TERMS AND CONDITIONS:

1. Information on how to enter and prizes form part of these Conditions of Entry. Participation in this promotion is deemed acceptance of these Conditions of Entry.
2. Entry is open to residents of Australia. Employees of the Promoter, and their immediate families and all companies and agencies associated with this promotion are ineligible to enter. Entrants under 18 must seek parental or legal guardian consent to enter.
3. Promotion commences on Friday 24th April at 16:00 AEST and closes on Wednesday 29th April 2015 at 23:59 AEST. The draw will take place at Promoter’s premises 24 Artarmon Road, Willoughby NSW 2068 Thursday 30th March 2015 at 09:00 AEST. The winners will be notified by phone and mail using the contact details given in their entry.
4. The Promoter reserves the right, at anytime, during, or after the closing date of the promotion, to verify the validity of entries and to disqualify any entrant who tampers with the entry process (including but not limited to tampering by way of the utilisation of techniques designed to avoid the payment of call costs or the utilisation of automated entry software) or who submits an entry that is not in accordance with these Conditions of Entry. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
5. To enter, individuals must:
a) Visit an official Channel 9 Facebook page https://www.facebook.com/Channel9
b) Follow the prompts to the competition tab page, input the requested details including full name, address, day time telephone number and submit the fully completed entry form as instructed.
6. This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
7. Multiple entries permitted but each entry must be submitted separately and in accordance with the entry requirements.
8. The promoter is neither responsible nor liable for late, lost or misdirected entries. Incomplete, inaudible or indecipherable entries will be deemed invalid.
9. All entries are deemed to be received at the time of receipt by the Promoter and NOT at the time of transmission by the entrant.
10. The first ten (10) valid drawn from all entries received during the promotional period will be deemed the major prize winner and will receive:
- 1 x Double pass to the Australia v New Zealand ANZAC Day NRL Test Match in Brisbane. Valued at $61.30
The total prize pool for the entire promotional period is $613.00
11. All prizes must be taken as offered. The prize, or any unused portion of the prize, is not transferable, exchangeable and cannot be redeemed as cash. The prize is not valid in conjunction with any other offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
12. Products included in prize package (including but not limited to titles, colour, design, sizing, model, finish, style etc) will be determined by the promoter in its complete discretion. All prizes must be taken as offered.
13. Unless specified otherwise, the winner (and their companions) are responsible for all expenses including, without limitation, spending money, meals (unless specified), drinks, transfers (unless specified), activities (unless specified), incidentals, energy surcharges, gratuities, services charges, and all other ancillary costs.
14. If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian on behalf of the winner. It is the responsibility of the winner’s parent/legal guardian to prove their parental status/ legal guardianship at the time of winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a winners parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to and administrative fees incurred by the Promoter). Where relevant, the Promoter is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. The Promoter is not responsible for determining any other delivery details or taking direction that relates to any ongoing family law negotiations and/or determinations. These are the responsibility of the winner and their respective parent/s and/or legal guardian/s.
15. In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.
16. In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery departments.
17. The promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).
18. The Promoter is not responsible nor liable for any prize damaged in transit in the delivery of their prize
19. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
20. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster)the Promoter reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.
21. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enterhowever you must briefly state your circumstances upon entry.
22. It is a condition of accepting the prize that the Winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion.
23. The Promoter reserves the right to request the Winner to provide proof of age and identity. Identification considered suitable for verification is at the discretion of the Promoter.
24. The Promoter may conduct such further draws at the same place as the original draw as are necessary on Monday 27th July 2015 at 10:00 AEST in order to distribute the prize if unclaimed by that date, subject however to all reference to any relevant state and territory regulations. In the event of a winner, they will be notified in writing using the contact details given in their entry.
25. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
26. If this Competition is not capable of running as planned due to any reason whatsoever, including but not limited to, programming changes, technical failures (either in the administration of the Competition or the broadcast of the television program), unauthorised intervention, fraud or any causes beyond the control of the Promoter which corrupt or affect the conduct, administration, security, fairness or integrity of the Competition, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law and subject to any written directions given by a regulatory authority, to: (a) modify, suspend, terminate or cancel the Competition; and/or (b) disqualify any entrant, as appropriate.
27. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the
Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these conditions of entry; (e) any tax liability incurred by a winner or entrant; (f) participation in the Competition and/or (g) redemption of the prize.
28. All entries become the property of the Promoter. The collection, use and disclosure of personal information in connection with this Competition are governed by the Promoter’s Privacy Notice available from the Promoter and these Conditions of Entry. The Promoter may use information it collects in relation to you to provide you with information regarding further offers, Competitions or goods and services provided by the Promoter and/or the Promoter’s partners and sponsors. The Promoter may also disclose information about you to its service providers to enable the Promoter to provide you with services. Your personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. You consent to the Promoter’s use and disclosure of information about you as contemplated by this condition. To remove your information from the Promoter’s records, please send an email to competitions@nine.com.au with your name, mobile phone number and your request to cancel the service. 29. To the full extent permitted by law, The Promoter will not be liable to you in respect of any claim for any loss or damage whatsoever (including, without limitation, any consequential, indirect, special, punitive or incidental damages) or for any personal injury suffered by you as a result of or in connection with the Promoter’s provision of the Service. Certain legislation may imply warranties or conditions or impose obligations (collectively Provisions) in relation to the Promoter’s provision of services to you which cannot be excluded, restricted or modified except to a limited extent. If those Provisions apply, to the extent that the Promoter is entitled to do so, the Promoter’s limits its liability in respect of any claim under those Provisions to, at the Promoter’s option, the supply of the relevant services again or the payment of the costs of having the services supplied again.
