“$5,000 EASTER GIVEAWAY” PROMOTION TERMS AND CONDITIONS 
1. Information on how to enter and the Prizes/Gifts form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 
2. Entry is only open to Australian residents aged 18 years or over. 
3. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.   
4. The promotion will be conducted at the Elizabeth Shopping Centre, 50 Elizabeth Way, Elizabeth, SA 5112 (“the Centre”) from 9:00am on 23/03/2015 until 5:00pm on 04/04/2015 (“Promotional Period”). All times indicated in these Terms and Conditions are in local SA time. 
5. To be eligible to enter, individuals must spend $10 or more on any food product(s) at participating retailer(s) at the Centre over the course of one (1) day during the Promotional Period (“Qualifying Spend”).   
The Qualifying Spend may include purchases made at multiple participating retailers within the Centre, however, the Qualifying Spend must be made entirely during the course of one (1) day of the Promotional Period. Participating retailers include all food court and takeaway retailers, fresh food retailers, cafes and restaurants in the Centre, excluding supermarkets. For the avoidance of doubt, transactions undertaken at any supermarket in the Centre are ineligible. For a full list of participating retailers see the Centre’s website (at www.elizabethshopping.com.au), the Customer Service Desk (opposite The Coffee Club) or the Centre Management Office. 
6. To enter the Draw (defined below), individuals must then complete the following steps on the same day the Qualifying Spend was made: a) present their original purchase receipt(s) for the Qualifying Spend made that day to a representative at the Customer Service Desk of the Centre (opposite The Coffee Club);  b) complete the official entry form located at the Customer Service Desk with all of the requested details (including the full name, post code and suburb of residence, and either their mobile telephone number or a valid email address) and opt-in to become a VIP member of the Centre (if they are not currently a VIP member); and c) provide the fully completed entry form to a representative at the Customer Service Desk.   For the sake of clarity, individuals must submit their entry the same day the Qualifying Spend is made. If this does not occur, the relevant Qualifying Spend will become invalid and cannot be used to enter or claim on any subsequent day. 
7. While stocks last, when an individual enters the Draw (in accordance with clause 6 above), they will also be invited to select a promotional Easter egg from the display at the Customer Service Desk (each an “Easter Egg”). Each Easter Egg will contain a random assortment of different vouchers (each a “Voucher”). Entrants must select and open one (1) Easter Egg, and then select one (1) Voucher from those contained in that Easter Egg. For the sake of clarity, individuals must complete the above steps immediately after they enter the Draw to be eligible to claim a Voucher (while stocks last).

8. Incomplete, indecipherable or illegible entries will be deemed invalid. 
9. Multiple entries permitted, subject to the following: (a) only one (1) Draw entry and one (1) Voucher (while stocks last) permitted per Qualifying Spend; (b) each entry must be submitted separately and in accordance with entry requirements; (c) a maximum of one (1) Draw entry per person per day is permitted; and (d) a maximum of one (1) Voucher per person per day is permitted (while stocks last).   
10. Entrants must provide their original purchase receipt(s) at the Customer Service Desk as proof of purchase. Purchase receipt(s) must clearly specify the store(s) of purchase, that the purchase(s) were made in a single day during the Promotional Period, and that the minimum Qualifying Spend of $10 was achieved across all receipt(s) at participating retailers for a single day. Failure to produce the proof of purchase may, in the absolute discretion of the Promoter, result in invalidation of an entrant’s entry and forfeiture of any right to a prize. 
11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. 
12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. 
13. The draw will take place at the Centre Management office at 11:00am on 09/04/2015 (“Draw”). The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. 
14. The first five (5) valid entries drawn in the Draw will each win a $1,000 Elizabeth Shopping Centre Gift Card (“Prize”). Gift Card is valid for 12 months from date of issue. Any ancillary costs associated with redeeming the Gift Card are not included. Any unused balance of the Gift Card will not be awarded as cash. Redemption of the Gift Card is subject to any terms and conditions of the issuer including those specified on the Gift Card.   
15. The Draw winners will be notified in writing and by telephone, and their names will be published in The Advertiser on 15/04/2015. 
16. The Promoter’s decision is final and no correspondence will be entered into. 
17. A combination of the Vouchers listed below will be available in the Easter Eggs (collectively “Gifts”). The Promoter will determine, in its discretion, exactly which of the Vouchers will be included in each Easter Egg:

18. All Vouchers must be redeemed at the Center, at the relevant retailer the Voucher is issued by. Any ancillary costs associated with redeeming any of the Vouchers are not included. 19. If for any reason a winner does not take a Prize/Gift by the time stipulated by the Promoter, then the Prize/Gift will be forfeited.   
20. If any Prize/Gift is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize/Gift with a Prize/Gift to the equal value and/or specification, subject to any written directions from a regulatory authority. 
21. Total combined Prize/Gift pool value is up to $31,785.30. 
22. Prizes/Gifts are not transferable or exchangeable. 
23. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a Draw winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this

promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 
24. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 
25. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in South Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 
26. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize/Gift claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize/Gift value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking and/or use of a Prize and/or Gift.   
27. As a condition of accepting a Prize, each Draw winner may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.   
28. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.elizabethshopping.com.au/Privacy-Policy/.  In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
