WIN A TRIP ANYWHERE WITH YALUMBA Y SERIES
TERMS AND CONDITIONS OF ENTRY - GAME OF CHANCE (“Terms and Conditions”)
1. Promotion name

Win a trip anywhere with Yalumba Y Series (“Promotion”).
2. Conditions of entry

a) Information about the Promotion and how to enter forms part of these Terms and Conditions. Entry into this Promotion is deemed acceptance of these Terms and Conditions by each entrant. Entries not made in accordance with these Terms and Conditions will be disqualified. b) The promoter is S Smith & Son Pty Limited ACN 007 871 427 of Eden Valley Road, Angaston SA 5353 trading as Yalumba Wine Company (“Promoter”). c) For the purposes of these Terms and Conditions, the Promoter includes all related and subsidiary companies, past, present and future officers, agents, representatives, employees and assigns of S Smith & Son Pty Limited ACN 007 871 427. d) Employees and their immediate families are not permitted to enter the Promotion. e) Entry is free and open to residents of Australia aged 18 and over (“Entrant”) who enter the Promotion in the manner stipulated in these Terms and Conditions.
3.Duration of the Promotion

Entry into the Promotion opens at 12.00 am (AEST) Monday, 22 September 2014 and closes 11.59 pm (AEST) Monday, 3 November 2014 (“Promotional Period”).
4. The prize:

a) One prize comprising a $10,000.00 Flight Centre Limited ACN 003 377 188 Voucher, valued at $10,000.00 (“Prize”). 2 of 7 b) The Prize may not be transferred or substituted, except at the Promoter's discretion. The Promoter reserves the right to substitute the Prize for a prize of equal or greater value due to Prize unavailability. c) The Prize will be delivered to the winner’s address as agreed upon or any other method agreed between the winner and the Promoter. d) The Promoter shall not be liable for any costs associated with the Prize after delivery to the Prize winner.
5. How to enter

a) Entrants can enter in the following way: I. by purchasing a Yalumba Y series product from retail and on-premise venues in New South Wales, Victoria, Queensland, South Australia, Australian Capital Territory, Tasmania and Western Australia during the Promotional Period; and II. by completing and submitting the online entry form at www.yalumbayseries.com b) Entrants will be required to provide their full name, address, state, D.O.B. or age, gender, a valid email address and mobile number. c) Entrants must retain proof of purchase in the form of a receipt of purchase of a Yalumba Y Series product (bottle or on-premise bottle or glass) within the Promotional Period. d) Entries will be deemed to be accepted at the time of receipt of the completed online entry form by the Promoter and not at the time of transmission. e) Entries must be received by the Promoter during the Promotional Period. The Promoter accepts no responsibility for late, lost or misdirected entries. f) Any costs associated with accessing the www.yalumba.com.au website remain the responsibility of the Entrant and are dependent upon the Internet Service Provider used by the Entrant. 3 of 7 g) Entries not completed in accordance with these Terms and Conditions or received after the expiry of the Promotional Period will not be considered. The outcome of the draw is final and binding on every person who enters. No correspondence will be entered into by the Promoter. h) Incomprehensible and incomplete entries will be deemed invalid. i) Entrants may enter into the Promotion multiple times, provided that: a) Entrants make no more than one entry per 24 hour period regardless of the number of Yalumba Y Series products purchased in that period. b) Proof of purchase must be retained and provided on request and the date, time and place of purchase on the tax invoice must match the date provided in the electronic entry submission. j) The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, has engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or the Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type as described in this clause.
6. The Draw

a) The electronic prize draw (NSW approval number 525, SA approval Number 959) will take place at Parkside Offices, 108 Glen Osmond Road, Parkside SA 5063 at 10.00 am (AEST) Monday 10 November 2014 b) If the winner cannot be notified within 30 days an unclaimed prize draw will take place at Parkside Offices, 108 Glen Osmond Road, Parkside SA 5063 at 10 am (AEST) on Monday 22nd December 2014.
7. Notification of winners

a) The winner will be notified by phone or email within one business day of the draw and in The Australian Newspaper on Monday 24 November 2014 b) In order to claim the Prize, the winner must confirm its desire to do so in writing by 4 of 7 5pm on Tuesday 2 December, 2014. If the winner fails to do this by the deadline, the winner will be deemed to have forfeited the Prize and an unclaimed Prize draw will take place. c) Should an Entrant’s contact details change during the Promotional Period, it is the Entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter. d) The Prize will be delivered within Australia only to the nominated prize delivery address specified in the winner’s entry. e) The Promoter reserves the right to request winners to provide proof of identity; proof of residency at the nominated prize delivery address and or proof of entry validity in order to claim the Prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that the winner cannot provide suitable proof, the winner will forfeit the Prize in whole and no substitute will be offered to the winner by the Promoter. f) If for any reason a winner does not claim the Prize within the timeframe stipulated by the Promoter, then the Prize will be forfeited and a redraw will occur four weeks from the date of the draw, being Monday 8 December 2014. g) Should an unclaimed Prize draw occur, the winner will be notified by phone or email within one business day of the draw and in The Australian Newspaper on Monday 22 December 2014. h) The Prize must be taken as offered and is non-refundable, non-transferable and non-redeemable for cash or other goods or services. i) Once the Prize has left the Promoter’s premises, the Promoter takes no responsibility for Prizes damaged, delayed or lost in transit. j) Without limiting any other provision of these Terms and Conditions, it is a condition of accepting the Prize that the winner must comply with all the conditions of use of the Prize and the Prize supplier’s requirements; and may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
8. General Terms

5 of 7 a) The Promotion is conducted by the Promoter. b) To the maximum extent permitted by law, the Promoter shall not be liable for any claims, costs, expenses, personal injury, death, loss (including loss of opportunity) or damage whatsoever (including but not limited to indirect or consequential loss or damage) suffered, sustained or incurred (including but not limited to that arising as a result of any negligent act or omission) as a result of, or arising out of, or in any way connected with: I. this Promotion (including participation or attempted participation in the Promotion by an Entrant); II. the Prize (including use or attempted use of the Prize); III. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); IV. any theft, unauthorised access or third party interference; or V. any entry that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter). c) The Promoter is not responsible for any incorrect or inaccurate information, either caused by the Entrant or by any of the equipment or programming associated with or utilised in this Promotion, or for any technical error, or any combination thereof, that may occur in the course of the administration of this Promotion. d) By participating in the Promotion, an entrant also acknowledges that a further primary purpose for collection of the entrant's personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the entrant in the future with information on special offers or to provide the entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners who may contact the entrant with special offers in this way. By entering the Promotion, an entrant acknowledges and agrees that the Promoter may use the entrant's personal information in the manner set out in this condition. 6 of 7 e)If for any reason this Promotion is not capable of running as planned, including (but not limited to) due to infection by a computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to take any action that may be available, and to cancel, terminate, modify or suspend the Promotion, subject to any direction given under any applicable laws or regulations, including to disqualify any Entrant who tampers with the entry process. f) The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. g) The promoter encourages responsible consumption of alcohol. In no way does this competition promote irresponsible consumption of alcohol. Enjoy your wine with food and alternate wine with water. Do not drink and drive.
9. Privacy

a) The Promoter is collecting Entrants’ personal information for the purpose of conducting and promoting this Promotion (including but not limited to determining and notifying winners). b) The Entrant’s personal information may be disclosed to representatives and agents acting on behalf of the Promoter or assisting the Promoter in the administration of this Promotion, including Prize suppliers and deliverers. The personal information provided by Entrants in connection with the Promotion will be used by the Promoter in accordance with these Terms and Conditions and in accordance with the Promoter’s privacy policy which can be viewed at [http://www.yalumba.com/content.asp?p=218]. c) Entrants’ personal information may be disclosed to State and Territory lottery and regulatory departments (as required) and winners’ names published as described under these Terms and Conditions and as required under the relevant lottery legislation (as applicable). A request to access, update or correct any personal 7 of 7 information of an Entrant should be directed to the Promoter. d) Each Entrant consents to the Promoter using an Entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. e) Authorised under NSW Permit No: LTPS/14/06147 SA Licence No: T14/1417; Vic Permit No 14/4832;
