Club Membership terms and conditions In these Terms and Conditions: Take 5 Club Card means a membership card issued pursuant to this Program; Member means an individual who is an Australian resident whose application to take part in the Program is accepted; Membership means membership in this Program. Program means the Take 5 Club operated pursuant to these Terms and Conditions by the Promoter; Promoter is Bauer Media Pty Ltd, 54 Park Street, Sydney, NSW 2000 (ABN 18 053 273 546) Telephone: 02 9282 8000. By completing the Membership application form located at www.take5mag.com.au or using a Take 5 Club Card (hereafter the Card), each Member (and applicant) accepts and agrees to be bound by these Terms and Conditions and any variations made from time to time to these Terms and Conditions.
Membership in the Program is only open to individuals who reside in Australia and is subject to acceptance of application. Individuals under the age of 18 years must have parental or legal guardian consent to become a Member of the Take 5 Club. Membership only established on receipt and acceptance of original application of the Member by the Promoter. The Promoter may refuse any application in their absolute discretion.
To become a Member of the Program, the individual must complete a Membership application form available at www.take5mag.com.au. Please allow two weeks for the date of receipt of the application by the Promoter for delivery of Card.
Only one Membership per person.
Only original application forms from the Take 5 website (www.take5mag.com.au) will be accepted. Photocopies and facsimiles are not permitted.
No responsibility is accepted for any late, lost or misdirected applications or Cards.
Each Card will remain the property of the Promoter and must be returned on demand. It is not a credit or a payment card. Any lost Card may at the discretion of the Promoter be replaced. In the event of replacement the Member will be required to pay a replacement fee to the Promoter before delivery of the Card. A Member must notify the Promoter immediately if the Card is stolen or lost, at the Take 5 Contact Point. The Promoter is not liable for any delay in replacing a Card.
Members Card can only be used by the Member who is named on the front of the Card and whose signature appears on the reverse.
Membership entitles the Member to promotional offers, extra content and puzzles available on the Take 5 website, events, blogs and competitions. Notwithstanding the forgoing, nothing shall prevent the Promoter from offering promotional offers and competitions to individuals who are not Members. All promotional offers and competitions offered to Members will only be offered in accordance with the Terms and Conditions for those promotional offers and competitions.
The Promoter in its sole discretion will determine what promotional offers are offered to Members and makes no guarantee as to the availability of any promotional offers.
To the extent permitted by law, the Promoter will not be liable for any delays, disruptions, omissions or errors in the operation of the Program including technical or mechanical malfunctions, and will not be liable for any loss caused by any such delays, disruptions, omissions or errors.
The Member acknowledges and agrees that all decisions pertaining to this Program rests solely with the Promoter and its decision is final. The Promoter in its sole discretion can at all times: (i) change, amend or vary these Terms and Conditions; (ii) change, amend, vary, withdraw or cancel any promotional offer offered to Members; (iii) exclude a Member from, or cancel a Members Membership in the Program, without prior notice and without prior notice to a Member. The Promoter gives no warranty as to the continuing availability of the Program. The Promoter may, in its absolute discretion, at any time cancel the Program in whole (or in part) upon reasonable notice (reasonable notice being no less than 1 week).
Without limiting Clauses 11 and 12 in any way, Members will be taken to have received notice of any changes to these Terms and Conditions if the Promoter notifies the Member of the change by any method including, but not limited to the use of email and or posting details of the changes on the Promoter’s website.
Without in any way limiting the rights of the Promoter, if a Member is in breach of these Terms and Conditions, at any time, then the Promoter may cancel the Members Membership with the Program and any Member whose Membership is cancelled may no longer access Member promotional offers or any other related benefits.
To the full extent permitted by law, the Promoter, its related bodies corporate, employees, directors, suppliers and agencies is not liable for any loss or damage suffered by Members resulting from such withdrawals, cancellations, variations or change as set out in Clauses 12, 13 or 14 or otherwise in the terms of, and arising out of this Program.
Privacy: The Promoter collects personal information (“PI”) in order to conduct the Take 5 Club and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Membership is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.bauer-media.com.au/privacy.htm.In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the member. Members should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All memberships become the property of the Promoter. Entrants’ PI will not be disclosed to any entity outside of Australia.
The Terms and Conditions and Membership in the Program are governed by and will be construed in accordance with the laws of the State of NSW, irrespective of where the application for membership has been completed by the Member or submitted.
Nothing in these Terms and Conditions affects any rights a Member may have and which by law may not be excluded under any statute including the Competition and Consumer Act (2010).

Take 5 Club Dreamworld Promotion 2014 Terms and Conditions

Information on how to enter and prizes form part of these Terms and Conditions. Participation in the promotion is deemed acceptance of these Terms and Conditions.
The promotion is open to Australian residents who are current or new members of the Take 5 Club during the promotional period. Employees of the Promoter, their immediate families, authorised outlets and agencies associated with this promotion are ineligible to enter. Only one entry per day is permitted per Club member.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who does not participate in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Errors and omissions will be accepted at the Promoter’s discretion.
The entire promotion commences on Thursday 31 July 2014 and closes at 11:59pm (AEST) on Wednesday 22 October 2014. The draw will take place on Friday 31 October 2014 at 11.00am (AEST) at the Promoter’s premises, 54 Park St, Sydney NSW 2000. The winner will be notified in writing using the details given in their membership within two (2) business days of the draw, and the winner will be published in Take 5 issue 49, on sale 27 November 2014.

8.     Prize:
The first two (2) valid entries drawn from all valid entries received will win: One Dreamworld Holiday for 2 Adults and 2 Children (0-12 yrs inclusive), valued at up to $11,643.92 each. Each holiday includes:

Return airfares for 2 adults and 2 children (0-12 yrs) from the winner’s nearest major airport to Gold Coast or Brisbane,  valued at up to $4012
3 Nights’ Accommodation for four in a Resort Room at Paradise Resort Gold Coast, valued at up to $1167
21 day Holiday World Pass for four people (Up to 21 consecutive days of unlimited entry to Dreamworld, WhiteWater World and SkyPoint Observation Deck) valued at up to $719.92
Tiger Photo Experience, valued at $345 (participants must be over 10 years of age)
One hour VIP access to the Big 9 Thrill Rides at Dreamworld before the park opens, valued at $5,000

The total prize pool is valued at $23,287.84 (including GST). Prize does not include any ancillary costs associated with redeeming this prize. These are the responsibility of the winner.

Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.  All elements of the prize are valid for 2 adults and 2 children (0-12yrs inclusive), subject to age and safety restrictions.
To take part in the Tiger Photo Experience, participants must be over 10 years of age and up to 15 years must be accompanied by a paid participating Adult. This portion of the prize is subject to age and safety restrictions.
VIP access to the Big 9 Thrill Rides is subject to height and safety regulations of each ride and prize winners must remain with their host at all times until Dreamworld opens to the public.  Thrill rides are subject to closure for maintenance issues.
The prize is subject to availability, cannot be taken during Australian school holidays (inclusive of all Australian States) or during Gold Coast 600 Event dates, and is valid for a period of 12 months from the original draw date. Validity date of this prize cannot be extended.
The prize winner will be required to provide at least 3 weeks notice of intent to travel.   All components of prize are subject to availability at time of booking.
If the winner resides within a 3-hour drive or 240km from Dreamworld and WhiteWater World, airfares and car rental are not included in the prize.
Once booked, any changes made to the booking may incur a cancellation fee of amendment fee, at the cost of the winner.  The winner of the prize (and their travel companions) will not accrue any frequent flyer points from taking the prize.
All components of the prize must be taken together. Travel Insurance is not included. Travel Prize does not include meals, spending money or transport to and from departure and arrival points. All other ancillary and travel costs are the winner’s responsibility.  All additional costs incurred whereby the prize winner wishes to make variations to the travel are the winner’s responsibility and must be booked separately by the winner.  All travel variations are subject to approval by Ardent Leisure Limited upon booking.  Travel variations include, but are not limited to extension of travel duration, travellers outside of the age restriction and additional travellers.
Prizes cannot be transferred, exchanged or redeemed for cash. In the event a winner does not take the prize by the time stipulated, then the prize will be forfeited by the winner and cash will not be awarded in lieu of prize.  Prizes must be taken as offered and cannot be varied.  Any unused portion of the prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash.
If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian on behalf of the winner.  It is the responsibility of the winner’s parent/legal guardian to prove their parental status/ legal guardianship at the time of winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a winners parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to and administrative fees incurred by the Promoter). Where relevant, the Promoter is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. The Promoter is not responsible for determining any other delivery details or taking direction that relates to any ongoing family law negotiations and/or determinations. These are the responsibility of the winner and their respective parent/s and/or legal guardian/s.
The prize will be delivered to the nominated address of the Prize winner. Delivery of the Prize is valid to any state and/or city in Australia.
In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.
In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.
The promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).
The Promoter is not responsible nor liable for any prize damaged in transit in the delivery of their prize
A draw for any unclaimed prizes may take place on 30 January 2015 at the same time and place as the original draw, subject to any directions from a regulatory authority.  Winners, if any, will be notified in writing using the contact details in their membership within two (2) business days of the unclaimed prize draw and will be published in Take 5 issue 10, on sale 26 February 2015.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including  but not limited to natural disaster)the  Promoter reserves the right to subject to reference to all relevant  state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.
If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.
If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoter requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize the winner sign any such legal documentation.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Terms and Conditions

Information on how to enter and prize forms part of these Terms and Conditions. By entering this promotion, the entrant confirms that they have read and understood these Terms and Conditions and deems to accept them.
Entry is open to all residents of Australia. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
The Promotion commences on 04 September 2014 and entries close 17:00pm (AEDST) on 9 October 2014 (“Promotional Period”). The judging will be done by a panel of judges appointed by the Promoter. The judging will take place at Bauer Media 54 Park Street, Sydney NSW 2000 on 21/10/2014. The winner will be notified in writing and by telephone using the contact details given in their entry.
To enter, individuals must during the Promotional Period:
purchase any Take 5 Issue either 37,38, 39,40 or 41 magazine (on sale 04/09/14, 11/09/14, 18/09/14, 25/09/14 and 02/10/14 respectively) during the promotional period; and
Send in 200 words or less “why your four-legged friend deserves to win?” including their full name, address, daytime contact number and attach a photograph of their dog to take5@bauer-media.com.au; or Mail: on a A4 sized piece of paper including in 200 words or less “why your four-legged friend deserves to win?”, their full name, address, daytime contact number and attach a photograph of their dog (maximum size photograph to be 4×6 size) to: Take 5 Magazine, Bauer Media, GPO Box 3525 Sydney NSW 2000.Original copies of entries including photographs will not be returned to entrants from the Promoter. Please note to send copies of photograph only.
All entrants warrant that the photograph is owned by the entrant and the pet (dog) featured in the photograph is owned by the entrant. The promoter is not responsible for any dispute (including family dispute) as to the ownership of the animal. The entrant also warrants they have obtained the consent of any third parties that appear in the Photograph. Each entrant warrants that Entrants indemnify the Promoter for any breach of this warranty.
A selection of entries received may be published in future issues of Take 5 magazine. Such publications may not be an indication of the final winner. All entrants who have their entry featured may be required to sign a declaration in a form determined by the Promoter in its absolute discretion.

Consumers may enter as many times as they wish, however, each mail entry must be posted in a separate stamped business-sized envelope (220mm x 110mm or smaller) and contain an official entry coupon. Only original entry forms from magazines in official circulation are valid. Entries from newsagents’ returns will not be accepted. Only one prize will be awarded per person, excluding SA residents in Australia and excluding 190 and SMS competitions. For the sake of clarity, except for SA residents, a winner’s entry will not be entered back into the draw or included in the unclaimed prize draw. SMS and 1900 competitions are not available in New Zealand.
The Promoter reserves the right, at any time, to verify the validity of claims and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process (including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS or 190 call costs). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
