Facebook Like competition terms and conditions
1. These terms apply. Entry into this competition constitutes acceptance of these terms and conditions. Entries must comply with these terms and conditions to be valid. This competition is governed by the laws of NSW.

2. Promoter. The promoter of this competition is Financial Literacy Australia Ltd ABN 46 158 813 891, Level 4, 105 Kippax St, Surry Hills NSW 2010 (“Promoter”).

3. Competition period. Competition period. This competition commences at 5:01pm (AEST) Friday 1 August 2014 and closes at 4.59pm (AEST) Monday 11 August 2014 (“Competition Period”).

4. Eligibility. Entry is only open to Australian residents who:
1) are 13 years of age and over (as at 11 August 2014).
2) are not:
a) Current employees of the Promoter; or
b) immediate family members of employees of the Promoter.
3) Eligible Entrants. The Promoter may request any entrant at any time to provide reasonable evidence that he or she meets the eligibility requirements and a failure to do so will result in disqualification from this competition.

5. How to Enter. To enter this competition, Eligible Entrants must, during the Competition Period, go to the MoneySmart Week Facebook page at http://facebook.com/moneysmartweekau1 and “Like” the page and then fill in the Entry form.
5.1) A valid Entry is one which includes complete and accurate contact details for the Eligible Entrant including their first and last name and email address (“Contact Details”).
5.2) Eligible Entrants may only submit one (1) Entry during the Competition Period.
5.3) The Promoter accepts no responsibility for late, lost, incomplete, incorrectly entered or misdirected Entries (whether or not before or after receipt by the Promoter) or for any technical difficulties or equipment malfunction (whether or not under the Promoter’s control) including inaccessibility of any website during the Competition Period.

6. Draw details. On the day following each day of the Competition Period (e.g. 2 August to 12 August), one winner will be randomly drawn from Eligible Entries received. The draw will be conducted via the Promoter’s competition mechanism, Woobox.

7. Prizes. There are ten (10) prizes to be won. 10 x $50 eftpos gift cards. The total prize pool is valued at $500.00.

8. Notification. The Prize Winners will be notified by an email (“Notification Email”) sent by the Promoter to the email address provided within two business days of the draw. It is the responsibility of the relevant Eligible Entrant to ensure that the Contact Details are true and accurate and to respond to the Notification Email within 3 business days of the Notification Email being sent (“Final Response Date”). The Promoter is not responsible for contacting the Prize Winners by any other method or for the relevant Prize Winners not receiving the Notification Email for any reason (including, without limitation, due to any technical difficulties or equipment malfunction (whether or not under the Promoter’s control. Subject to paragraph 10(2), the Promoter will not notify any other entrant except the Prize Winners.

9. Claiming the Prizes. To claim their Prize, the relevant Prize Winners must respond to the Notification Email on or before the Final Response Date, including a postal address.
1) Once a Prize Winner has responded to the Notification Email on or before the Response Date:
a) they will be publically announced on the MoneySmart Week Facebook page as the Prize Winner of the Prize; and
b) the Promoter will use its reasonable endeavours to advise the Prize Winners as to how the Prizes are to be distributed within 3 business days of the relevant Prize Winners responding to the Notification Email.
2) If one or more of the Prize Winners does not respond to the Notification Email on or before the Final Response Date, the Prize Winners Entry will be deemed null and void (and no compensation will be paid in lieu).

10. Second Chance Draw. For any prizes not claimed, there will be a second chance draw. All Eligible Entries received during the Competition Period, excluding prize winners, will be automatically entered into the Second Chance Draw element of this competition, if it is required.

11. Other conditions relevant to the Prizes. Subject to any written directions given by the NSW Office of Liquor, Gaming and Racing:
1) the Prizes are not transferable, exchangeable or redeemable for cash or any goods or services. The Promoter accepts no responsibility for any variation in the value or availability of the Prizes. The Promoter reserves the right in its absolute discretion and for any reason to substitute one or all of the Prizes (or any part of a Prize) for a prize of similar retail value or specification if, for any reason beyond the Promoter’s control, the Promoter is not able to give the Prize Winners one or all of the Prizes;
2) acceptance and use of the Prizes is subject to any and all terms of use issued by the manufacturer or supplier of the Prize, or any sponsor of the Prizes; and
3) the Promoter will not replace or substitute the Prizes or provide compensation where the Prize Winners are unable to claim or use the Prizes for any reason including cancellation or discontinuance or unavailability of the Prizes, inclement weather or illness or where any of the Prize Winners do not receive the Notification Email or do not receive the Prizes through providing incorrect Contact Details.

12. Liability and Release. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) shall not be liable for any loss or damage whatsoever that is suffered or sustained (including but not limited to indirect or consequential loss) or for any death, illness, personal injury or property damage suffered or sustained (even caused by negligence), as a result of, or in any way connected with, this competition or accepting, using or enjoying the Prizes. The Promoter is not responsible for any defects in the Prizes and takes no responsibility for the loss or theft of the Prizes or misuse of the Prizes. To the extent permitted by law, all entrants in this competition agree to release, fully indemnify and keep fully indemnified, the Promoter (including its officers, employees and agents) from and against all liability, cost, loss, damage, expense, claim or other right of action arising out of, or in connection with, this competition or accepting, using or enjoying the Prizes including (but not limited to) death, illness or personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission or otherwise.

13. Warranty by Entrants. Each entrant warrants that: their Entry is their own original work and their own true story; and it does not infringe the copyright or other intellectual property rights or moral rights of any other person. The entrant indemnifies the Promoter from all liability arising from a breach of this term.

14. Variation and cancellation. Subject to any written directions given by the NSW Office of Liquor, Gaming and Racing, the Promoter reserves the right, at its sole discretion, to vary the rules of, or cancel, this competition. The Promoter will not be liable for any loss or damage to any party arising from any variation, cancellation or otherwise of the competition.

15. Disqualification. The Promoter may at any time (and at its sole discretion) disqualify any entrant for:
a) tampering with the Entry or competition process, including by exceeding the limitation on the number of entries or acting in a manner that affects the fairness of the competition; or
b) otherwise breaching these terms and conditions.
1) Entrants acknowledge and agree that they:
a) are solely responsible for the content of their Entry and must ensure that they comply at all times with all applicable terms and conditions of the MoneySmart Week Ambassador Competition; and
b) must not attempt to interfere with or undermine the operation of the competition, or otherwise attempt to obtain any unfair advantage.

16. Ownership of Entries. Each entrant acknowledges and agrees that each Entry submitted in connection with this competition is assigned to the Promoter upon submission and becomes the property of the Promoter and will not be returned to the entrant. The entrant transfers all intellectual property rights in the Entry to the Promoter (including copyright) and consents to any use of their Entry (other than Personal Information) which may otherwise infringe their moral rights pursuant to the Copyright Act 1968. Without limitation, the Promoter may use or reproduce any Entry (in whole or part) in any publication, printed matter, online or in other media without any further reference or payment or other compensation to the entrant.

17. Privacy Notice. The Promoter will deal with any personal information that is collected from entrants as part of this competition (“Personal Information”) in accordance with the Information Protection Principles under the Privacy and Personal Information Protection Act 1998 (NSW). The Promoter collects entrants’ Personal Information in order to conduct the competition and may, for this purpose, disclose such information to its officers, employees and agents and third parties, including any sponsors or suppliers of the Prize. Entrants must provide the Personal Information otherwise their entries will be invalid. The Promoter may, for an indefinite period and unless otherwise advised by the Promoter, use the entrant’s Personal Information for promotional, marketing and publicity purposes including, but not limited to, sending electronic messages to, or telephoning, the entrant. Personal Information will be stored by the Promoter at the address given above and entrants may contact the Promoter by mail at the address above to access or correct their Personal Information.
