Terms and Conditions – Facebook Ice Cream Emergency Competition July 2015

Information on how to enter and prizes form part of these conditions.

The Promoter is Harice Pty Ltd Holdings Ltd. ABN 56067403730 of 17 Tinning Street Brunswick Victoria 3056 Australia.

By entering this promotion you agree to be bound by these Terms and Conditions (Terms) and the Promoter in its sole and absolute discretion may refuse to award any prize to any entrant who fails to comply with these Terms and Conditions.

This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook.

By entering this contest, you agree to a complete release of Facebook from any or all liability in connection with this contest.

 
1. Promotion Period

1.1. The promotion commences 9am Wednesday 1 July 2015 and concludes 11.59pm Monday 31 July 2015 EST.

1.2. Valid entries require entrants to:

    Like the Harry’s Ice Cream Facebook page, &
    Share a photo or status stating your ice cream emergency containing both hastags #HarrysIceCreamCo and #IceCreamEmergency

 

2. Eligibility

2.1. Entry is open to all permanent residents of Australia (Eligible Entrant) excluding: the Promoter’s employees, factory operators, suppliers and their immediate families;

2.2. The Promoter is responsible for determining whether a person is an Eligible Entrant in its sole and absolute discretion.

2.3. Entrants must be individuals only and cannot be acting on behalf of an organisation or group.

2.4. Eligible Entrants: on notification of winning must provide their own legal name to verify their entry in the Promotion;

 

3. Determining the winner

3.1. Harry’s Ice Cream Emergency Competition is a game of skill and will be judged internally by the Promoter. The most valid and compelling entry will be chosen at the end of each day and contacted by the Promoter via a comment on the winning photo or status. Please do not message with screen shots or complaints.

3.2. The prize winners must respond to the request for contact details from the Promoter within 48hrs of being contacted in order to claim their prize. Should the prize winner not respond within the time limit, the Promoter is within their rights to contact the next eligible winner.

3.3. All of the Promoter’s judging panel’s decisions are final and binding on each person who enters the competition and no correspondence will be entered into.

3.4. Unless advertised differently, the prize winners will be notified via Facebook, Instagram or Twitter.

3.5. If for any reason the Promoter believes the Eligible Entrant has not complied with these Terms or the Promotion requirements, the Promoter may, in its sole and absolute discretion, refuse to award a Prize.

3.6. Winners will be notified by the Promoter if their entry is selected as the winner of the competition.

 

4. How to Enter

4.1. Valid entries require entrants to a) like the Harry’s Ice Cream Facebook page  or Instagram page and b) submit a photo or status with a description of the ice cream emergency c) hasthtag the photo with both #HarrysIceCreamCo and #IceCreamEmergency d) submit before the stated closing date of the promotion period.

4.2. The Promoter will only accept one entry per day, per social platform, per user. The Promoter will take whatever entry is submitted first on the day, as the users official entry.

4.3. Entries must:

a) not be offensive, defamatory, unlawful or likely to cause offense to other persons; and


b) be free of any claims, including copyright claims, by other parties.


c) obtain full prior consent from any person who has jointly created or has any rights in the Content entered.

 

5. Prize

5.1. The Prize cannot be exchanged, transferred, redeemed for cash or sold.

5.2. The Prize must be taken as offered and cannot and will not be varied.

5.3. The Promoter is not responsible nor liable for any prize damaged in transit in the delivery of their prize

5.4. Each prize pack will comprise of: either 10 x 475ml tubs of Harry’s Ice Cream or a Harry’s Ice Cream Woolworth’s voucher worth $50. Prize values are correct as at the date of publication and the Promoter accepts no responsibility for variation in prize value.

5.5. Any Entrant within a 50kms of the postcodes VIC 3000, NSW 2000, and SA 5000, will be eligible for a delivery of Harry’s Ice Cream product. Whereas any entrant outside of these limits will receive a $50 Woolworth’s voucher.

5.6. The Promoter retains the right to provide a voucher rather than physical stock, in any circumstance deemed necessary.

5.7. Products included in prize packages (including but not limited to colour, design, sizing, model, finish, style etc) will be determined by the promoter in its complete discretion. All prizes must be taken as offered.

 

6. Monitoring and Moderation

6.1. The Promoter reserves the right to monitor and moderate all entries.

6.2. The Promoter reserves the right to remove any entries considered to be of an offensive or defamatory nature.

6.3. The Promoter reserves the right, in its sole and absolute discretion, to remove any entries that it considers to against the spirit of the competition.

 

7. General Conditions

7.1. All entries will become the property of the Promoter.
