TERMS AND CONDITIONS

 

On entering this competition you are agreeing to the following terms and conditions:

 

1.         STANDARD TERMS                                                                                                                                 

1.1           Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed acceptance of these conditions of entry.

1.2           This is a game of chance and the winner will be drawn randomly.

 

2.         WHO CAN ENTER?

2.1           Subject to clause 2.3, entry is open only to residents of Australia over 18 years of age.

2.2           There is a limit of one (1) entry per person.

2.3           Employees and families of the Promoter or the prize suppliers or any of their agencies associated with the Competition or Program are not eligible to enter. This includes a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption)

2.4           WARNING: Any attempt by the Entrant and/or his/her family/friends to enter more than the number of times authorized herein, using any third party proxy voting services, using multiple names or e-mail addresses and/or any other fraudulent mechanism(s), including robotic, automatic, programmed or similar methods, shall give the Promoter, in its sole discretion, the right to disqualify the Entrant’s Entry.

 

 

3.         HOW TO ENTER

3.1           The competition commences on 1st April 2014 and closes at Midnight on 31st August 2014.

3.2           Entrants can enter via the iHealth saunas Facebook page and fill out all the required fields before ‘Liking’ iHealth Saunas on our Facebook page linked to this site. Entrants are required to complete all fields on the site(s) including an email address by means of contact. Entry via the Facebook page requires a personal Facebook account.

3.3           Failure to comply with the above conditions or complete all fields required will deem the entry invalid and no correspondence will be entered into.

 

4.         THE PRIZE AND DETAILS OF PRIZE DRAW

4.1           There is one (1) prize to be won with a total value of AU$3500.00

 

4.2           The first valid entry randomly drawn from the national pool will win a Base model 1 person iHealth Infrared Sauna Cabin valued at a recommended retail price of AU$3500.00

4.3           The prize does not include delivery to the winner and must be claimed and picked up by the winner, at the winner’s expense from any of our warehouses in New South Wales, Queensland, South Australia, Western Australia, Canberra or Tasmania.  The prize includes delivery if the winner resides in Victoria.

 

4.4           The prize is not transferable and cannot be redeemed for cash.

4.5           Winners of the prize should seek independent financial advice about any tax implications that may arise from the prize winnings.

4.6           The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.

4.7           In participating in the competition, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed, filmed for broadcast and photographed. The winners agree to grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winner (and his/her companion) will not be entitled to any fee for such use.

4.8           The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.

4.9           If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

4.10        The prize draw will take place at iHealth Saunas Head Office, Vermont Victoria when 10,000 Facebook ‘Likes’ in total have been recorded on our Facebook page or at midday on Monday 1st of September 2014 if the total number of ‘Likes’ has not been achieved.  The winners will be notified by email & Facebook Message and the winner’s name will be published on the iHealth saunas website and in the classifieds section of The Australian newspaper on the Wednesday 3rd September 2014.

4.11        If any prize is unclaimed a redraw will take place (subject to any directions from a regulatory authority) at Midday on 1st October 2014. In the case of a re-draw the prize winner will be notified by mail and the winner’s name will be published in The Australian Newspaper on the Friday 3rd of October 2014.

4.12        As a condition of accepting the prize, the winner must sign legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

4.13        The Promoter’s decision is final and no correspondence will be entered into.

 

    NO LIABILITY

 

5.1           This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Eligible persons understand that they are providing their information to the Promoter and not to Facebook. The information an Eligible Person provides will only be used for the purposes outlined in these Conditions. Any questions, comments or complaints about this Competition must be directed to the Promoter and not to Facebook.

 

5.2           The use of any automated software or any other mechanical or electronic means that allows an entrant to automatically enter or ‘Like’ a Facebook Page repeatedly is prohibited and will render all entries and feedback submitted by that entrant invalid.

 

5.3           CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS COMPETITION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.

 

5.4           In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to government legislation
