1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to residents of Australia. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
3. Employees (and their immediate families) of the Promoter, participating stores and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. Promotion commences on 08/12/2014 and ends at 11:59pm AEDST on 15/02/2015 (“Promotional Period”). A prize draw will be conducted for the entries received each week of the Promotional Period (“Weekly Prize Draw”), and a prize draw will also be conducted at the end of the Promotional Period for all entries received during the Promotional Period (“Major Prize Draw”).
5. To be eligible to enter, individuals must purchase, in one (1) transaction, any two (2) STAEDTLER products that contain a barcode from any participating store in Australia during the Promotional Period (“Qualifying Purchase”). For the purposes of this promotion, a participating store is any store in Australia that sells STAEDTLER products.
6. To enter, individuals must then complete one (1) of the following entry mechanics during the Promotional Period:

Facebook Entry: a. visit the Promoter’s Facebook Page at www.facebook.com/STAEDTLERAustralia (“Facebook Page”). Only individuals with a current Facebook account will be able to enter via the Facebook Page;
b. become a fan of the Facebook Page by clicking the ‘like’ button (if not an existing fan of the Facebook Page);
c. follow the prompts to access the promotion entry page;
d. input the requested details (including their full name, full residential address including the suburb and the postcode, date of birth, a valid email address, telephone number, and the full product barcode number for each of the two STAEDTLER products purchased in the Qualifying Purchase);
e. tick all of the required tick boxes; and
f. submit the fully completed entry form;

 OR

Website Entry: a. visit www.staedtler.com.au and follow the prompts to access the promotion entry page;
b. input the requested details (including their full name, full residential address including the suburb and the postcode, date of birth, a valid email address, telephone number, and the full product barcode number for each of the two STAEDTLER products purchased in the Qualifying Purchase);
c. tick all of the required tick boxes; and
d. submit the fully completed entry form.


7. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Purchase; (b) a maximum of twenty (20) entries per person per day is permitted; and (c) each entry must be submitted in accordance with the entry instructions. For the sake of clarity, individuals are eligible to receive one (1) entry for every two (2) eligible STAEDTLER products purchased in one (1) transaction from a participating store during the Promotional Period, subject to a limit of twenty (20) entries per person per day.
8. Individuals should retain a record of their STAEDTLER product barcode numbers (for entry purposes, as the barcode numbers must be provided on the entry form).
9. Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase, that the required number of eligible STAEDTLER products were purchased, and that the purchase was made during the Promotional Period but prior to entry.
10. Incomplete or indecipherable entries will be deemed invalid.
11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence and Facebook account where relevant) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
13. There will be a total of ten (10) Weekly Prize Draws conducted for this promotion. Entries into each Weekly Prize Draw will close at 11:59pm AEDST on the dates outlined in the table below. Entries into the first Weekly Prize Draw will open on 08/12/2014, and entries into each subsequent Weekly Prize Draw will open as soon as entries into the previous Weekly Prize Draw close. Un-drawn entries in each Weekly Prize Draw will not be entered into any subsequent Weekly Prize Draw/s, and all entries received during the Promotional Period (including the Weekly Prize Draw winners) will be entered into the Major Prize Draw. All prize draws will take place at Greeneagle Distribution & Fulfilment, Unit 10, 20 Ricketty Street, Mascot NSW 2020 at 11:00am AEDST on the dates outlined in the table below. The Promoter may draw additional reserve entries in each draw and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified by phone and in writing by email within two (2) business day of each relevant draw and their names will be published from 24/02/2015 at www.STAEDTLER.com.au and www.facebook.com/STAEDTLERAustralia.

14. The Promoter’s decision is final and no correspondence will be entered into.
15. The first valid entry drawn in each Weekly Prize Draw will each win a Razor scooter (valued at up to $110) and a Diamondback bicycle (valued at up to $270), valued together at up to $380. The exact model of the Razor scooter and Diamondback bicycle awarded will be determined by the Promoter in its absolute discretion, and will be confirmed once the age and size of the prize winner is confirmed.
16. The first valid entry drawn in the Major Prize Draw will win a 2014 Honda CRV 2WD VTi, 2.0L with automatic transmission (five (5) speed auto) in white. Total major prize value is up to $29,990 including registration, compulsory third party insurance, stamp duty and dealer delivery charges (which may vary State/Territory by State/ Territory). The winner may be able to upgrade the finishes/model of the vehicle subject to availability and at their own cost (and subject to approval of the Promoter). Additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner. The winner must collect the prize from their nearest authorised Honda dealership. If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then the winner may assign the car to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded. It is a condition of accepting the prize that the winner (or a representative of the winner if the winner is under the age of 18) may be required to sign a legal release in a form to be determined by the Promoter in its discretion.
17. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or element of a prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
18. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
19. If a winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.
20. Total prize pool value is up to $33,790.
21. Prizes, or any unused portion of a prize, are not transferable (other than as indicated above) or exchangeable and cannot be taken as cash.
22. A draw for any unclaimed prizes may take place on 18/05/2015 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners, if any, will be notified by telephone and in writing by email within two (2) business days of the draw, and their names will be published from 25/05/2015 at www.STAEDTLER.com.au and www.facebook.com/STAEDTLERAustralia.
23. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
24. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
25. Any cost associated with accessing the Internet is the entrant’s responsibility and is dependent on the Internet service provider used.
26. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
27. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
28. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) taking and/or use of a prize.
29. As a condition of accepting a prize, each winner (and/or the winner’s parent/legal guardian if the winner is under 18 years of age) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
30. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed here. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
31. If an individual enters via Facebook, their entry and continued participation in the promotion is dependent on them following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
32. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
