Major prize
The major prize is a trip for the winner and three companions (aged 18 or over) to either Byron Bay NSW, Perisher NSW or Melbourne VIC (as selected by the winner) valued in total at up to $10,000 (inc GST), depending on the winner’s point of departure. The Promoter will not be liable in any way if the major winner does not receive the major prize of their choice, for whatever reason.

Unclaimed Major Prize Draw Details If, after making all reasonable attempts, the Promoter cannot contact a drawn major winner (and the drawn major winner does not contact the Promoter) by the above Major Prize Claim Date and Time, the Promoter reserves the right to discard that entry and to draw another major winner at 11am (AEST) on 24/07/15 (at the same location as the original draw).

The competition will be conducted in each Outlet during the Competition Period.

Entries must be received during the Competition Period. Entries are deemed to be received at the time they are received by the Promoter’s database and not at the time of submission by the entrant. Any entry that is based on a returned Eligible Purchase (except where due to defect of the product) will be deemed invalid. Failure of an entrant to provide their original itemised receipt/s and Entry Leaflet/s (as per the Retain Receipt and Entry Leaflet Requirements) (without alteration) to the Promoter upon request may, at the Promoter’s discretion, result in an invalid entry (and, at the Promoter’s discretion, in all of the entrant’s entries being invalid). The draw will be conducted at the time, on the date and at the location as stated in the Draw Details.

The major prize is a trip for the winner and three companions (aged 18 or over) to either Byron Bay NSW, Perisher NSW or Melbourne VIC (as selected by the winner) valued in total at up to $10,000 (inc GST), depending on the winner’s point of departure and their choice of major prize. Each trip option consists of the following:

(a)   return economy airfares (including airfare taxes) for the winner and their three companions from the winner’s nearest Australian capital city to either Ballina airport (for the Byron Bay trip), Canberra airport (for the Perisher trip) or Melbourne airport (for the Melbourne trip), as relevant;

(b)   accommodation for the winner and companions, as follows:

(i)   Byron Bay – 3 nights accommodation at the Quiksilver pad;

(ii)   Perisher – 3 nights accommodation in a minimum 4 star apartment

(iii)   Melbourne – 2 nights accommodation in a minimum 4 star hotel (as determined by the Promoter) including breakfast daily;

(c)   return transfers between the destination airport and the accommodation for the winner and their companions; and

(d)   the following additional items for the winner and their companions, as relevant:

(i)   Byron Bay – 1 day surfboard hire and a 2 hour surf lesson;

(ii)   Perisher – 3 days snowboarding equipment hire, a 2 hour snowboarding lesson, a 3 day lift pass and travel insurance for the winner and their 3 companions;

(iii)   Melbourne –1 day Moto X equipment hire, hanging out with Cam Sinclair for a day (subject to availability) and having a personal Moto X lesson, and travel insurance for the winner and their 3 companions. The Promoter will not be liable for Cam Sinclair’s failure to attend the trip on dates to be agreed between the winner and the Promoter, for whatever reason. The Moto X Trip prize must be taken on dates agreed with the Promoter and Cam Sinclair. The Promoter will not be liable if a winner is unable to take the Moto X Trip prize on the date of their choice, for whatever reason; and

(e)   $1,000 spending money for the winner only.

Flights and/or transfers may not be included if the winner resides in the state of their chosen trip destination, at the Promoter’s discretion.

Flights, activities and accommodation are subject to booking and availability. Travel must be booked and completed by 30/03/16. The major prize cannot be taken during major event/peak/public holiday periods or any other exclusion periods as specified by the Promoter or the prize supplier/s. All other costs associated with the major prize, including but not limited to any additional transfer costs, meals, additional taxes, insurance and other ancillary costs are the responsibility of the winner and his/her companion/s, as incurred. The winner and their companions must depart and return at the same time. The major prize is subject to any additional terms and conditions specified by the prize suppliers, including any conditions of entry into any relevant event or venue (including but not limited to behaviour requirements and applicable dress codes).

The winner will be notified in accordance with the Winner Notification and Publication section of these conditions. By entering this competition, each entrant requests that his or her full address not be published.

The winners (and their companions) must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their names and images in promotional material.

Entrants (and their companions) acknowledge that there are inherent risks in some aspects of the major prize and that using the prize involves participating in dangerous activities. By entering this competition and/or accepting the prize, entrants and their companions accept that risk.

In order to participate in the activities awarded as part of the major prize, the winner and their companions may be required to comply with applicable height, weight, health and fitness requirements and any other requirements normally associated with the relevant activities. It is the winner’s responsibility to ensure that they and their companions are sufficiently healthy and fit so as to safely take the trip and undertake the activities awarded as part of the prize. The Promoter reserves the right to deem that the winner and their companions are not sufficiently healthy or fit. The winners and their companions must comply with all requirements and directions of the people responsible for the conduct of the relevant activities. The winner and their companions may be required to sign an indemnity and exclusion of liability form (provided by the Promoter) in favour of all parties involved in this competition and/or providing the prize prior to undertaking the activities included in the prize. If a winner or any of their nominated companions do not sign the form provided by the Promoter within the time requested by the Promoter, the winner’s entry or claim will be deemed invalid.

14   The Promoter may require winners to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.

If a major prize winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry in accordance with paragraph 6.

The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person (including without limitation a winner or any of their companions) who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate. The winner is fully responsible for the acts and omissions of their companions and the Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, the winner and any or all of their companions if any of their companions breaches these conditions, whether or not legally bound by them.

The Promoter may in its absolute discretion cancel the prize or otherwise cease to provide any benefit of the prize to a winner (and their companions, if applicable) if the winner (or their companions, if applicable), in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate.

The Promoter’s decision is final and no correspondence will be entered into.

The prizes are not transferable or exchangeable and (except where cash is specified) cannot be redeemed for cash. If for any reason the major winner or any of their companions do not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited and cash will not be supplied instead. The Promoter accepts no responsibility for any variation in prize value. If a prize or any element of a prize is unavailable for any reason, the Promoter may substitute for that prize or element of that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the relevant gaming authorities if required.

There will be a total of 111,400 Entry Leaflets printed.

Printing and other quality control errors outside the Promoter’s control will not invalidate an otherwise valid prize claim. Every prize claim in excess of the advertised minor prize pool will be honoured, unless such claim is rejected due to fraud or ineligibility under these conditions.

If any minor prize has not been accepted or claimed in accordance with the Minor Prize Claim Date, or if an instant win prize has not been won, any relevant winner’s entry will be deemed invalid and the Promoter will conduct such further draws in accordance with the Unclaimed/Unwon Minor Prize Draw Details as are necessary to distribute the minor prize/s, subject to any requirements of the relevant gaming authorities. Any winner(s) in this draw will be notified in writing (by email).

If any major prize has not been accepted or claimed in accordance with the Major Prize Claim Date and Time or if, after making all reasonable attempts, the Promoter cannot contact the drawn winner (or the drawn winner does not contact the Promoter) by the Major Prize Claim Date and Time, the relevant winner’s entry will be deemed invalid and the Promoter will conduct such further draws in accordance with the Unclaimed Major Prize Draw Details as are necessary to distribute the major prize, subject to any requirements of the relevant gaming authorities. Any winner(s) in this draw will be notified as stated in the Unclaimed Major Prize Draw Winner Notification and Publication.

The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury illness or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in transit to prizes. Prizes will be delivered in Australia only.

The Promoter may communicate or advertise this competition using Facebook. However, the competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability.

As a condition of accepting or participating in any prize a winner’s companions accept these conditions.

If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the relevant gaming authorities if required.

The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
