TERMS AND CONDITIONS


1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this contest is deemed acceptance of these Terms and Conditions.

2. This contest commences on Monday 19th January 2015 at 09:00 and closes at 23:59 on 19th April 2015.

3. Entry is only open to Australian residents aged between 21 and 58 years old that firstly complete a physical paper entry form in its entirety or alternatively complete an online entry in its entirety on the website www.infinityinvestmentsgroup.com.au and the entry will be validated by 8 am on the 19th April 2015. However the sponsor of the Family holiday to the Gold Coast contest may at its sole discretion choose to close the entries earlier if enough entries have been validated. All times and dates are times and dates in Sydney, which may be AEST or AEDT depending on the date. All times are stated using the 24-hour clock. 00:00hrs is the start of a day and 24:00hrs is the end of a day.

4. Employees (and their immediate families) of the Promoter and agencies associated with this contest are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

5. The judging will take place on the 20th April 2015 between the hours of 10am and 12 noon approximately at the office of Level 1, 2/18 Lexington Drive Bella Vista NSW 2153, 1800 INFINITY (1800 46946423) or alternatively the sponsor of the contest may elect to move this location and date and time to any other place of business in Australia at its sole discretion and all participants and stakeholders will be notified prior to the judgment.

6. To be eligible to enter and have the opportunity to validate the entry to be the recipient of the Family holiday to the Gold Coast contest prize, potential entrants must not only complete an entry form either physically or online in its entirety, entrants must also meet a set criteria which is set out below:
a. Aged between 21 and 58 years of age.
b. Must be a mortgage holder in Australia with more than 5 years term remaining on your repayment schedule to achieve a debt free home.
c. If renting must have a minimum combined household superannuation balance of $100,000.00.
d. Is an existing infinity investments group Australia pty ltd, infinity financial services group pty ltd client, or has an obligation free financial health check from an infinity investments group Australia pty ltd consultant.
e. To validate your entry existing clients or new clients must have a minimum 30 minute financial health check in the comfort of their own home with one of the promoters authorized representatives.
f. Must provide relevant financial information of intrinsic value for the consultant to assess the current position of the entrant.
g. If the entrant has a de facto or spouse both parties must be present for the appointment.
h. At the completion of the 30 minute meeting the entry is manually validated by the consultant advising a senior manager of the sponsor.

7. Full Terms and Conditions for the Family holiday to the Gold Coast contest are always provided whilst the promotional stand is staffed and entries are being accepted by requesting a copy of these terms and conditions, alternatively you can email info@iiga.com.au and a copy of the terms and conditions will be emailed to you within 72 business hours of receiving your email.

8. If an entrant does not sit through a minimum 30 minute meeting with a consultant the entry is deemed invalid and will be terminated effective immediately.

9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including such as but not limited to an entrant’s identity, age and place of residence, Income, mortgage information and home ownership status) and disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

10. Incomplete or illegible entries will be deemed invalid.

11. Only one (1) entry permitted per Australian residential address Within NSW and QLD.

12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

13. The Promoter’s decision is final and no correspondence will be entered into.

14. The contest prize to be provided on the day is the below:
The Family holiday to the Gold Coast Contest Prize consists of;  A 7 day 6 nights family holiday (2 adults 2 kids) Accommodation at paradise resort Gold Coast QLD.  $1000 spending money (Issued as a pre-paid vise debit card)  A 3 park super pass for the family to movie world, sea world & wet n wild.
 The prize does not cover transportation costs, the winner will be fully responsible for the cost of attending the accommodation and getting to and from the theme parks mentioned above.

15. THE TOTAL PRIZE POOL FOR THIS PROMOTION IS VALUED AT A MAXIMUM OF $5,000.00 Inclusive of all prizes & Labour

16. All Prize values are correct as at Monday 1st September, 2014 and are reflective of the recommended retail price and are in Australian dollars. The Promoter takes no responsibility for any variations in the Prize values.

17. The Prize cannot be refunded, transferred or exchanged and, except as expressly permitted by these Terms and Conditions, cannot be taken as a monetary payment.

18. The Winner is advised that tax implications may arise from them winning the Prize and they should seek independent financial advice prior to accepting the Prize. All entrants acknowledge that the Promoter may require the Winner to (and the Winner will) reasonably execute such further documents to limit the Promoter’s liability in relation to the Prize.

19. Once the Prize has left the Promoter’s/Supplier’s premises, the Promoter and the Relevant Parties will not be responsible for any delay in delivery or loss or damage to the Prize.

20. If a winner of a prize is not present at the judging they are still the recipient of the contest prize.

21. If for any reason the recipient does not redeem the contest prize by the time stipulated by the Promoter, then the contest prize will be forfeited.

22. The recipient judged by the Sponsor to be deemed the new winner of the home makeover is not open to discussion and the judge’s decision is final.

23. There is a strict set of criteria that entrants will be judged upon to be awarded the jeep contest prize which is listed below:
a. If entry has been validated, the entrant who will be judged the recipient of the contest prize will have undertaken all advice provided to them by the sponsor and or its affiliates or other trading entities and business associates and undertaken a debt reduction strategy to better their financial position that they were previously headed towards.
b. The entrant must be willing to adhere to all budgetary structures implemented as agreed by them mutually with the sponsor and be forecast by the sponsor to achieve at least twice as much principal reduction off the existing home loan as the year previous to becoming a client of the sponsor.
c. The entrant to become the recipient of the contest prize will be voted as the new owner of the vehicle based on a judging panel to be at the full discretion of the sponsor’s company directors however it will comprise of at least 5 qualified persons to avoid a tie or deadlock between entrants.
d. The judge’s decision is final and not open for discussion nor is any other extenuating criteria that may need to be included in the event that a clear recipient cannot be determined, further to this the individual votes will remain anonymous from entrants and members of the public out of safety for staff of the sponsor.

24. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

25. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorized intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

26. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any
personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

27. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of a prize.

28. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter.

29. All entries become the property of the Promoter.
