TERMS AND CONDITIONS – Crown Club Birthday Prize Draw   
SECTION 1: PROMOTION 1. Promotion: Crown Club Birthday Prize Draw  2. Promoter: Burswood Nominees Ltd ABN 24 078 250 307, as trustee for The Burswood Property Trust trading as Crown Perth (ABN 35 491 489 282), Great Eastern Highway Burswood, Western Australia 6100. Promotion Period: The Promotion will occur between 6am and 10pm on Wednesday, 18 February 2015. All times recorded throughout these terms and conditions are in Australian Western Standard Time.   
SECTION 2: ELIGIBILITY 3. Eligibility: To be eligible to enter the Promotion, the entrant must be 18 years of age or older whose birthday is in the calendar month in which the relevant draw is held and either: • Be an Active Crown Club Member;  • join Crown Club during the Promotion Period and earn rewards points between 6am and 9.55pm on the day of the Promotion (New Member); or • Be a Crown Club Member that is not an Active Crown Club Member and earn rewards points between 6am and 9.55pm on the day of the Promotion (Non Active Crown Club Member). 
4. Non-Eligibility: In addition to the criteria for being eligible, persons are not eligible to enter the Promotion or win any Prize if: a. they are an employee of the Promoter or an employee of one of the Promoter’s related entities who is primarily based in Perth (Promoter Employee); b. they are an immediate family member, being a spouse, partner, sibling, parent or child, of any member of the Promoter’s Executive Team: c. they are excluded for any reason from the property of the Promoter; d. any personal information or contact details are entered incorrectly; or e. they are a VIP Program Player (anyone not domiciled in Western Australia and / or interstate or overseas program player). 
SECTION 3: ENTRY TO THE PROMOTION 5. Entry: Eligible Active Crown Club Members must visit a VIK between 4pm and 9.55pm on Wednesday, 18 February 2015 to claim their entry form.   
All New Members will need to visit a Crown Club desk during the Promotion Period and request a manual entry form.   
All Non Active Crown Club Members will need to visit a Crown Club desk during the Promotion Period and request a manual entry form.   
All entry forms must be completed and placed into the corresponding prize draw barrel located next to the promotional stage on the Main Gaming Floor prior to the end of the Promotion Period to be eligible for each subsequent Prize Draw. 
The barrel will be closed for entries at 10pm on Wednesday, 18 February 2015. In the event of a VIK malfunction, a Crown Club Host is to void the issued coupon in the member’s account and the member will then proceed to register at a VIK again. 
Drawn entries will be returned to the barrel after each Daily Prize Draw. Eligible entrants can win more than once in this Promotion. The barrel will be emptied after each Grand Prize Draw.   
SECTION 4: DRAWS  6. Daily Prize Draw: At 6pm, 7pm, 8pm and 9pm on Wednesday, 18 February 2015, a representative of the Promoter will conduct a random barrel draw of all eligible entries at the promotional stage on the Main Gaming Floor, Crown Perth to determine two (2) Daily Prize Winners per Daily Prize Draw.  Each Daily Prize Winner must claim the Daily Prize in accordance with Term 12 or they will forfeit their right to the Daily Prize and Term 9 will apply in respect of the Daily Prizes.  7. Grand Prize: At 10pm on Wednesday, 18 February 2015, a representative of the Promoter will conduct a random barrel draw of all eligible entries at the promotional stage on the Main Gaming Floor, Crown Perth to determine one (1) Grand Prize Winner. The Grand Prize Winner must claim the Grand Prize in accordance with Term 12 or a redraw will occur in accordance with Term 14. 8. Prize Winner: The Prize(s) described below in Term 9 will be awarded to the relevant Prize Winner who has claimed their relevant Prize in accordance with Term 12.     
SECTION 5: PRIZE  9. Prize: Daily Prize: The Daily Prize is $2,000 per Daily Prize Draw. If there is a jackpotted amount that is being carried over, this will be in addition to the $2,000 for that draw (ie $2,000 is added to the jackpotted amount that is being carried over). The Prize(s) awarded for each of the Daily Prize Draws will be as follows: 







 If both Daily Prize Winners claim their Prize in accordance with Term 12, each Daily Prize Winner will win half of the Prize amount for that Daily Prize Draw;







 If only one (1) Daily Prize Winner claims their Prize in accordance with Term 12, that Daily Prize Winner will win the total Prize amount for that Daily Prize Draw and the other drawn entrant will be deemed to have forfeited their right to a Prize.







 If no Daily Prize Winner claims their Prize in accordance with Term 12, the total Prize amount for that Daily Prize Draw will jackpot to the next Daily Prize Draw and each of the drawn entrants will be deemed to have forfeited their right to a Prize. However, at the final Daily Prize Draw, if no Daily Prize Winner claims their Prize in accordance with Term 12, a redraw will occur in accordance with Term 14.  Grand Prize: The Grand Prize for the Grand Prize Winner is $5,000 cash. 10. Prize Value: The total maximum retail value of the Prize(s) is: $13,000.  11. Prize Conditions: The Prize(s) are subject to the following conditions:  a. No exchange of Prize: If for any reason, a Prize Winner cannot take any component of the Prize(s) or the Prize(s), then the Prize will be forfeited. b. Ancillary Costs: Subject to any provision to the contrary, and if applicable, all transport, meals, beverages, spending money, insurances, service charges, taxes, transfers and ancillary costs, including cost of travel to and from the airport and the property are not included in a Prize unless specified and are the responsibility of the Prize Winner. c. Taxes: If a Prize(s) or receipt of it incurs a tax liability, the Prize Winner is liable for payment of such tax. d. Prize Availability: Subject to any provision to the contrary, and if applicable, all components of the Prize(s), including accommodation are subject to availability and any separate and individual terms and conditions applicable to that Prize, some of which may not be within the control of the Promoter. In the event that any component of a Prize is unavailable for any reason, subject to State legislation, the Promoter reserves the right to substitute that Prize component with another prize of equal value and the Prize Winner will be notified accordingly. 12. Claim of Prize: If the drawn entrant wishes to claim the relevant Prize, the drawn entrant must be physically present within the Promoter’s venue and confirm this fact and his/her eligibility to win under these terms and conditions by personally notifying a Crown Club host who is on the Main Gaming Floor within two (2) minutes of the announcement of the relevant draw. If a draw is broadcast live into another venue within the Complex, the drawn entrant must be physically present within the Promoter’s venue and may claim the Prize by notifying one of the Promoter’s hosts in person within that venue by the deadline.  The drawn entrant must provide personal identification to the satisfaction of the Promoter.  13. Contact: The Promoter will not contact any winners to notify them of the draw outcome unless stated.  14. Redraw: The Promoter reserves the right to redraw, in accordance with the terms and conditions of the original draw, in the event of an entrant being unable to satisfy these terms and conditions or forfeiting their right to the Prize. A redraw is to occur up to a maximum of ten times (or any other number of times as determined by the Promoter in its sole discretion). If an entrant has not claimed their right to the Prize in accordance with these terms and conditions after ten redraws (or that number of redraws as determined by the Promoter) the right to the Prize will be forfeited and the Prize will be awarded to the first drawn entrant, with this entrant being notified by mail or phone.  15. Winner Publicity: The Promoter reserves the right and licence to use Prize Winners’ names, suburbs, photographs, images and likeness for the purpose of promoting and advertising Crown Club and Crown Perth unless a written request for anonymity is received from the Prize Winners. 
SECTION 6: GENERAL CONDITIONS  16. Lost, Delayed Communication: The Promoter will not be responsible for any delayed, lost or misdirected mail or any other communication. 17. Release: To the fullest extent permissible by law, each entrant in the Promotion including without limitation the Prize Winner and any other person participating in the Prize(s), releases the Promoter from any claim, loss, damage, expense (including any claim for legal expenses), cost or charge sustained or in any way incurred by such entrant in connection with the Prize or their participation in the Promotion or Prize. The Promoter, its related bodies corporate, their officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect, consequential and economic loss) suffered or sustained in connection with this Promotion, the promotion of this Promotion, or the use of any Prize, except for any liability which cannot be excluded by law. Further, to the fullest extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any website, or any unauthorised intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to participants' or any other person's computer related to or resulting from participation in or down-loading any materials in this Promotion. The use of any automated
entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. The Promoter’s responsibility for the provision of prizes is limited to the prizes as described in these terms and conditions, the Promoter accepts no further liability or commitment beyond those stated and is not liable for any failure of the Promoter’s agents or contactors to supply the prizes as stated. 18. Force Majeure: Subject to State legislation the Promoter will not be responsible for any act, omission, failure or delay by the Promoter that is due to an act of God, riots, acts of terrorism, storms, fire, any labour or industrial dispute, any strike, and other acts, which are not reasonably within the control of the Promoter.  19. Disputes: In the event of a dispute, the decision of the Promoter is final and binding and no correspondence will be entered into.  20. Privacy Notice: During the course of the Promotion, the Promoter may collect personal information in relation to entrants. This may include, but is not limited to, the names, email addresses, telephone numbers and credit card details of the entrants. The entrants' personal information is collected so the Promoter is able to conduct the Prize Draw and to contact and award the Prize to the Prize Winner, to publish the results of the Promotion and/or to publicise the Promotion.  21. Consent to use of Personal Information for Marketing Purposes: Furthermore, by entering this Promotion, unless otherwise advised by the entrant, each entrant consents to the retention and use of the information collected pursuant to term 20 by the Promoter, which trades as Crown Perth. Uses may include future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant.  22. Definitions: If referred to in these terms and conditions, the following terms have the following meanings:  a. ‘Active Crown Club Member’ means a Crown Club member who has earned reward points using their Crown Club card in the 12 months prior to 6am on Wednesday, 18 February 2015.  23. Alteration of Terms and Conditions: Subject to approval being granted under Condition 12 of the general conditions attaching to Trade Promotion Lotteries issued by the Gaming and Wagering Commission of Western Australia, the Promoter reserves the right to alter these terms and conditions to address any misinterpretation, misinformation or misunderstanding that may arise in the application of these terms and conditions, as is permitted by law. The Promoter’s decision will be final. 24. Acceptance of Terms and Conditions: Participation in the competition constitutes an acceptance of these terms and conditions. 25. Disqualification: Any failure to comply with these terms and conditions may result in immediate disqualification of an entrant or the Prize Winner. Disqualification will be at the Promoter’s sole discretion and no correspondence will be entered into. 26. Cancellation of the Promotion: The Promoter reserves the right to cancel the Promotion at any time prior to the commencement of the Promotion Period for any reason whatsoever.
