TERMS AND CONDITIONS:

1. The ‘Celebrate Christmas’ Promotion (Promotion) commences at 9:00am Australian Eastern Standard Time (AEST) on Tuesday 24 November 2015 and concludes at 4:00pm (AEST) on Sunday 13 December 2015 (Promotion Period).
2. The Promoter of the Promotion is Vicinity Custodian Pty Ltd ACN 077 870 243 as trustee for VCX Property Management Trust ABN 21 969 875 489 of Toombul Shopping Centre, 1015 Sandgate Road, Toombul Queensland 4012 (Toombul).
3. All entrants will be subject to, and will need to adhere to, the terms and conditions as set out by the Promoter and any future terms and conditions or alterations to these terms and conditions.
The Prizes
1. The total prize pool is valued at $3,110 and consists of:
a. one (1) Christmas catering package valued at $1,610, including delivery to a suburb 10
km radius of Toombul, and one (1) $1,000 Eftpos Gift Card (Major Prize); and
b. one (1) $500 Eftpos Gift Card (Minor Prize).
2. The Major Prize and the Minor Prize are each a Prize, and together the Prizes.
3. The catering package is supplied by Tognini’s Catering (MPT Pty Ltd ABN 75 166 843 983) and
is valid until 24 December 2015.
4. The Eftpos Gift Cards are supplied by Igodirect Group Pty Ltd (trading as Rewards Come True)
ABN 17 110 897 320 and are valid until 31 August 2016.
5. If a Prize is unavailable for whatever reason, the Promoter reserves the right to substitute the Prize for
a Prize of equal or greater value, subject to any applicable statutory requirements.
6. The Prizes are not transferable, refundable or exchangeable for cash or kind and may be subject to
additional terms and conditions.
How to Enter the Promotion
7. To partake in the Promotion and receive an entry form into the draw, entrants must, during the Promotion Period:
a. make a purchase of $20 or more at any store located at Toombul (Purchase);
b. collect an official entry form and present
9. Entry Forms that are not in accordance with these terms and conditions are invalid.
10. Receipt(s) must be original. Copied, faxed, forged, illegible, mutilated or tampered receipts will
not be accepted.
11. Bill payments such as the payment of credit card bills, bank transactions, bank fees and charges and
service bills (such as gas, electricity, rates and phone bills) are not accepted as part of this Promotion.
12. Prescription and EFTPOS receipts are not valid Receipts.
13. Partial lay-by receipts are not valid Receipts. Final lay-by payment receipts are valid Receipts.
14. All participants under the age of 18 must have prior consent from their parent or guardian before entering the Promotion and must be able to provide evidence of such consent on request.
Selection of Winning Entries
15. The Prize draw will occur at 10.00am AEST on Monday 14 December 2015 at Toombul Centre Management located at Level 1 Office Suites, 1015 Sandgate Road, Toombul Queensland 4012.
16. The first eligible entry drawn will be the winner of the Major Prize. The second eligible entry drawn will be the winner of the Minor Prize (each a Winner and together, the Winners).
17. The Winners do not need to be present at the Draw and will be notified by telephone or mail. If a Winner cannot be contacted within three (3) months of the draw, the Winner will no longer be entitled to the Prize and the Promoter may undertake a re-draw at a time and place determined by the Promoter. In such case, the first valid entry drawn in the re-draw will be entitled to the Prize (Replacement Winner). The Replacement Winner is then the Winner for the purposes of these terms and conditions.
18. Any unclaimed Prize draw will take place at the same on Monday 14 March 2016 in order to distribute any unclaimed Prize in the Promotion. Winner(s) in any unclaimed prize draw will be notified by telephone or mail.
19. Proof of identity will be required to collect any Prize.
20. If the Winner is under 18 years of age, the Prize will be awarded to the Winner’s nominated
parent/guardian upon presentation of photo identification. The parent/guardian shall be deemed the Winner (or Replacement Winner as the case may be) for the purposes of these terms and conditions.
21. Any decision made by Toombul Centre Management in respect of the Promotion is final and binding and no correspondence shall be entered into.
General Conditions of Entry
22. The Promotion is open to all persons except employees, contractors, agents of Toombul, sponsors of the Promotion and their immediate families; employees of Vicinity Limited or related body corporate and their immediate families; tenants in Toombul and their immediate families; the staff of tenants in the centre and their immediate families; the contractors of tenants in the centre and their immediate families; the proprietors and staff of companies involved in the production, publishing and administration of this Promotion and their immediate families. Immediate families mean spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) and grandparents. Tenant means lessees, licensees and in the case of a corporation, includes their directors.
23. The Promoter accepts no responsibility for any tax implications that may arise from a Prize.
24. No responsibility will be accepted for late, lost, incomplete or misdirected entries. Entries which contain incorrect contact details shall be deemed invalid. The Promoter reserves the right in its sole discretion to disqualify any entrant who the Promoter has reason to believe has breached any of these conditions, or engaged in unlawful or other improper misconduct calculated to jeopardise the fair and
proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other
compensation from such a person are reserved.
25. The Promoter (including its related entities) and its respective officers, employees, contractors and
agents shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential economic loss) or for personal injury suffered or sustained, as a result of the Promotion or in connection with a Prize. The warranty on the goods and services obtained as a result of this Promotion remains the sole responsibility of the supplier of the Prize.
26. This Promotion is not valid in conjunction with any other offer.
Privacy
27. By entering the Promotion, the entrants hereby give Toombul and the Promoter authority to publicly announce the entrant’s name (should they be the Winner) at the time of the draw and at any stage thereafter.
28. By partaking in the Promotion, entrants agree that the Promoter may use information provided on Entry Forms or in connection with claiming any Prize in accordance with Vicinity Centre’s Privacy Policy Collection Statement. A copy of the Privacy Policy Collection Statement will be available for viewing at Centre Management, Toombul.
29. By participating in the Promotion, each entrant acknowledges and agrees that the Promoter collects personal information about entrants for the purposes of:
(a) including entrants in the Promotion and, where appropriate, awarding Prizes; if the personal information requested is not provided, the entrant may not participate in the Promotion; and
(b) enabling the Promoter to use the information assist the Promoter in improving goods and services and to contact entrant in the future with information on special offers or to provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners, who may contact the entrant with special offers in this way. By entering the promotion, an entrant agrees that the Promoter may use entrant’s personal information in this manner.
