TERMS AND CONDITIONS:

1. The Local Foodies Promotion (Promotion) commences at 9:00am Australian Eastern Daylight Time (AEDT) on Thursday 5 November 2015 and concludes at 5:30pm (AEDT) on Sunday 20 December 2015 (Promotion Period).
2. The Promotion is promoted by Vicinity Custodian Pty Ltd ACN 077 870 243 as trustee for VCX Property Management Trust ABN 21 969 875 489 (Promoter) of Toombul 1015 Sandgate Road, Toombul QLD 4012.
3. All entrants (Entrant) will be subject to, and will need to adhere to, the terms and conditions as set out by the Promoter and any future terms and conditions or alterations to these terms and conditions.
Prize
4. The Promotion will award nine (9) finalists and one (1) winner (Winner) with a prize (each a Prize and together, the Prizes).
5. Finalists will each win Prizes worth $200 and one (1) Winner will win a Prize worth $1,000.
6. The Prize pool has a total value of $2,800.
7. The Prizes are supplied by Rewards Come True ABN 17 110 879 320 (Supplier).
8. The Prizes are further subject to the terms and conditions of the Supplier.
9. The Prizes are not transferable, refundable or exchangeable for cash or kind and are subject to terms and conditions.
10. If a Prize is unavailable for whatever reason, the Promoter reserves the right to substitute that Prize for a Prize of equal or greater value, subject to any applicable statutory requirements.
How to Enter
11. To enter the Promotion, Entrants must, during the Promotion Period:
a. visit www.toombulcentre.com.au
b. navigate to the Promotion screen (the Competition Entry Page);
c. complete all mandatory fields as required on the Competition Entry Page; and
d. agree to the terms and conditions of the Promotion and enter the Promotion
(completion of steps (a) to (d) constitutes an Entry).
12. Entry is limited to one (1) Entry per eligible person during the Promotion Period.
The Selection
13. The Promotion is a game of skill. The Winners will be selected from the pool of Entries which comply with these terms and conditions and will be judged based on the most interesting and original eligible recipe (at the absolute discretion of the Promoter).
14. Winners will be selected by the Promoter at approximately 12:00pm (AEDT) on Monday 18 January 2016 at Toombul Centre Management, 1015 Sandgate Road, Toombul QLD 4012.
No responsibility will be accepted for late, lost, incomplete or misdirected Entries. Entries which contain incorrect contact details will be deemed invalid. The Promoter reserves the right in its sole discretion to disqualify any Entrant who the Promoter has reason to believe has breached any of these terms and conditions, or engaged in unlawful or other misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such a person are reserved.
16. Any decision made by the Promoter in respect of the Promotion is final and binding and no correspondence shall be entered into.
17. The Winners do not need to be present at the selection and will be notified by telephone or email at a later date. If the Promoter has not had return communication from any initial intended Winner within three months (i.e attempts to contact the Winner have met with failure) then that person shall be deemed to be no longer eligible for a Prize and the Promoter will select a replacement winner at a time and place determined by the Promoter (the Replacement Winner). The Replacement Winner is then a Winner for the purposes of these terms and conditions.
18. Proof of identity will be required to claim any Prize.
19. All Entrants under the age of 18 must have prior consent from their parent or guardian
before entering the Promotion and must be able to provide evidence of such consent on
request.
20. If a Winner is under 18 years of age, the Prize will be awarded to that Winner’s nominated
parent/guardian upon presentation of photo identification. The parent/guardian will be
deemed the Winner for the purposes of these terms and conditions.
21. The Promotion is open to Australian residents; except employees, contractors, agents of
Vicinity Limited or related bodies corporate and their immediate families; tenants of Vicinity Limited centres and their immediate families; the staff of tenants in the centres and their immediate families; the contractors of tenants in the centres and their immediate families; the proprietors and staff of companies involved in the production, publishing and administration of this Promotion and their immediate families and the sponsors of the Promotion and their immediate families. Immediate families means spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) and grandparents. Tenant means lessees, licensees and, in the case of a corporation, includes its directors.
Privacy
22. By partaking in the Promotion, Entrants agree that the Promoter may use information provided on Entry Forms or in connection with claiming a Prize in accordance with Vicinity Centres Privacy Policy, which can be viewed in the Centre Management office. The Vicinity Centres’ Privacy Statement contains information concerning your rights to access and correct the personal information we hold about you and your right to complain about an alleged breach of the Australian Privacy Principles.
23. By entering the Promotion, Entrants provide the Promoter with authority to use their name, likeness, image and/or voice (including any photograph, film, and/or recording of same) in any media at any time or times without remuneration for the purposes of promoting the Promotion, the Centre, the Promoter and/or the Promoter’s (or its related entities) products
or services. Further, Winners agree to participate in all reasonable promotional activities in
relation to the Promotion and the winning of a Prize.
24. Recipes will be the property of the Promoter and can be used and replicated in any way to
further promote the Promotion and Toombul. If you no longer wish for your recipe to be
used, contact Centre Management, Toombul.
25. By participating in the Promotion, each Entrant acknowledges and agrees that the Promoter
collects personal information about Entrants for the purposes of:
a. including Entrants in the Promotion and, where appropriate, awarding Prizes (if the
personal information requested is not provided, the Entrant may not participate in
the Promotion); and
b. enabling the Promoter to use the information to assist the Promoter in improving
goods and services and to contact the Entrant in the future with information on special offers or provide Entrants with marketing materials via any medium including mail, telephone and commercial electronic messages (Short Message Service (SMS), Multimedia Message Service (MMS), Instant Messaging (IM) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners, who may contact the Entrant with special offers in this way. By entering the Promotion, an Entrant agrees that the Promoter may use the Entrant's personal information in this manner. Entrants may opt out by clicking on the “unsubscribe” link in the email or as set out in the SMS/MMS/IM.
Limitation of Liability
26. The Promoter (including its related entities) and its respective officers, employees, contractors and agents shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential economic loss) or for personal injury suffered or sustained, as a result of the Promotion or in connection with a Prize.
27. The warranty on the goods and services obtained as a result of the Promotion remains the sole responsibility of the Supplier.
28. The Promoter assumes no responsibility for:
a. any error, omission, interruption, or delay in the operation or transmission of any
communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet providers, congestion on any carrier networks or otherwise;
b. any theft, destruction or authorised access to, or alteration of such communications; and
c. any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition.
29. The Promoter accepts no responsibility for any tax implications that may arise from a Prize.
30. The Promotion is not valid in conjunction with any other offer.
Reasonable Control
31. If the conduct or operation of the Competition is interfered with or disrupted in any way by any cause outside the reasonable control of the Promoter, the Promoter reserves the right to (subject to any statutory requirements) suspend, modify, recommence or terminate the Competition as appropriate. For the avoidance of doubt, any cause which is outside the reasonable control of the Promoter includes, without limitation, vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, computer viruses or technical failures.
32. Any attempt to cause damage to any website or the information on any website associated with this competition or to otherwise undermine the fair and legitimate operation of this competition may be a violation of criminal and civil laws. The Promoter reserves the right to seek damages from the offender to the fullest extent permitted by law.
Intellectual property
33. By entering the Competition, each Entrant grants to the Promoter or its related entities, a world-wide, irrevocable, non-exclusive, transferable, royalty free and sub-licensable right to use, reproduce, modify, adapt, publish or display (in whole or in part) any intellectual property contained in the content of each entry, without compensation. Each entrant agrees not to assert any moral rights in relation to such use and warrants that they have full authority to grant such rights.
Severability
34. Any provision of these terms and conditions which is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction to the extent of the prohibition of unenforceability. That does not invalidate the remaining provisions of these terms and conditions nor affect the validity of the provision in any other jurisdiction.
