1. All information published by the Promoter concerning entry into the Competition and Competition prizes forms part of these terms and conditions of entry. Entry into the competition is deemed acceptance of these terms and conditions of entry.
2. The promoter of the Competition is Betts Group Pty Ltd (ABN 41 008 675 929) of 32 Millrose Drive, Malaga, Western Australia (the Promoter) in conjunction with Cadet Shoes Pty Ltd.
3. Participants can successfully enter the competition by:
Buying any pair of Kardashian Kollection shoes from Betts, post a photo of yourself strutting your stuff in your new KK heels on Instagram. Tag #bettsshoes and @kardashiankollection.3.1 Entry is only open to Australian residents only.
3.2 Incomplete, incorrect and incomprehensible answers and details will, at the sole and absolute discretion of The Betts Group, invalidate the participant’s entry into the Competition.
4. The Competition commences at 9am AWST on Tuesday, March 3, 2015 and closes at midnight AWST on Monday, March 30, 2015. All registrations are deemed to be received at the time of receipt into the Promoter’s database, and not at the time of transmission by the participant.
5. The prizes are: 1x pair of KK shoes in a box signed by Kourtney, Khloe and Kim, plus a $500 Betts voucher. Prizes are not exchangeable or transferable and cannot be taken for cash.
5.1 If the prize (or part of the prize) is unavailable, The Betts Group, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
6. The winner will be announced via the Betts for Her Instagram account on Tuesday, March 31, 2015. The winner will be picked due to creativity of their answer. All entries will be judged by The Betts Group having regard to the overall quality of the response to the promotion question, including literary composition, creative merit & originality. This is a game of skill and chance plays no part in determining the winner.
7. The winner must contact Betts prior to Thursday, April 30, 2015 to claim their prize. If the prize remains unallocated or unclaimed, this prize will be forfeited.
8. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed (the Publications).
9. All entries become the property of the Promoter. The Promoter collects personal information about participants to enable participants to participate in this Competition (which may include disclosure to third parties for the purpose of processing and conducting the Competition) but no further use of this information will be made without the participant’s prior consent. Each participant agrees to his or her personal information being disclosed to State and Territory Lottery Departments and being published (if he or she wins a prize) as required under the relevant lottery legislation.
10. Except for any liability that cannot be excluded by law, the promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following:
10.1. Any technical difficulties or equipment malfunction (whether or not under the Promoter’s control).
10.2. Any theft, unauthorised access or third party interference.
10.3. Any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter.
10.4. Any variation in prize value to that stated in these Terms and Conditions.
10.5. Any tax liability incurred by a winner or entrant.
10.6. Use of a prize.
11. Employees and relatives (as defined by the Corporations Act 2001 (the Act) of employees of:
11.1. the Promoter;
11.2. service providers associated with the Competition; and
11.3. a related party or associated entity (as defined in the Act) of the persons specified in paragraph 11.1 and 11.2 above, are not eligible to enter the Competition.
12. If for any reason this Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to any written directions from the a regulatory authority.
13. The Promoter’s decision is final and binding and no correspondence will be entered into.
14. The laws of the State of Western Australia, State regulatory bodies (and where applicable the Commonwealth of Australia) shall apply to the Competition.
