Terms and Conditions of Entry for the
"Swann Insurance – Get a Quote for a chance to Win The Ultimate Garage Makeover" (Promotion)   

1.         Information on How to Enter and Prize information form part of these Conditions of Entry (Conditions of Entry). The Promoter is Swann Insurance (Aust.) Pty Ltd ABN 80 000 886 680 of Level 15, 414 La Trobe Street, Melbourne, Victoria 3000 (Promoter).   

2.         Entry into the Promotion is deemed to constitute acceptance of these Conditions of Entry.   

3.         An Entrant is responsible for ensuring their familiarity with the Conditions of Entry at the time of participation. The Promoter’s decision not to enforce a specific restriction (whether communicated to an Entrant or not) does not constitute a waiver of an entitlement to enforce that restriction or of the Conditions of Entry in general.   

4.         All Entrants acknowledge that the Promoter can rely on these Conditions of Entry even if the Promoter only learns of an Entrant’s ineligibility after the Promoter has awarded the Prize. Return of the Prize or payment of its equivalent value to the Promoter may be required by the Promoter in this scenario.   

5.         The Promoter’s decision in relation to any aspect of these Conditions of Entry and the Promotion is final and binding on each Entrant. No correspondence will be entered into.   

PROMOTION PERIOD  
6.         The Promotion will commence at 00:01 AEDT on 18/01/2015 and conclude at 23:59 AEDT on 22/02/2015 (Promotion Period).   

7.         Entry in the Promotion is only open to Australian residents 18 years and over, excluding:   (a) management, employees, directors and contractors of the Promoter, its related entities and other  agencies, firms or companies associated with the Promotion (including suppliers of the Prize);   (b) a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 7(a) of these Conditions of Entry;   (c) persons who have breached the terms and conditions of any prior promotion run by or on behalf of the Promoter,          (Entrant). The Promoter is responsible for determining whether a person is an Entrant in its absolute discretion.       

HOW TO ENTER  
8.         To enter and be eligible to win, Entrants must, during the Promotion Period:   
(a)               visit  www.swanninsurance.com.au (Promotion Website);   
(b)               follow the links to obtain a quote for motorcycle insurance;   
(c)               complete and submit the online insurance quote form, including a response to all details requested by  the Promoter; and   
(d)               retain, and if requested produce, a copy of the email which is automatically generated after submitting the online insurance quote form,   (Eligible Entry).   

9.         The Promoter is not responsible for any technical difficulties encountered in accessing the Promotion Website. Any costs associated with accessing the Promotion Website are the Entrant’s responsibility and are dependent on the internet service provider used.   

10.     The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter the Promotion repeatedly is prohibited and will render entries submitted using such means as invalid.   

11.     Eligible Entries are deemed to be received at the time of receipt into the Promoter's database, not time of transmission by the Entrant.   

VERIFICATION   
12.     If requested by the Promoter, Entrants must produce, within the time stipulated by the Promoter, appropriate photo identification or other documentation required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim the Prize and compliance with these Conditions of Entry.   

13.     If the items required by the Promoter are not received or an Entrant has not verified to the satisfaction of the Promoter within the time period stipulated by the Promoter, the entry submitted by the Entrant will be deemed invalid.   

14.     The Prize will only be awarded after all validation and verification requirements of the Promoter, including the requirements set out in Condition 18 hereof have being met to its satisfaction. In the event that the Entrant cannot provide requested validation or verification, the Entrant will forfeit the Prize and no substitute will be offered to him or her.   

15.     All costs associated with or arising in connection with the receipt of the Prize are the responsibility of the Prize winner.             

PRIZE DRAW AND PRIZE INFORMATION   
16.     A random electronic prize draw will conducted by a representative of the Promoter at Prime Focus, 403/62 Beach Street, Port Melbourne, VIC 3207 (Draw Location) at 12 noon AEDT on 27/02/2015 (Prize Draw). Entrants will not need to be present at the Draw.   

17.     The first Entrant with an Eligible Entry drawn in the Prize Draw will, subject to any validation and verification requirements stipulated by the Promoter being met, win an Ultimate Garage Makeover, valued at $10,000 (including GST) (Prize). The Prize will be awarded as gift vouchers totaling of $10,000 (including GST) from Peter Stevens Motor Cycles, JB HI-FI and/or Total Tools. The Prize winner can choose any combination of gift vouchers from the above listed retailers to the combined value of $10,000 – E.g. $3000 Peter Stevens Motor Cycles voucher, $3000 JB HI-FI voucher and $4000 Total Tools voucher.   

18.     To be eligible to claim the Prize, the Prize winner must provide a copy of their proof of identity, such as a passport, to a representative of Promoter as and when requested.   19.     The Prize is not redeemable for cash.   

20.     The Prize must be redeemed in full by 27/08/2015.
   
NOTIFICATION OF PRIZE WINNER 
21.     The Prize winner will be notified by phone and via email, and will subsequently be featured on the Promotion Website from 06/03/2015.   

RE-DRAW (IF ANY)   
22.     If the Prize is undeliverable (i.e. the Prize winner cannot be located) or for whatsoever other reason cannot be conferred by way of the Prize Draw, a random electronic re-draw will be conducted on the 12/06/2015 at 12 noon AEST at the Draw Location by a representative of the Promoter from all remaining Eligible Entries received in the Promotion, subject to any directions from the relevant State and Territory Gaming Departments (Prize Re-Draw).  Entrants will not need to be present at the Prize Re-Draw.   

NOTIFICATION OF RE-DRAW WINNER (IF ANY) 
23.     The Prize Re-Draw winner (if any) will be notified by phone and via email, and will subsequently be featured on the Promotion Website from 19/06/2015.   

GENERAL   
24.     If more than one person attempts to claim the Prize, the Promoter has sole and absolute discretion to determine which of those persons will be the Prize winner.   

25.     The Promoter shall not be liable for the Prize being lost, stolen, damaged or tampered with in any way before it reaches the Prize winner or after it has been provided to the Prize winner.   

26.     The Promoter accepts no responsibility for any variation in the value of the Prize from the time of printing Promotion materials.   

27.     If the Promoter is unable to provide the Prize winner with the Prize, the Promoter reserves the right to supply an alternative Prize of similar monetary value to the Prize, subject to any directions given by State and / or Territory Gaming authorities.   

28.     The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period.  No responsibility will be taken for lost, late or misdirected entries. The Promoter does not warrant that the entry mechanism will be available at all times during the Promotion Period.   

29.     If, for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs, network failure, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to States and Territories regulations, including cancelling, terminating, modifying or suspending the Promotion.   

30.     Any Entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.   

31.     The:  Promoter, the Promoter's related entities, and all agencies associated with the Promotion; and   
(b)       the employees, agents, directors and contractors, of all entities referred to in paragraph

31. (a), shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of the Prize, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).   

32.     The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of the Prize.       

33.     The Prize winner must, at the Promoter's request, participate in any Promotion activity (such as publicity and photography) relating to the winning of the Prize, free of charge, and they consent to the Promoter using their name and image in any future promotional material.   

PERSONAL INFORMATION   
34.     Immediately upon submission by an Entrant, their entry becomes the sole property of the Promoter.   

35.     All information Entrants provide (Personal Information) will be used by the Promoter for the purpose of administering this Promotion and contacting and verifying the winner, as well as providing a quote for motorcycle insurance.       

36.     Should an Entrant's Personal Information change during the Promotion Period, it is the Entrant's responsibility to notify the Promoter by contacting the Promoter using the ‘Contact Us’ form on the Promotion Website.   

37.     The Promoter may disclose Entrants' Personal Information to its contractors and agents to assist in conducting this Promotion and as required, to Australian regulatory authorities.   

OPTING-IN FOR MARKETING PURPOSES 
38.     By requesting a quote and submitting an Eligible Entry in the Promotion, Entrants understand that the information provided may be entered into a database and may be used by the Promoter, the Promoter's related entities, and agencies engaged by the Promoter, for the Promoter's current and future promotional and marketing purposes without further reference or compensation to the entrant.   

39.     Entrants may request to update or correct their Personal Information held by the Promoter and/or may request that they not receive further Promotional or marketing communications from the Promoter at any time by contacting the Promoter at Swann.Compliance@swanninsurance.com.au or by electing to ‘opt out’ by using the ‘opt out’ function on any marketing materials received.

40.     Entrants may view the Promoter’s privacy policy by visiting www.swanninsurance.com.au/privacy The privacy policy details how a privacy complaint can be made.   

41.     The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988 (The Privacy Amendment (Enhancing Privacy Protection) Act 2012) as well as any other applicable laws.   Authorised under Permit Numbers - VIC 15/29, NSW LTPS/15/00082, SA T15/11 & ACT TP 15/00039.
