Terms and Conditions
Participation in the Competition
By participating in the Competition, the Participant agrees to these Terms and Conditions.
To participate in the Competition, the Participant must be an Eligible Person who submits an Eligible Entry during the Competition Period.
Each Eligible Person may only enter the Competition once during the Competition Period.
To submit an Eligible Entry, the Eligible Person must:
during the Competition Period either:
be an existing ThemeParks.com.au subscriber at the commencement of the Competition Period and re-submit their subscription via the specific competition subscription form on ThemeParks.com.au, agree to be bound by the ThemeParks.com.au terms and conditions and privacy policy, and remain a ThemeParks.com.au subscriber throughout the Competition Period; or
sign up to become a ThemeParks.com.au subscriber via the specific competition subscription form on ThemeParks.com.au and provide the Eligible Person’s full name, valid email address, mobile number and post code, agree to be bound by the ThemeParks.com.au terms and conditions and privacy policy, and remain a ThemeParks.com.au subscriber throughout the Competition Period;
if the Eligible Person is under the age of 18 years, have the consent of a parent or guardian to subscribe to ThemeParks.com.au and enter the Competition; and
be a Queensland resident.
The Competition
The Competition will be conducted online at Themeparks.com.au during the Competition Period.
Eligibility
The Competition is only open to Eligible Persons.
The Promoter reserves the right, at any time, to verify the eligibility of any Participant (including a Participant’s identity, age and place of residence) and to disqualify any Participant who does not strictly comply with these Terms and Conditions or who tampers with the entry process. Incomplete or indecipherable entries will be deemed invalid. If requested by the Promoter, a Participant must provide the Promoter with evidence of eligibility. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Prize
There will be three (3) prizes and one (1) winner of each prize (Prize Winner).
Each prize is not transferable, refundable nor exchangeable and cannot be taken as cash.
Each Eligible Entry by an Eligible Person will be entered into the Competition.
The first Eligible Entry drawn at random will win the 1st Prize, the second Eligible Entry drawn at random will win the 2nd Prize and the third Eligible Entry drawn at random will win the 3rd Prize.
The Prize draw will take place at 2:00pm (Qld time) Monday 2 February 2015 at Village Roadshow Theme Parks’ head office situated at Warner Bros. Movie World, Gold Coast, Oxenford.
If the Prize Winner is under the age of 18 years, the parent or guardian of the Prize Winner who gave permission for entry into the Competition will be deemed to be the Prize Winner for the purposes of the Competition.
The Promoter will use reasonable efforts to notify the Prize Winner by email or phone or otherwise to arrange delivery or collection of the Prize.
If despite reasonable efforts the Promoter is unable to locate or contact the Prize Winner by Monday 6 April 2015, another Prize Winner will be drawn at 2.00pm Tuesday 7 April 2015. Any subsequent winner will be notified in accordance with these Terms and Conditions.
The Promoter may, but is not obliged to, publish the results of the Competition. By participating in the Competition, the Participant gives their consent for their personal details to be published in the manner prescribed in this clause if they are the recipient of a prize. If the Promoter decides to publish the results of the Competition, then the Promoter will publish the results on the Centre Website robinatowncentre.com.au.
A Participant claiming to be the Prize Winner will be required to provide proof of identity.
The Promoter’s decision as to the winner of each prize is final and binding and no correspondence will be entered into in relation to the conduct of the Competition or otherwise.
Each prize is subject to the terms and conditions relating to its use (including validity period) which can be viewed at themeparks.com.au.
Other General Terms
All Competition entries are the property of the Promoter.
The Prize Winner consents to the Promoter using their name, likeness, image and voice for an unlimited period and without remuneration for marketing and publicity use, if required by the Promoter.
The Promoter Entities shall not be liable (including, without limitation, in negligence) for:
any loss or damage whatsoever that is suffered (including, but not limited to, indirect or consequential loss); or
any personal injury suffered or sustained, during the course of participating in this Competition or using a prize, except for and to the extent that any liability cannot be excluded by law.
Each Participant indemnifies and keeps indemnified the Promoter Entities against all claims, losses, damages, costs and expenses suffered or incurred by the Promoter Entities or any third parties arising out of the breach of these Terms and Conditions by the Participant, the conduct of the Participant in the Competition or the use of a prize by the Participant.
If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law and subject to any written directions from a regulatory authority (if any) to:
disqualify any Participant; and/or
modify, suspend, terminate or cancel the Competition as appropriate.
The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by a Participant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Competition.
Privacy
Under the Privacy Act 1998 (Cth), the Promoter must notify Participants of certain matters when it collects personal information about them including how it plans to use or disclose it. If a Participant chooses to enter or take part in the Competition, the Participant will be required to provide the Promoter with personal information about themselves such as the Participant’s name, post code, telephone number and email address.
The Promoter will collect, use and disclose the personal information which the Participant has provided for the following purposes:
carrying out the Competition (including as described in clause 16 in particular and in general for notification and promotion of prizes);
adding the Participant’s details to the ThemeParks.com.au communications database; and
carrying out marketing and promotions activities including, without limitation, sending newsletters or publications and/or other marketing and promotional material to the Participant about news, special offers, future competitions or promotional events which may be undertaken by the Promoter or any other person or organisation to which the Promoter discloses the personal information (including contractors) for the purposes of assisting the Promoter to do this.
By entering the Competition, the Participant consents to the collection, use and disclosure of his or her personal information in the manner outlined in these Terms and Conditions.
A Participant has the right to access, in most circumstances, personal information which the Promoter holds about the Participant. A Participant may contact the Promoter on 07 5573 8481 to ask for access to the Participant’s personal information, or if the Participant has a complaint concerning a Participant’s information privacy. The Promoter may deny the participant’s request for access in some circumstances. If the Promoter does this, it will tell the Participant why.
The Promoter's Privacy Policy contains further information on its processes in relation to access to and correction of personal information, about how a Participant may complain about a breach of the Australian Privacy Principles and how the Promoter will deal with such a complaint. http://themeparks.com.au/privacy.aspxIf a Participant considers that any personal information that the Promoter holds about the Participant is inaccurate or if at any time the Participant’s details change, the Participant may contact the Promoter on 07 5573 8481 and the Promoter will take reasonable steps to ensure that such personal information is corrected. The Promoter will take reasonable steps to keep personal information secure from misuse, interference, loss or unauthorised access, modification or disclosure.
Definitions
“Centre” means Robina Town Centre located at 19 Robina Town Centre Drive, Robina Qld 4226.
“Competition” means the Village Roadshow ThemeParks and Robina Town Centre “Win the Ultimate Theme Park Package” competition as outlined in these terms and conditions.
“Competition Period” means the period from 9:00am Wednesday 14 January 2015 until midnight 31 January 2015 Queensland time.
“Eligible Entry” means an entry which complies with the requirements of clause 4.
“Eligible Person” means an individual who:
is a resident of Queensland;
if under 18 years of age, has a parent or guardian’s permission to participate in the Competition and subscribe to ThemeParks.com.au;
is not a Non Eligible Person; and
submits an Eligible Entry.
“Non-Eligible Person” means the following:
owners and managers of the Centre or Village Roadshow Theme Parks Pty Ltd;
retailers of the Centre;
suppliers, associated companies and agencies of the Centre;
the employees or contractors of the persons and entities in paragraphs (a) – (c); and
any spouse, child, de facto or any other person living at the same premises as any of the persons mentioned in paragraphs (a) – (d).
“Participant” means any person who participates in the Competition.
“1st Prize” means: 2 night stay in a Deluxe room at Sea World Resort & Water Park for 2 adults and 2 children, 4 VIP Magic Passes, Family Dolphin Adventure at Sea World, a meet and greet with character of choice at Warner Bros. Movie World, and Wave Pool Cabana at Wet’n’Wild Gold Coast including meal package (one time use only). Total value for 1st Prize is $1,789.94.
“2nd Prize” means: 4 tickets to High Country Legends – Australian Outback Spectacular’s brand new show and 4 VIP Magic Passes. Total value for 2nd Prize is $879.92.
“3rd Prize” means: 4 VIP Magic Passes. Total value for 3rd Prize is $439.96.
“Promoter” means Village Roadshow Theme Parks Pty Ltd c/o Warner Bros. Movie World, Pacific Motorway, Oxenford QLD 4210.
“Promoter Entities” means the Promoter, all associated companies, advisors and agencies and all those entities’ personnel.
