Terms and Conditions Modoras Marriott Competition

By entering the Modoras Marriott Competition, you agree to the following conditions:

1. Information on how to enter forms part of the terms and conditions of entry. Entry into the promotion is deemed acceptance of these terms and conditions.

2. The promoter is Modoras Pty Ltd (ABN 86 068 034 908) of Level 3, 50-56 Sanders St, Upper Mount Gravatt Qld 4122 and Associated Entities (Promoter).

Eligibility

3. Entry is open to Australian residents (Eligible Entrants) excluding directors, management, employees (and their immediate families) of the Promoter and its related bodies corporate and registered travel companions of employees of the Promoter and its related bodies corporate.

4. Entry is open to all residents of Australia 18 years and over. The promotion commences at 12:00 pm (AEST) on 27 May, 2014 and closes by 6:00 pm (AEST) on 31 July, 2014 (Promotion Period).

Competition entry

6. To enter the draw, Eligible Entrants must complete the Competition Form with their answer to the question: In 25 words or less, tell us your new financial year’s resolution. Via the website: http://www.modoras.com/start-the-new-year-a-winner/

7. Incomplete, indecipherable, or illegible entries will be deemed invalid and will be rejected. The Promoter reserves the right to disqualify any entry where it reasonably suspects that such materials are prohibited by these terms and conditions, any relevant law, or are otherwise deemed inappropriate. This is at the Promoter’s absolute discretion and discussions will not be entered into.

8. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to Associated Entities, third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.modoras.com. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian privacy laws or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.

Judging

9. The winner will be the most creative entry received by the Promoter which satisfy the eligibility requirements as set out in these Terms and Conditions.

10. This is a game of skill and chance plays no part in determining the winner. Each entry received during the Promotion Period will be judged based on the creativity and honesty of the response.

11. The prize draws for the 2 nights stay in Surfers Paradise Marriott will be conducted by the Promoter at Level 3, 50-56 Sanders St, Upper Mount Gravatt Qld 4122 on Friday 8 August 2014 by 6:00pm.

12. The winner will be notified by phone or email no later than 5:00pm on Thursday 15 August 2014. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.

13. It is a condition of accepting the prize that the winners must comply with all the conditions of use of the prize.

The prize

14. The prize is a gift voucher for a 2-night stay in a hinterland view room at the Surfers Paradise Marriott Resort & Spa.

15. The gift voucher is valid for a period of 6 months from the date of issue and subject to the hotel’s availability.

16. The prize is not redeemable for cash or other goods and services.

17. In the event of a prize winner being unable to satisfy these terms and conditions or forfeiting or not claiming a prize within 5 days of being notified by the Promoter that they are a prize winner, the Promoter reserves the right to award the prize to the Eligible Entrant whose entry was received next in time after the entries of other prize winners.

No Liability

23. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Promotion on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion:

a) cancel the Promotion and recommence it from the start on the same conditions; or
b) replace the Prize with an alternative Prize of equal or greater value.

24. The Promoter and their associated agencies and companies take no responsibility for Prize damaged or lost in transit, or late, lost or misdirected mail.

25. To the extent permitted by law, the Promoter, their partners, agents and suppliers are not liable for any death, misadventure, accident, injury, damage, loss (including but not limited to consequential loss) or claim that may occur:

a) during the competition
b) whilst undertaking any travel connected with their entry into the Promotion;
c) in the participation in any Prize;
d) as a consequence of late, lost or misdirected mail; or
e) due to the publication of any material, including any statements made by any staff member, journalist, other entrants or any other person.

26. The Promoter assumes no responsibility for:

a. any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise;
b. any theft, destruction or unauthorized access to, or alteration of such communications;
c. any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition;
d. any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise).

27. If for any reason this Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Promotion.

28. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.

General

29. The winners agree to the use of their name, image and photograph/s for publicity and Promotional purposes, without compensation, and agree that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s.

30. All of the Promoter’s decisions are final and no correspondence will be entered into.
