Terms and Conditions: 1. Information on how to enter form part of these terms and
conditions. 2. Entry is only open to residents of Australia. Employees and the
immediate families of the promoter and agencies associated with this promotion are
ineligible to enter. This includes retailers, retail employees and their immediate
families associated with Rockhampton City Centre Plaza (Mirvac Retail Pty Ltd). 3.
The competition commences at 9am Monday 19 January 2015 and closes at 5pm
Sunday 25 January 2015 with the winning draws taking place Tuesday 27 January
2015 at 9am at Rockhampton City Centre Plaza. 4. There will be a total of eight (
winners in the ‘Simply WINNING!’ competition – 2 x Major Prize winners, 2 x Runnerup
Prize winners and 4 x Third-Place Prize winners. All winners will be notified via
phone and email for collection of their prizes. All prize winners’ names will be
published on the Rockhampton City Centre Plaza website and Facebook Page. The
draw decision is final and no correspondence will be entered into. An unclaimed
prize draw will take place on Monday 2 February 2015 at 9am at Rockhampton City
Centre Plaza Centre Management if prizes are not collected or prize winners not
identified from the initial draws. Winners will again be notified directly and feature
online. 5. If the winner is under the age of 18 years, the prize will be awarded to the
winner’s parent or guardian. 6. As a condition of accepting a prize, each winner must
sign any legal documentation as and in the form required by the Promoter and/or
prize suppliers in their absolute discretion, including but not limited to a legal release
and indemnity form. 7. There are two (2) major prizes in the ‘‘Simply WINNING!’
competition, two (2) runner-up prizes and four (4) third-place prizes. Prizes include;
Major prizes – One (1) Xbox One 500Gb with Kinect and one (1) Playstation 4
500Gb console. Runner-up prizes – Two (2) iPad Mini 16Gb. Third place prizes –
Four (4) iPod 2Gb Shuffles. Total prize pool for this promotion: $2,200 (incl. GST)
though prize values may fluctuate or increase at the time of redemption. All prizes
are not redeemable for cash and are not transferable. 8. To enter, spend $10 or
more in one transaction at any Rockhampton City Centre Plaza specialty store
between Monday 19 January and Sunday 25 January 2015, complete an entry form
in-store and place it into the entry barrel located in front of Coles. One entry form
may be completed per specialty spend. Entry forms must have a validated invoice
number printed on them or have a proof of purchase receipt attached. 9. Except for
any liability that cannot by law be excluded, including, the Non-Excludable
Guarantees, the Promoter (including its respective officers, employees and agents)
is not responsible for and excludes all liability (including negligence), for any
personal injury; or any loss or damage (including loss of opportunity); whether direct,
indirect, special or consequential, arising out of: (a) any technical difficulties or
equipment malfunction (whether or not under the Promoter’s control); (b) any theft,
unauthorised access or third party interference; (c) any entry or prize claim that is
late, lost, altered, damaged or misdirected (whether or not after their receipt by the
Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any
variation in prize value to that stated in these Terms and Conditions; (e) any tax
liability incurred by a winner or entrant; or (f) use of/taking of a prize. 10. The
Promoter reserves the right, at any time, to verify the validity of entries/claims and to
disqualify any entrant who tampers with the entry/claims process or who submits an
entry/claim that is not in accordance with these Terms and Conditions. Errors and
omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to
enforce any of its rights at any stage does not constitute a waiver of those rights. 11.
All entries become the property of the Promoter. All entries will be entered into a
database and the entrants’ names and addresses may be used for future
promotional, marketing and publicity purposes by the promoter and its associated
parties. 12. Entrants must consent to the Promoter using their name, likeness, image
and/or voice in the event they are a winner (incl. photograph, film and/or recording of
the same) in any media for an unlimited period of time without further remuneration
or reference for the purpose of promoting this promotion (including any outcome),
and promoting any products manufactured, distributed and/or supplied by the
Promoter. 13. The Promoter reserves the right to cancel the competition at any time.
14. Specialty stores are defined as all stores in Rockhampton City Centre Plaza
other than Coles, Target and any Casual Lease stores in-centre over the campaign
