Terms and Conditions


1.            Information on How to Enter and prize information form part of these Conditions of Entry (Conditions of Entry). Entry into this Promotion is deemed acceptance of these Conditions of Entry.

 

2.            Entry in the Promotion is open to Australian residents aged 18 years and over, (Entrants) excluding those who are:

(a)          Management, employees, directors and contractors of the Promoter, its related entities, agencies, or companies associated with the Promotion;

(b)          a spouse, de-facto spouse, parent, guardian, child or sibling of the entrant;

Any cost associated with accessing the competition website is the responsibility of the entrant and is dependent upon the internet service provider used.

 

3.            The Promoter’s decision in relation to any aspect of these Conditions of Entry and the Promotion is final and binding. No correspondence will be entered into.

 

4.            The Promotion commences at 12:01am AEDT on 8 December 2014 and ends at 11:59pm AEDT on 31 January 2015 (Promotion Period).

 

5.            To be eligible to win the Grand Prize, entrants must, during the Promotion Period enter the Promotion at www.roadshowent.com.au/meetmitch for one chance in the draw, and be available to take the prize as stated in condition 7 below (“Eligible Entrant”). Entry is free. One entry per household.

Anyone found intentionally creating multiple Registrations to generate entries (whether using an alias, false name or abbreviated name) will be immediately disqualified from the Promotion. This includes entries generated on-behalf of members of competition websites.

 

6.            This Promotion is a game of chance.  The Grand Prize random draw will be conducted at 2.00pm AEDT on 3 February 2015, at MDSA, 15 Grosvenor Street, Neutral Bay, NSW 2089.

 

7.            The first Eligible entry drawn will win the Grand Prize which consists of:

 

• 2 x return economy airfares (for the Winner and one nominated travel companion) from the Winner’s nearest Australian Capital City serviced by the airline nominated by the Promoter, to Sydney, including airline taxes (if the winner is a NSW resident this portion of the prize will be forfeited and no compensation will be paid or given in lieu)

• 2 nights twin share accommodation in a 4 Star Hotel in Sydney, nominated by the Promoter

• A 30 minute meet and greet with Mitchell Johnson in Sydney on Sunday 8 March 2015 or such other date as notified by the Promoter pursuant to clause 8 below

• A Cricket Australia merchandise pack

• The Mitchell Johnson: Bouncing Back DVD

 
Total maximum retail value of the Grand Prize is $3,929.95 including GST.


 

8.            Pending talent availability, the location and date of the meet and greet may need to be changed in accordance with the Cricket World Cup schedule.  The Promoter will organise flight and accommodation accordingly.

9.            The Grand Prize winner will be notified by phone, by email, published on: www.facebook.com/roadshow and announced in The Australian newspaper on  5 February 2015.

 

10.         The Grand Prize must be booked and taken before 9 March 2015 or such date as notified by the Promoter pursuant to clause 8 above.

 

11.         Air tickets are for economy travel on regular scheduled services of the airline selected by the Prize Partner are subject to seasonal embargos & availabilities. The flight itinerary may need to be adjusted depending on the airline's departure city and their current flight schedule. Travel must coincide with the dates specified in these terms and conditions.

 

12.         Frequent Flyer points are not available from any airline in respect of flights booked in this Promotion.

 

13.         A credit card imprint or cash deposit may be required from the Winner upon at check-in at the hotel, which may be used in relation to incidental charges, not included in the Prize. Once accommodation is booked, changes aren’t permitted.

 

14.         It is the personal responsibility of the Winner to ensure that they and their Companions have valid travel documentation.

 

15.         If the Winner and their Companion are, for whatever reason, unable to travel on a nominated date, or do not take a portion of the Prize within the time stipulated by the Promoter, then that portion of the prize will be forfeited by the Winner. Cash will not be awarded in lieu of the Prize or any portion thereof.

 

16.         Participation in the Grand Prize is subject to any Terms and Conditions imposed by a prize supplier.

 

Subject to clause 8 above, changes and cancellations to any booking may be subject to fees payable by the Winner. Unless otherwise specified, spending money, meals (other than specified), taxes (other than airline/airport taxes), insurance, transport to and from the departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included and are the responsibility of the Winner.

 

17.         Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.

 

18.         If any part of the Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the prize) with a Prize, or element, to the equal value and/or specification, subject to any law or written directions from a regulatory authority.

 

19.         In the event that for any reason whatsoever a Winner does not claim, use or accept this Prize at or within the time stipulated by the Promoter, the prize will be forfeited by the Winner.

 

20.         Subject to clause 18 above, the Prize, or any element, is not transferable or redeemable for cash.

 

21.         The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these Terms and Conditions, or forfeiting or not claiming the Prize. The Promoter will use all reasonable efforts to contact the winner using the contact details provided in their entry, however the Prize will be considered forfeited if the winner still cannot be contacted after 3.5 months from the date of the Draw. If the Prize remains unclaimed or forfeited (through ineligibility or otherwise, the Promoter will instruct MDSA to conduct such further random redraw at 12 noon AEST on 4 May 2015 at the same place as the original draw as necessary to award the unclaimed Prize (except for the Mitchell Johnson meet & greet), subject to any written direction given under applicable law. The unclaimed Prize Winner will be notified by phone, by email, published on: www.facebook.com/roadshow and announced in The Australian newspaper on 11 May 2015.

 

22.         The Promoter accepts no responsibility for any entries not received for any reason, during the Promotion Period.  No responsibility will be taken for lost, late or misdirected entries.

 

23.         If, for any reason, the Promotion is not capable of being run as planned, including due to tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to States and Territories regulations, including cancelling, terminating, modifying or suspending the Promotion.

 

24.         Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry or draw mechanism in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.

 

25.         The Promoter, Promoter’s Management, employees, Directors and contractors, its related entities, agencies, or companies associated with the Promotion (including each Partner (as defined in clause 30 below) shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of the Prize, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).

 

26.         The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of the Prize.

 

27.         All entries become the property of the Promoter.  Entries not completed in accordance with the conditions of entry or received after the closing date will not be considered.  Indecipherable or incomplete entries will be disregarded.  No responsibility is taken for any late or misdirected email.

 

28.         The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any elements included in the Prize. To the extent permitted by law, the Promoter, its employees and agents are not liable for any loss suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the prize winner and, where applicable, to any persons accompanying the prize winner.  This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law.

 

29.         The Promoter reserves the right to announce or publish the winner’s name for publicity purposes.  This information may be disclosed to State departments and published as required by the relevant legislation regulating trade promotions.

 

30.         The information Entrants provide (Entry Information) will be used by the Promoter for the purpose of conducting this Promotion and by the Promoter and, where permitted by an Entrant, each Partner for the purposes set out below in this clause 30. For the purposes of these Terms and Conditions, the Partners are defined to mean each of Cricket Australia, My Fun and

By entering this Promotion, entrants who tick the relevant tick boxes consent to the storage of their entry information on the databases of the Promoter and each Partner involved in this Promotion. The Promoter and each Partner will only use and disclose an Entrant’s Personal Information in accordance with their respective privacy policies and, if applicable, collection statements, which can be accessed by an Entrant on the entry page of the Promotion prior to entry into this competition. The Promoter and/or each Partner may use this information for future promotional and marketing purposes regarding their products and services in accordance with their respective privacy policies and, if applicable, collection statements, including contacting entrants via any contact details provided by the entrant without further reference or compensation to the entrant, for an indefinite period or until the entrant opts out from any Partner involved with this Promotion. The eMail platform of some Partners may be housed outside Australia.

 

31.         If an Entrant has selected the option to receive information and offers from the Promoter or a Partner the Entrant acknowledges and agrees that the Promoter and/or Partner may collect your personal information on behalf of its related entities(including in the case of Cricket Australia on behalf of State or Territory cricket associations, including the Big Bash League teams (together, "Australian Cricket")) to communicate with Entrants in accordance with Promoter’s and/or Partner’s related entities privacy policy.

32.         All entries become the property of the Promoter. By entering the Promotion, entrants are agreeing to receive further information from the Promoter delivered via email to the email address entrants provide to enter the Promotion. If entrants wish to stop receiving this information, entrants may unsubscribe by clicking on the unsubscribe link within any future emails entrants receive. Entrant’s details will then be removed from the Promoter’s database. The Promoter collects entrant’s information so that entrants can participate in the Promotion. If entrants do not give the Promoter the information, entrants cannot participate. The Promoter may use this information for the purposes of the conduct of the Promotion and the compilation of survey results and evidence. The Promoter may disclose this information to third parties who provide the Promoter with administrative services.
