TERMS AND CONDITIONS FOR WESTFIELD GARDEN CITY FASHION APPRENTICE PROMOTION
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this Westfield Garden City Promotion (“Promotion”) is deemed acceptance of these Terms and Conditions.
ELIGIBILTY
2. Subject to condition 3, this Promotion is only open to residents of QLD aged 18 years or over.
3. The following are ineligible: (i) employees of the Promoter, the Scentre Group or any of the tenants or retailers in the Participating Centres or any of the Promoter’s agencies that are associated with the Promotion; (ii) the spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of an excluded employee; and (iii) any person who the Promoter has previously notified is not permitted to enter the Promoter’s promotions.
PROMOTION PERIOD
4. This Promotion commences at 5.00pm Australian Eastern Standard Time (“AEST”) on 15 June 2015 and ends at 11:59pm AEST on 1 July 2015 AEST (“Promotion Period”). Online public voting for finalists commences at 9.00am AEST on 3 July 2015 and ends at 11:59pm AEST on 7 July 2015 (“Voting Period”).
HOW TO ENTER
5. Individuals can enter the Promotion through the “Fashion Apprentice” application (“App”) on the Facebook Platform. Individuals can locate the App on the Westfield Garden City Shopping Centre page on Facebook (www.facebook.com/WestfieldGardenCity) (“Westfield Garden City Page”). Individuals must accept the permissions requested by the App. Entrants must then use the App to undertake the following steps:
 Input the requested details including their full name, valid email address, mobile telephone number, age and occupation;
 Upload a maximum of three (3) photographs and/or illustrations (that the entrant has taken or created themselves) that showcases the entrants styling, design and/or trend interpretation abilities;
 Include a 100 words or less blog detailing the theory/inspriation behind their submission; and
 Submit the fully completed online entry form.
It is a condition of entering the Promotion that entrants agree for their personal information to be added to the Westfield database and to be
used in accordance with the purposes set out in these Terms and Conditions.
6. Each entrant warrants to the Promoter that each entry/photograph/illustration submitted is an original creative work of the entrant that does not infringe on the rights of any third party. Each entry/photograph/illustration must comply with the provisions contained in clause 8.
7. All entries (including the photographs/illustrations) will be reviewed by the Promoter for compliance with these Terms and Conditions. Entries that contain prohibited or inappropriate content, or is otherwise in breach of these Terms and Conditions, as determined by the Promoter, will at the discretion of the Promoter be deemed invalidand will not be eligible to win.
8. Entrants agree that they are fully responsible for any materials they submit via the Promotion including but not limited to comments, recordings images or illustrations (“Content”). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that:
(a)they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
(b)their Content shall not contain viruses or cause injury or harm to any person or entity;
(c)they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
(d)the Content is the original literary work of the entrant that does not infringe the rights of any third party;
(e)they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
(f) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.
9. As a condition of entering this Promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall
include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
LIMITS ON ENTRY
10. Limit of one (1) entry permitted per eligible person.
CRITERIA OF JUDGING
11. This is a game of skill and chance plays no part in determining the winner. At the end of the Promotional Period, each entry will be individually judged based on the entrants styling, design and trend interpretation abilities as well as how well they detailed their styling in their blog response. The best five (5) valid entries, as determined by the judges will each be deemed a finalist (“Finalist”).
12. Once the Finalists have been determined each of the five Finalists entries will be uploaded onto the Facebook Page for public voting.
13. At the end of the Voting Period, the Finalists entry that received the highest number of valid votes will win the prize.
14. In the event of a tie for the prize between two (2) or more Finalists, the Promoter will judge each of these tied original entries against each other, and the Promoter will select which tied entry will be deemed the winner. Each tied-entry will be judged based on the entrants styling, design and trend interpretation abilities as well as how well they detailed their styling in their blog response.
VOTING INSTRUCTIONS
15. Voting is only open to residents of Australia aged 13 years or over. Individuals must have a Facebook account in order to access the Facebook Page and cast a vote.
16. To vote, individuals must complete the following steps during the Voting Period:
a) visit the Westfield Garden City Page;
b) follow the prompts to the App and access the Voting Gallery contained
on the App; and
c) click the “Vote” button corresponding to the entry they determine to be
the most worthy of the prize in their opinon.
17. No prize will be awarded for the act of voting.
18. The Promoter reserves the right, at any time, to verify the validity of votes and voters (including a voter’s identity, age and place of residence) and to disqualify any voter who submits a vote that is not in accordance with these Conditions of Entry or who tampers with the voting process. Errors

The Promoter reserves the right, at any time: (a) to invalidate any votes which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or votes that have been submitted through the use of multiple identities, email addresses or accounts, including but not limited to social networking accounts; and/or (b) to disqualify any entrant (or invalidate his/her entry) that the Promoter reasonably suspects has paid, bartered or offered payment or other consideration to another person in exchange for votes or has otherwiseencouraged or procured any person to submit votes contrary to these Terms and Conditions.
20. Multiple votes permitted, subject to the following: (a) each vote must be submitted separately and in accordance with voting requirements; and (b) a maximum of one (1) vote is permitted per person per entry. For the sake of clarity, individuals are eligible to vote for multiple entries, however, they may only vote for each entry once.
WINNER NOTIFICATION
21. The provisional winner will be notified by email. A provisional winner will only be deemed a winner once verified by the Promoter.
PRIZES
22. The prize is an opportunity for the winner to attend the Westfield Spring Summer Fashion Shoot in July 2015 and includes:
 Return economy flights from Brisbane, QLD to Sydney, NSW in July 2015 for the winner only. All costs associated with getting to and from Brisbane QLD is the winner’s responsibility and is not included;
 three (3) nights accommodation at a minimum 4star hotel in the Sydney CBD in July 2015 for the winner only;
 A $500 Westfield XS Gift Card to help the winner towards spending money, transportation required and/or meals;
 meet and greet with Kirstie Clements, a meet and greet with Bauer Media representatives and subject to availability a digital media session with Alyce Cowell. In the event Alyce Cowell is unavailable on the day of the Westfield Spring Summer Fashion Shoot in Sydney, the Promoter will liaise with the winner to organise another date for the digital media session with Alyce Cowell to take place in Brisbane QLD, however, in the event that agreement can not be reached, the Promoter reserves the right to determine the alternate date (for the digital media session) in its absolute discretion. All ancillary costs associated with getting to and from the media session (including but not limited to any travel and or accommodation costs) will be the responsibility of the winner;
One (1) two (2) hour style session with a Westfield Garden City stylist (at Westfield Gafrden City) for the winner only. This styling session must be redeemed by 30th September 2015; and
 A one thousand dollar ($1,000) Westfield Gift Card awarded to the winner each month for six months (being July 2015, August 2015, September 2015, October 2015, November 2015 and December 2015).
Additional spending money, meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken to coincide with the Wesfield Garden City Fashion Shoot being held in July 2015 and is subject to booking and flight availability. The Wesfield Garden City Fashion Shoot is scheduled to take place bewtween 1st and 31st of July 2015 and the Promoter will advise the winner of the exact dates at the time of winner notification.
23. The winner must depart from and return to the same departure point. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.
24. Any ancillary costs associated with redeeming the Westfield Gift Card are not included. Any unused balance of the Westfield Gift Card will not be awarded as cash. Westfield Gift Cards are issued by Scentre Gift Cards Pty Ltd ACN 113 171 663. Westfield Gift Card terms and conditions apply. Westfield Gift Cards are only redeemable at accepting retailers.

GENERAL
25. Incomplete, indecipherable or illegible entries will be deemed invalid.
26. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
27. Prize is subject to the standard terms and conditions of individual prize and service providers. If for any reason a winner does not take the prize or an element of the prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.
28. If any prize (or part of any prize) is unavailable due to reasons beyond the control of the Promoter, the Promoter its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
29. Total prize pool value is up to $9,000.
Prizes, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

The Promoter reserves the right, at any time, to verify the validity of entries (including contacting Participating Retailers) and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.

The Promoter’s decision is final and no correspondence will be entered into.

Any cost associated with accessing the Westfield Garden City Page is the entrant’s responsibility and is dependent on the Internet service provider used.

Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non- Excludable Guarantees, the Promoter and the Scentre Group of companies (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

 Except for any liability that cannot by law be excluded, including the Non- Excludable Guarantees, the Promoter and the Scentre Group of companies (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or correspondence that is late, lost, altered, damaged or misdirected (whether received by the Promoter or not) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an entrant or winner; or (f) use of the prize.

PRIVACY

In order to conduct this Promotion, the Promoter needs to collect personal information about each entrant and may for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, gift suppliers and regulatory authorities. Participation in the Promotion is conditional on providing this information. It is a condition of entry that the entrant agrees to being entered into the Westfield database. The Promoter and the Scentre Group may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant and for such other purposes as set out in the Westfield Privacy Policy. Entrants should direct any request to access, update or correct information to the Promoter. All personal details of entrants will be stored at the office of the Promoter and/ or Westfield. Upon the entrant’s request, all information provided will be removed from our active database. To request details to be removed, please go to http://westfield.com.au/unsubscribe or write to the Digital Marketing Manager, Level 30, 85 Castlereagh Street, Sydney, NSW 2000. Information will be removed as soon as reasonably possible in accordance with our Privacy Policy and applicable laws. The “Promoter” is Scentre Promotion Fund Management Pty Ltd (in its capacity as The Trustee for SCENTRE PROMOTION FUND ABN 79 727 004 194) C/- Westfield Garden City Shopping Centre, Centre Management, Corner Logan and Kessels Road, Upper Mt Gravatt, QLD 4122.

The “Scentre Group” means the Promoter, each of the Promoter’s related bodies corporate, each person with whom the Promoter or any of its related bodies corporate is in joint venture or partnership, and each entity, trust, partnership or fiduciary arrangement (including each managed investment scheme) of its related bodies corporate has been, is or becomes the trustee, manager or responsible entity including, without limitation, the Scentre Group Trust 1, Scentre Group Trust 2, or Scentre Group Trust 3.
