Promotional Period
1. Promotion commences on 16/11/2015. Entries close 11.59pm 25/12/15 (“Promotional Period”).
Entry Requirements
2. The Promoter is Canterbury League Club Limited (ABN 84 000 191 248) of 26 Bridge Road,
Belmore NSW 2192. Telephone (02) 9704 7777
3. Entry is only open to Australian residents 18 years and over. The following persons (and their
immediate families) are not eligible to participate in or win the promotion.
 Club Directors or auditors;
 Club employees;
 Officers, executives or any staff of suppliers or contractors to the club, who are directly
involved in any aspect of the promotion;
 Persons whose usual place of work is within premises owned or leased by the Club who
are employed by any of the contractors, licensees or lessees of the Club and;
 Persons employed by any other supplier or contractor of the Club who at or about the time
of a particular draw, or during the entry period for the promotion, are on the clubs
premises in that capacity such as an employee.
 Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child
or step-child (whether natural or by adoption), parent, step-parent, grandparent, stepgrandparent,
uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st
cousin.
4. To be eligible to enter, individuals must take a photograph of themselves with family and or friends
at Canterbury League Club during the promotional period.
5. To enter, individuals need to;
 Follow @canterburyleaguesclub on Instagram
 Post your favourite pic of you at Canterbury during the promotional period and use the
hash tag #christmasatcanterbury and tag @canterburyleaguesclub. Each entry will be
individually judged based on the depiction of your Christmas spirit at Canterbury League
Club
Prize Details
6. The judging will take place at 12.00pm 29/12/15 at Canterbury League Club, 26 Bridge Rd,
Belmore NSW 2192. The winner will be notified on Instagram and Facebook. This is a game of
skill and chance plays no part in determining the winner. The Promoter’s decision is final and no
correspondence will be entered into.
7. The photograph judged the winner will receive a $200 Canterbury Gift Card, the photograph
judged as the first runner up will receive a $100 Canterbury Gift Card and the photograph judged
as the second runner up will receive a $50 Canterbury Gift Card.
8. The winners will be notified via Instagram and their name will be published at
www.facebook.com/canterburyleaguesclub on 29/12/15.
General
9. Before submitting photographs. Participants must ensure that:
 The Photograph is original – in other words, the work of the Participant is exclusively the work
of the author, nobody else has worked on it and he/she is the owner of all the copyright in the
Photograph;
 In the event that any Photograph presents an individual, the participant must have obtained
permission from the individual for use in the Competition;
 The Photograph specifically relates to Canterbury League Club;
 The Photograph does not contain any element whatsoever that might infringe a third party’s
right in any way, for example another work of art;
 The Photograph does not in any way reflect negatively on anyone’s image or reputation;
 The Photograph is not in any way violent or pornographic, and will not, in any way whatsoever
harm the dignity or any other rights of any third party;
 And, overall, the Photograph does not to their knowledge contravene current legislation;
 The Photographs must be published on “Instagram” and include the hash tag
:#christmasatcanterbury and tag @canterburyleaguesclub
 Your profile must be set to public for Canterbury to see your entry
10. By entering the Competition, participants expressly acknowledge that the Competition is in no way
sponsored, endorsed or administered by, or associated with Instagram or any other social
networks.
11. Participants need to use the Instagram smartphone application to participate. Canterbury League
Club will moderate entries.
12. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including
an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an
entry that is not in accordance with these Terms and Conditions or who tampers with the entry
process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a
waiver of those rights.
13. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole
discretion, to determine the identity of the entrant.
14. All entries submitted become the property of the Promoter.
15. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the
event they are a winner (including photograph, film and/or recording of the same) in any media for
an unlimited period without remuneration for the purpose of promoting this competition (including
any outcome), and promoting any products manufactured, distributed and/or supplied by the
Promoter.
16. The Promoter collects personal information in order to conduct the Promotion and may, for this
purpose, disclose such information to third parties, including but not limited to agents, contractors,
service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is
conditional on providing this information. The Promoter may, for an indefinite period, unless
otherwise advised, use the information for promotional, marketing, publicity, research and profiling
purposes, including sending electronic messages or telephoning the entrant. Entrants should
direct any request to access, update or correct information to the Promoter.
17. If this promotion is interfered with in any way or is not capable of being conducted as reasonably
anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter
reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any
entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
18. Except for any liability that cannot be excluded by law, the Promoter (including their officers,
employees and agents) exclude all liability (including negligence), for any personal injury; or any
loss or damage (including loss of opportunity); whether direct, indirect, special or consequential,
arising in any way out of the Promotion, including, but not limited to, where arising out of the
following: (a) any technical difficulties or equipment, system or computer malfunction (whether or
not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c)
any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after
their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability
incurred by a winner or entrant; or (f) use of a prize.
Proprietary Rights in Content on Instagram
19. Instagram does NOT claim ANY ownership rights in the text, files, images, photos, video, sounds,
musical works, works of authorship, applications, or any other materials (collectively, "Content")
that you post on or through the Instagram Services. By displaying or publishing ("posting") any
Content on or through the Instagram Services, you hereby grant to Instagram a non-exclusive,
fully paid and royalty-free, worldwide, limited license to use, modify, delete from, add to, publicly
perform, publicly display, reproduce and translate such Content, including without limitation
distributing part or all of the Site in any media formats through any media channels, except
Content not shared publicly ("private") will not be distributed outside the Instagram Services.
20. Some of the Instagram Services are supported by advertising revenue and may display
advertisements and promotions, and you hereby agree that Instagram may place such advertising
and promotions on the Instagram Services or on, about, or in conjunction with your Content. The
manner, mode and extent of such advertising and promotions are subject to change without
specific notice to you.
21. You represent and warrant that: (i) you own the Content posted by you on or through the
Instagram Services or otherwise have the right to grant the license set forth in this section, (ii) the
posting and use of your Content on or through the Instagram Services does not violate the privacy
rights, publicity rights, copyrights, contract rights, intellectual property rights or any other rights of
any person, and (iii) the posting of your Content on the Site does not result in a breach of contract
between you and a third party. You agree to pay for all royalties, fees, and any other monies
owing any person by reason of Content you post on or through the Instagram Services.
22. The Instagram Services contain Content of Instagram ("Instagram Content"). Instagram Content is
protected by copyright, trademark, patent, trade secret and other laws, and Instagram owns and
retains all rights in the Instagram Content and the Instagram Services. Instagram hereby grants
you a limited, revocable, nonsublicensable license to reproduce and display the Instagram
Content (excluding any software code) solely for your personal use in connection with viewing the
Site and using the Instagram Services.
23. The Instagram Services contain Content of Users and other Instagram licensors. Except as
provided within this Agreement, you may not copy, modify, translate, publish, broadcast, transmit,
distribute, perform, display, or sell any Content appearing on or through the Instagram Services.
24. Instagram performs technical functions necessary to offer the Instagram Services, including but
not limited to transcoding and/or reformatting Content to allow its use throughout the Instagram
Services.
25. Although the Site and other Instagram Services are normally available, there will be occasions
when the Site or other Instagram Services will be interrupted for scheduled maintenance or
upgrades, for emergency repairs, or due to failure of telecommunications links and equipment that
are beyond the control of Instagram. Also, although Instagram will normally only delete Content
that violates this Agreement, Instagram reserves the right to delete any Content for any reason,
without prior notice. Deleted content may be stored by Instagram in order to comply with certain
legal obligations and is not retrievable without a valid court order. Consequently, Instagram
encourages you to maintain your own backup of your Content. In other words, Instagram is not a
backup service. Instagram will not be liable to you for any modification, suspension, or
discontinuation of the Instagram Services, or the loss of any Content.
