“WIN THE NEW MINETAN SUMMER COLLECTION” PROMOTION
CONDITIONS OF ENTRY

    By entering this Promotion, Entrants agree to abide by these Conditions of Entry. The Promoter is Marque of Brands Pty Ltd, ABN 65 147 537 513, 158 Christmas Street, Fairfield VIC 3078, ph: 1300 819 331.
    The Promotion commences at 11:00am AEDT on 29 October 2015 and closes at 17.00pm AEDT on 17 December 2015 (Promotion Period).
    Entry is open to any Australian resident aged 13 years or older (Entrant). Employees and their immediate families of the Promoter, related companies of the Promoter and agencies associated with the promotion and their related companies are ineligible to enter.
    To enter the Promotion, Entrants must accurately complete an online entry form at www.winwithminetan.com.au/collection which includes selecting whether they are a “Retail Consumer” or a “Salon Professional”, sign up to receive the Marque of Brands and Mine Tan email newsletters and submit it so that it is received during the Promotion Period (Entry).
    Entrants may only enter the Promotion once during the Promotion Period. Incomplete, indecipherable or inaccurate Entries will be deemed invalid. Entries are deemed to be received at the time of receipt into the Promotion database. The Promoter is not responsible for any delay in, or failure of, transmission which causes an Entry not to be received within the Promotion Period.
    On the entry form Entrants have the option to obtain an extra entry into the draw by referring a friend, up to a maximum of 3 entries. Entrants will need to enter the names and email addresses of up to 3 friends to obtain the additional entries.  Extra entries will only be valid for referrals made via the entry form. Before referring friends, the entrant must first ensure they have the consent of the friend/s prior to nominating them to receive the details of the promotion. On the Thank You Page (www.winwithminetan.com.au/collection/thanks) Entrants have the option to obtain an extra entry into the draw by “sharing” the Competition on their Facebook page by clicking the “Share on Facebook” button.
    By accepting the terms and conditions upon entering the promotion you are automatically entered into the Marque of Brands and MineTan email database.
    The total Prize Pool is valued at $765.93. There are two (2) Prizes in total – 1 x Retail Consumer Prize and 1 x Salon Professional Prize. The Retail Consumer Prize is valued at $319.93 and includes 1 x MineTan MyMoroccan Foam (RRP $29.99), 1 x MineTan Coconut Foam (RRP $29.99), 1 x MineTan Classic Caramel Foam (RRP $27.99), 1 x MineTan Absolute Foam (RRP $32.99), 1 x MineTan Instant Tan Foam (RRP $19.99), 1 x MineTan Tan Contour Enhancer (RRP $16.99), 1 x Bronze On Application Mitt – 2 for 1 Pack (RRP $12.99) and 1 x MineTan Bronze Babe Kit (RRP $149.00). The Salon Professional Prize is valued at $446.00 and includes 1 x MineTan Caramel Classic 1L Solution (RRP $99.00), 1 x MineTan Coconut 1L Solution (RRP $99.00), 1 x MineTan My Moroccan 1L Solution (RRP $99.00) and 1 x MineTan Bronze Babe Kit (RRP $149.00). Prizes are not transferable or exchangeable, and cannot be taken as cash. The Winner will need to take their holiday within 12 months of being contacted as a Winner.
    The Prize Draw will be conducted at 11.00am AEDT 18 December 2015 at 3/145 William St, Darlinghurst NSW 2010. The Retail Consumer Prize Winner will be the first valid Entry drawn from the Retail Consumer pool of entries. The Salon Professional Prize Winner will be the first valid Entry drawn from the Salon Professional pool of entries.
    The Winners will be notified by telephone within five (5) business days of the Prize Draw, will receive written confirmation within twenty-one days and their names will be published on the Mine Tan Body Skin Facebook Page (www.facebook.com/minetanbodyskin) on 19 December 2015. In their written confirmation, winners will be provided with details of how to claim their Prize and the date by which they must claim their Prize (Prize Claim Date). Winners may need to provide sufficient identification in order to claim their Prize.
    If the Prize is unclaimed by the Prize Claim Date, subject to any directions from a regulatory authority, the Promoter may conduct a further draw on 31 March 2016 at the same time and location as the Prize Draw, in order to distribute the unclaimed Prize (Unclaimed Prize Draw). In the case of a winner, they will be notified by telephone within two days of the Unclaimed Prize Draw, receive written confirmation within twenty-one days and their names will be published on Mine Tan Body Skin Facebook Page (www.facebook.com/minetanbodyskin) on 1 April 2016.
    The Promoter’s decision is final and binding and no correspondence will be entered into. The Promoter reserves the right, at any time, to verify the validity of Entries and Entrants and to disqualify any Entrant who submits an Entry that is not in accordance with these Conditions of Entry or who tampers with the Entry process including the use of any form of automated entry device or software.
    The Promoter is not liable for any loss, damage or personal injury suffered or sustained as a result of, in connection with, or arising out of the Promotion or taking the Prize.
    If for any reason the Promotion is not capable of running as planned, including but not limited to fraud or causes beyond the control of the Promoter or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in their sole discretion to cancel, terminate, modify or suspend the Promotion, subject to any directions from a regulatory authority.
    This Promotion is not sponsored, endorsed, administered by or associated with Facebook. You understand that you are providing your information to Marque of Brands Pty Ltd, not to Facebook.
    In order to conduct this Promotion, the Promoter needs to collect personal information about each entrant and may for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, gift suppliers and regulatory authorities. Participation in the Promotion is conditional on providing this information. It is a condition of entry that the entrant agrees to being entered into the Marque of Brands Pty Ltd database. The Promoter and Marque of Brands Pty Ltd may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant and for such other purposes as set out  in the Marque of Brands Pty Ltd Privacy Policy. Entrants should direct any request to access, update or correct information to the Promoter. All personal details of entrants will be stored at the office of the Promoter. Upon the entrant’s request; all information provided will be removed from our active database. To request details to be removed, please write to The Marketing Manager, Marque of Brands Pty Ltd, 158 Christmas Street, Fairfield VIC 3078. Information will be removed as soon as reasonably possible in accordance with our Privacy Policy and applicable laws.     The collection, use and disclosure of personal information in connection with the Promotion is governed by the Privacy Act 1988 (Cth). By entering the Promotion, Entrants agree and consent to the Promoter:
    i.    using and disclosing the Entrant’s personal information for the purposes of conducting the Promotion, redeeming the Prizes and any other matter connected to or incidental to the Promotion;
    ii.    using the Entrant’s personal information for the purposes of carrying out marketing, planning, product development and promotional campaigns, in any media including email and SMS, unless an Entrant otherwise withdraws their consent to the use of their information in this manner; and
    iii.    using the Entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion and for any other purpose at the Promoter’s sole discretion.
