TERMS AND CONDITIONS:

Information on how to enter the V Energy & Marvel’s Avengers: Age of Ultron promotion (“Promotion”), the prizes and rules for redeeming the prizes, form part of these Terms and Conditions. Participation in the Promotion is deemed to be acceptance of these Terms and Conditions.
Any entry which does not comply with these Terms and Conditions is invalid. Incomplete, indecipherable or illegible entries will be deemed invalid.
Entry into the Promotion is open to Australian residents who are over the age of 16 years (“Eligible Entrants”) and (for entry into the New York trip prize draw) are able to travel to New York, USA at any time in 2015. Eligible Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians of Eligible Entrants under the age of 18 years old may be required by Frucor Beverages (Australia) Pty Ltd (“Promoter”) to enter into a further agreement as evidence of consent to the minor entering the Promotion.
Employees (and their immediate families) of the Promoter, and employees of participating retailers and entities associated with the Promotion are ineligible to enter.
The Promotion commences at 9:00am Australian eastern daylight time (“AEDT”) on 9 March 2015 and entries close at 11:59pm Australian eastern standard time (“AEST”) on 3 May 2015 (“Promotional Period”).
Specially marked V and “Avengers: Age of Ultron, Your chance to win a trip for 2 to New York” products are available from participating retailers (“Promotional Product”). Each individual can or bottle of Promotional Product will bear a unique entry code (“Unique Code”) which will be displayed on the outside of the Promotional Product.
Eligible Entrants are required to create a login, including creating a password and to select an age bracket in order to register for the Promotion.

PRIZE PACK WEEKLY PRIZES:

To enter, visit www.marveluniverse.com.au during the Promotional Period and:
follow the prompts to the Promotion registration and entry web page;
create a login or login (if previously registered) to play the ‘V Energy and Avengers: Age of Ultron’ game (“Game”);
play the Game; and
follow the prompts to submit your score.
No product purchase is required to play the Game or win a Prize Pack (described below). However, Eligible Entrants may purchase Promotional Product and use the Unique Code to gain boosted ability in the Game and/or enter the draw for the New York trip prize (see details below).
Eligible Entrants may enter more than once by playing more than one (1) Game however, each Game score must be submitted separately in accordance with these Terms and Conditions.
For each week of the Promotional Period, the Eligible Entrants who achieve the highest five (5) scores in the Game each week (“Weekly Winners”) will win a ‘V & Avengers: Age of Ultron prize pack’ (“Prize Pack”) comprising one of each of the following:
USB – RRP $29.95;
adult sized T-Shirt – RRP $19.95;
cap – RRP $19.95;
coaster set – RRP $12.95; and
drink bottle – RRP $9.95.
Each Prize Pack is valued at AU$92.75 RRP. There are a total of 40 Prize Packs to be won throughout the Promotion (5 per week).

Weekly Winners’ entries will be validated by 12.00pm (noon) each Monday following each weekly End Time during the Promotion Period, at Soap Creative, 406/22 Mountain Street, Ultimo, NSW 2007. Each week, Weekly Winners will be notified by email within 48 hours of Weekly Winners being validated. Weekly Winners will have their names and postcodes published in The Australian on 9 May 2015.
Weekly Winners will not be eligible for a Prize Pack for any of the subsequent weeks if they have previously won a Prize Pack.
Weekly Winners will be determined by their game score, calculated by an algorithm that determines proficiency in the Game and their ability to complete the Game (including any advantage provided by the entering of a Unique Code) and submitting their score. The Promoter’s decisions when assessing the highest scores in the Game and the times when scores were received are final, and no correspondence will be entered into regarding those decisions.
The maximum number of Weekly Winners each week will not exceed five (5). In the event that there are more than five Eligible Entrants with the highest scores in one week because some Eligible Entrants obtain equivalent scores, the Eligible Entrants with equivalent scores will be ranked by the time their score is submitted and the Weekly Winners will be the highest of scorers in the order in which they are submitted.
Each weekly prize pool is valued at up to AU$463.75 RRP. The total weekly prize pool is valued at up to AU$3,710 RRP.
Prize Packs will only be delivered to locations within Australia and Weekly Winners should allow 28 days from the end of the Promotional Period for the delivery of their Prize Pack. Entries are deemed to be received at the time of receipt into the Promoter’s database.
NEW YORK TRIP PRIZE

To enter the Promotion to win the New York trip prize, Eligible Entrants must purchase the Promotional Product.
Eligible Entrants must then visit www.marveluniverse.com.au during the Promotional Period and:
follow the prompts to the Promotion registration and entry web page;
create a login (or login if previously registered) to play the Game to be eligible to enter the draw (however, Eligible Entrants may elect not to play the Game);
enter the Unique Code; and
submit the entry.
Entrants will receive one entry into the New York trip prize draw on the date specified in clause 27 for each valid entry they submit.
Eligible Entrants may enter more than once, subject to the following:
only one (1) entry is permitted per can or bottle of Promotional Product purchase;
each entry must be submitted separately and in accordance with these Terms and Conditions;
only one (1) Unique Code per entry is permitted;
the same Unique Code cannot be used more than once;
unrecognized Unique Codes will be deemed invalid; and
a maximum of two (2) entries are permitted per person per day.
Entrants must retain the original or a photocopy of the receipt(s) for the purchase of the Promotional Product(s) for up to 14 days after the unclaimed draw date. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and the entrant’s forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase, and that the purchase was made during the Promotional Period and prior to their entry into the Promotion.
Entrants must retain the original Promotional Product(s) clearly showing the Unique Code(s) used to enter for all entries for up to 14 days after the unclaimed draw date. Failure to produce the original Promotional Product(s) for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and the entrant’s forfeiture of any right to a prize.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The first valid entry drawn from the New York trip prize draw will win a trip for two (2) people to New York City, USA (“Trip Prize”) (the exact dates to be determined by the Promoter in its sole discretion), valued at up to AU$20,100 depending on date and place of departure. The Trip Prize includes:
return economy class flights from the winner’s nearest Australian capital city to New York City for two (2) people;
transfers from airport/hotel/airport in New York only for two (2) people;
five (5) nights accommodation in a 4 star (or equivalent) hotel near Times Square for two (2) people;
1 x Marvel custom sketch valued at AU$10,000;
New York City Passes & Top of the Rock tickets for two (2) people;
Design Lab Experience for two (2) people;
New York Super-Hero Movie Sites Tour tickets for two (2) people; and
$1,000 spending money (in cash, via bank transfer) (Australian dollars, including any conversion fees)
standard travel insurance for two (2) people.
The Trip Prize draw will take place at 11.00am AEST on 5 May 2015 at Soap Creative, 406/22 Mountain Street, Ultimo, NSW 2007. The Trip Prize Winner will be notified by email and telephone within two (2) business days of the draw and their name and postcode will be published in The Australian on 9 May 2015.
Unless otherwise stated in clause 26, all other costs including meals, additional spending money, taxes (excluding airline and airport taxes), additional insurance, passports, visas, vaccinations, transport to and from the departure point, additional transfers, items of a personal nature, in-room charges, any costs or charges consequential to the Trip Prize, and all other ancillary costs are the responsibility of winner and are not included in the Trip Prize.
The Trip Prize must be taken in 2015 and is subject to booking and flight availability. Winner must give at least 60 days’ notice prior to their requested departure date. Winner will be requested to provide three separate dates of preferred travel to the Promoter who will work towards fulfilling at least one of the winner’s preferred dates of travel. The exact dates are to be determined by the Promoter in its sole discretion. The travel date is subject to availability and blackout dates will apply unless specifically pre-arranged prior to the competition being run. Blackout dates include peak Christmas, Easter and United States summer holidays.
Once confirmed in writing, travel dates and names of those traveling are not changeable.
If the winner is under the age of 18 years at the time of the Trip Prize draw, the Trip Prize will be awarded to the winner’s nominated parent or guardian on the winner’s behalf. If the winner of the Trip Prize is under the age of 18 years for any part of the duration of the trip that forms the subject of the Trip Prize, a nominated parent/guardian must accompany that person for the duration of the trip.
It is the responsibility of the winner and the winner’s guest to ensure that they each have valid travel documentation (including, but not necessarily limited to, passports, visas, and re-entry permits) as required for travel between their nearest Australian capital city and the USA. It is the responsibility of the winner and the winner’s guest to each comply with the visa requirements of the USA. Anyone not holding valid travel documentation will be deported from the USA upon arrival without exception. Approval of visas, and of entry into the USA, is at the discretion of the USA Embassy, USA Customs and USA Border Officials, and the Promoter and entities associated with the Promotion will not be held responsible for any rejection or deportation whatsoever of the winner or the winner’s guest. Any fines, penalties, payments or expenses incurred as a result of travel documents not meeting the requirements, or a winner or winner’s guest being deported, will be the sole responsibility of the winner or the winner’s guest. International travel advice can be obtained from various sources, including government and local consular offices and the Australian Department of Foreign Affairs and Trade website at www.dfat.gov.au.
The winner and the winner’s guest must provide proof of identity.
Each component of the Trip Prize is subject to the standard terms and conditions of the individual providers of that component. The winner and the winner’s guest must have a valid passport, and must be valid for at least six (6) months from the date of departure. The winner and the winner’s guest must depart from and return to the same departure point in Australia and must travel together. The itinerary is to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the Trip Prize. Winner may be required to present their credit card at the time of check in to accommodation.
The provision of specialist activity and travel insurance in the Trip Prize is subject to the standard terms and conditions of individual insurance providers and the ability of the winner and/or the winner’s guest to obtain the relevant insurance. Specialist activity and travel insurance will be supplied to the Trip Prize winner and the winner’s guest before departure from Australia. Any travel insurance to cover the winner or winner’s guest’s pre-existing medical condition(s) will be at the winner or the winner’s guest’s expense.
The New York City Pass & Top of the Rock tickets, Design Lab Experience and New York Super-Hero Movie Sites Tour tickets are subject to the event venue and ticket terms and conditions, including any applicable age restrictions. The Promoter and event organisers hereby expressly reserve the right to refuse entry or eject any winner and/or any winner’s guest for any inappropriate behaviour whilst participating in any element of the Trip Prize.
As a condition of accepting the Trip Prize, the winner and the winner’s guest must sign any legal documentation as and in the form required by the Promoter, and entities associated with the Promotion and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
MISCELLANEOUS
The Promoter may conduct an unclaimed prize draw for any unclaimed prizes at 10.00am AEST on 10 August 2015 at the same place as the original draw for the Trip Prize, subject to any directions from a regulatory authority, including but not limited to gaming or lottery authority. The Trip Prize winner of the 10 August 2015 draw, if it is undertaken, will be notified by email and telephone within two business days of unclaimed prize draw. The winners of Prize Packs of the 10 August 2015 draw, if it is undertaken, will be notified by email within two business days of unclaimed prize draw. All winners of unclaimed prizes will have their names and postcodes published in The Australian on 14 August 2015.
The Promoter’s decisions are final and no correspondence will be entered into.
The Promoter may engage third party providers to assist in completing fulfillment of the prizes.
If any prize (or an element of any prize) is unavailable despite the Promoter’s reasonable endeavours to procure the item within Australia, the Promoter, in its discretion, reserves the right to substitute the prize (or that element of the prize) with a prize to the equal value and/or specification, subject to any written directions from a gaming or lotteries authority.
If for any reason a winner does not take or claim a prize (or an element of the prize) at the time stipulated by the Promoter, then that (or that element of the prize) will be forfeited and will not be redeemable for cash.
The total prize pool value is up to AU$23,810. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, and place of residence) and to disqualify any entrant from the Promotion who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Entries that contain errors or omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter and its associated agencies and companies will not be liable for any problem or technical malfunction of any telephone, computer network, line, servers, or telephone or internet provider, traffic congestion on any phone or computer network, or any combination thereof. They will also not be liable for any injury or damage to an entrant’s, or any other person’s, handset or computer related to or resulting from their participation in, or sending or receiving of any communication or other materials as part of, this Promotion.
Entrants agree to the use of their name, likeness, image and/or voice for publicity regarding the Promotion and acknowledge that it is a condition of taking any prize that all persons taking a prize agree to publicity regarding the Promotion including the use of their names, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter or entities associated with the Promotion.
If the Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated for any reason beyond the reasonable control of the Promoter, including but not limited to a computer virus, mobile phone failure, line drop outs, bugs, tampering, fraud, technical difficulties or unauthorised intervention, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
to disqualify any entrant; or
subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
The use of any software or any other mechanical or electronic means that allows an entrant to automatically enter the Promotion repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Nothing in these Terms and Conditions limits, excludes, modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, or any other implied warranties under the Australian Securities and Investments Commission Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, those arising out of:
any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
any theft, unauthorised access or third party interference;
any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter) for any reason beyond the reasonable control of the Promoter;
any variation in the value of the prizes as stated in these Terms and Conditions;
any cancellation or delay of the awarding of any element of a prize that is beyond the reasonable control of the Promoter;
any tax liability incurred by a winner or entrant; or
use of a prize.
The Promoter and its associated agencies and companies are not liable for any loss or damage whatsoever which is suffered by entrants into the Promotion, including but not limited to indirect or consequential loss and any personal injury suffered or sustained during the course of accepting or using any of the prizes, except for any liability which cannot be excluded by law.
By entering the Promotion entrants are deemed to have accepted these Terms and Conditions and to have expressly consented to the use of their personal information for the purpose of the Privacy Act, Spam Act and other related privacy legislation. Entrants acknowledge and agree that the Promoter may collect their personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to, agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry into the Promotion is conditional on providing this information. The Promoter may, for an indefinite period, unless consent is withdrawn by the entrant, use an entrant’s personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct their personal information to the Promoter. All entries into the Promotion become and remain the property of the Promoter. Personal information will only be used in accordance with the Promoter’s privacy policy available at www.frucor.com.au.
