Terms and conditions

    1. Information on how to enter forms part of the terms and conditions of entry. Entry into the competition is deemed acceptance of these terms and conditions.
    2. The Promoter is AGL Energy Limited (ABN 74 115 061 375) of 120 Spencer Street, Melbourne VIC 3000, telephone 131 766.
    3. Entry is open to all New South Wales, South Australian and Victorian residents who are 18 years of age or over, who make a purchase from AGL in accordance with these terms and who are not Excluded People.
    4. Employees, contractors of AGL Energy Limited or any AGL franchise, and their immediate families, are not eligible to enter the competition (Excluded People).
    5. The Competition commences on Saturday 1 November 2014 at 9:00 (AEDT) and concludes on Monday 5 January, 2015 at 20:00 (AEDT) (the Promotional Period). No responsibility is accepted for lost, late, ineligible or misdirected entries.
    6. Every purchase valued at $150 or more of cooling products (fans, portable air conditioners, ducted air conditioners and split system air conditioners), cooling services, or repairs to cooling appliances from AGL during the Promotional Period will be eligible for one valid entry into the prize draw. The customer must enter by completing the online entry form at agl.com.au/coolsummer including proof of purchase (valid invoice details) by the end of the Promotional Period. Proof of purchase must be presented to claim the prize.
    7. The Promoter reserves the right to verify the validity of entries and to disqualify any entry of any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions of entry or who has, in the opinion of the Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter.
    8. The Prize winner will be randomly selected from all eligible entries received. The Draw will take place at Zebra Direction Pty Ltd, 300 St Kilda Rd, St Kilda VIC 3182 on Thursday 8 January 2015 date at 11am (AEDT).
    9. The first valid entry randomly drawn will win the "Cool Summer Experience - On the Green" package, for two people.
    The "Cool Summer Experience - On the Green" package comprises of two tickets to Sting and Paul Simon “on the green” at Mt Duneed Estate in Geelong, Victoria (Concert & Dining package) on Saturday 7 February 2015, one night’s accommodation (twin share) at the Geelong Mecure Hotel, limousine transfers from either Avalon airport or a Melbourne CBD location to the Geelong Mercure Hotel, return airfares from either Sydney or Adelaide airports to Avalon airport, transfers from Mecure Geelong Hotel to Avalon airport (or Melbourne CBD location) and a $200 prepaid Visa card. The prize has been procured and supplied by Zebra Direction. It will be delivered to the winners within 1 week of the draw and must be used for the Cool Summer Experience – On the Green on February 7 2015. The prize is transferrable, but not redeemable for cash.
    10. The total prize pool is no more than $3,670.
    11. The winner will be notified by phone or in writing within 3 working days of the draw. The winners name will be published on the agl.com.au website and in the Public Notices in The Australian newspaper on Wednesday 14 January 2015.
    12. Subject to any direction given under relevant State legislation, an unclaimed prize draw will take place at Zebra Direction Pty Ltd, 300 St Kilda Rd, St Kilda VIC 3182 on Thursday 22 January 2015 date at 11am (AEDT). The winner/s of the unclaimed prize draw will be notified of their prize via phone and will have their details published on the agl.com.au website and in the Public Notices in The Australian newspaper on Wednesday 28 January 2015.
    13. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed receiving the prize.
    14. Should an entrant's contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
    15. The Promoter's decision is final and no correspondence will be entered into.
    16. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
    17. In the case of the intervention of any outside act which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms, the Promoter may in its absolute discretion cancel the competition and/or recommence it from the start on the same conditions, subject to any written directions given under State Regulation. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any directions from a regulatory authority.
    18. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information provided by the entrant, or for any of the equipment or programming associated with or utilised in entering this competition.
    19. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages.
    20. The Promoter, is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying the winner) and may be used to market the Promoter’s services to the entrant (see Privacy Notice below).
    21. Entrants' personal information may also be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter.
