Terms & Conditions
2014 VRC Member Experience Promotion
1. The “2014 VRC Member Experience Promotion” (Promotion) is promoted by Victoria Racing Club Limited (ACN 119 214 078) of 488 Epsom Road, Flemington, Victoria, 3031 (Promoter).
2. The Promotion is governed by these terms and conditions (Terms and Conditions). Entry into the Promotion is deemed to be acceptance of these
Terms and Conditions. It is recommended that you read these Terms and Conditions in full.
3. The Promoter will accept entries for the Promotion from the date on which Lady Melbourne , Melbourne Girl and What Would Karl Do (Bloggers) post the link to the Promotion on the Blogger’s website (and any other site used by a Blogger, as agreed in writing between the parties) until Sunday 11.59pm on 31 August 2014 (Entry Period).
4. This Promotion is in no way sponsored, endorsed, administered by, or associated with, Facebook, Instagram or Twitter (Social Media Sites). By participating in the Promotion you are providing your information to the Promoter and not to a Social Media Site, and you agree to a complete release of each Social Media Site from any claims. Any questions, comments or complaints regarding the Promotion must be directed to the Promoter, and not a Social Media Site.
ELIGIBILITY AND ENTRY
5. Participation in the Promotion is open to non-members of Victoria Racing Club Limited who are permanent residents of Australia aged 18 years or older only (Eligible Entrants) who meet the Entry Requirements set out in clause 7 below.
a. following a link to the Promotion as provided by a Blogger on the Blogger’s own site or a Social Media Site; and
b. completing all required fields on the entry and validly submitting the entry form during the Entry Period,
(Entry Requirements).
8. Incomplete or ineligible entries will be
deemed invalid. The Promoter accepts no responsibility for lost, late or misdirected entries. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions.
9. Eligible Entrants may not enter the Promotion on behalf of a third party.
10. Eligible Entrants are not permitted to enter the Promotion more than once and can not enter the Promotion through more than one Blogger. The Promoter can disqualify any Eligible Entrant who enters more than once.
PRIZE AND PRIZE DRAW
11. The first valid entry drawn at random via a computer-generated selection at 10.00am on Monday 1 September 2014 (Prize Draw) will win a dining package in the Atrium Tiered Restaurant for 4 people to spend the day at Flemington as a VRC Member at Sofitel Girls’ Day Out on Saturday 13 September 2014 and is valued at approximately $600 (Prize).
12. The Prize Draw will take place at the Promoter’s Administration Office at 488 Epson Road (Promoter’s Address). The winner will be notified via telephone and mail (including email).
13. The Prize is subject to change at the discretion of the Promoter.
14. The Prize is non-transferrable, non- exchangeable and not redeemable for cash.
15. The winner must claim the Prize within 1 week of being notified that they have won the Prize. Failure to claim the Prize within 1 week will result in a redraw and you will not be entitled to any supplementary prize or benefit.
16. The redraw will take place at the Promoter’s Address at 10.00am on Monday 8 September 2014. The unclaimed Prize Draw winner will be notified via telephone and mail (including email).
17. The Prize must be taken as offered and cannot be varied unless authorised in writing by the Promoter. The Prize value includes GST and is in Australian dollars and is correct at the time of printing. The Promoter accepts no responsibility for any variation in Prize value.
18. The Prize is only valid for the date specified on the tickets or as agreed to by the Promoter, and are subject to any further terms and conditions imposed by the Promoter, including the ticketing and conditions of entry for Flemington Racecourse, found at vrc.net.au. Once awarded, the Promoter is not liable for any ticket that has been lost, stolen, forged, damaged or tampered with in any way.
19. If an event or any part of an event that forms the Prize is abandoned, called off, varied or postponed for any reason, then at the Promoter’s discretion, the Prize winner (and their companions) forfeits all rights to attend the relevant event and no cash or alternative tickets will be substituted for that element of the Prize. If the event is varied or postponed, the Promoter, where reasonable, will try to vary arrangements to allow the winner (and their companions) to attend the varied or postponed event (unless doing so would involve additional costs to the Promoter).
CONSENT TO PROMOTIONAL ACTIVITY AND PERSONAL DETAILS
20. The Prize winner acknowledges and consents to participating in promotional

By entering the Promotion, the entrant agrees that the Promoter may use this information for future direct marketing purposes and to help us improve our services, including by our sponsors. Entrants’ personal information may also be provided to third parties for the purpose of administering this Promotion or providing the Prize. Entrants may access the information that the Promoter holds about them by contacting the Promoter’s Privacy Officer at 488 Epsom Road, Flemington, Victoria, 3031.
GENERAL
22. These Terms and Conditions do not exclude or limit the application of any statutory provision (including a provision of the Competition and Consumer Act 2010 (Cth) where to do so would contravene that statute or cause any part of these terms and conditions to be void.
23. All entries become the property of the Promoters when submitted.
24. Entry will be deemed to be accepted at the time the entry is received in the entry database and not at the time of transmission or submission.
25. If, for any reason, the Promotion or the Prize is not capable of being run or offered as planned, the Promoter reserves the right in its absolute discretion to take any action that may be available to it. Such actions may
include cancellation, termination, modification or suspension of the Promotion. If the Promotion is not capable of being run, the Promoter will not be liable for any loss or damage of any kind to entrants arising out of any resultant action taken by the Promoter.
26. Unless required by any law, including the Australian Consumer Law, the Promoter, its related bodies corporate and their respective officers and employees, its agents, its contractors, its associated entities and their
respective officers will not be liable for any loss (including but not limited to, indirect, special or consequential loss, loss of opportunity or loss of profits), expense, damage, personal injury or death which is suffered or sustained in connection with any part of this Promotion (including entry, collation of contestant details, the Prize draw and determination of the Prize winner), promotion of this Promotion, use or acceptance of the Prize or the Prize itself, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum extent allowable by law).
27. The Promoter warrants that the purchase of alcohol will not be used as an inducement to enter the Promotion or encourage: rapid or irresponsible consumption of alcohol; intoxication; the consumption of alcohol by minors; anti-social behaviour; or the consumption of in restricted alcohol or alcohol-free zones. Entrants will be refused service of alcohol or provision of an alcoholic beverage prize if it would breach any laws or codes including those relating to the responsible service of alcohol. The Promoter supports the responsible service of alcohol.
28. The Promoter may at its absolute discretion cancel or suspend the Prize or cease to provide any Prize to the winner (or their companions) where, in the reasonable opinion of the Promoter, the winner (or their companions) are under the influence of alcohol or drugs, behaving aggressively, disruptively, or in a manner which may diminish the good name and reputation of the Promotion, the Promoter or its products and brands, or are engaging in conduct that is misleading, deceptive, contrary to law or is otherwise inappropriate or in breach of any of the Promoter’s terms and conditions.
29. The Promoter's decisions in connection with the Promotion and the Prize are final and no correspondence will be entered into.
