3.Acceptance of the My Dan Murphy's program membership terms and conditions and participation in the My Dan Murphy's competitions constitutes acceptance of these Terms and Conditions and any Competition Details.


4.Entry is open to validly registered My Dan Murphy's members who are over the age of 18 and are residents of Australia (“Eligible Entrant”).


5.Employees and their immediate families living in the same household as the employee of Woolworths Limited and its related entities, printers, suppliers, providers and agencies involved in this competition are ineligible to enter.


6.Definitions within these Terms and Conditions:

7.This Promotion (the "Promotion") starts 07:00am AEDT Friday 1 January 2016 and ends at 11:59pm AEDT Sunday 31 January 2016.


8.To enter, an Eligible Entrant must make a Qualifying Purchase either at a Dan Murphy's store or online at www.danmurphys.com.au and present their My Dan Murphy's membership card or enter their My Dan Murphy's membership number at the time of purchase during the Promotional Period ("Eligible Purchase").


9.Eligible Entrants will receive one (1) entry per calendar day irrespective of all the Eligible Purchases made on that day.


10.Eligible Entrants may also receive bonus entries into the Promotion. To receive bonus entries, an Eligible Entrant must purchase Somersby Apple Cider 330ml, Somersby Pear Cider 330ml, Somersby Blackberry Cider 330ml, Somersby Double Press Premium Dry Cider 330ml, Somersby Apple Cider Cans 10 pack 375ml or Somersby Pear Cider Cans 10 pack 375ml ("Product Purchase") either at a Dan Murphy's store or online at www.danmurphys.com.au and present their My Dan Murphy’s membership card or enter their My Dan Murphy’s membership number at the time of purchase during the Promotional Period. 11.For the avoidance of doubt, if an Eligible Entrant makes a Qualifying Purchase as the first transaction of the day and subsequently makes a Product Purchase in the same day, the Eligible Entrant will only receive 1 entry into the competition. 13.Prizes are the recommended retail value as provided by the supplier and are correct at the time of printing.


14.The major prize must be taken and flight booked for travel between February 2016 and until the end of October 2016 (subject to any blackout periods). All bookings must be made a minimum of 45 days in advance of requested departure dates.


15.All components of the prize must be taken together and when offered. Any element of the prize not taken at the time offered will be forfeited and will not be redeemable for cash. Prize cannot be sold and cannot be redeemed for cash.


16.Redemption of the Prize is subject to availability and may be dependent on travel class availability, specific room category availability, any applicable prize supplier or Promoter representative availability, and any travel 'blackout' periods applying (including 20 June 2016 to 10 August 2016 and any school holidays, public holidays and special event periods).


17.Use of a Prize and any tickets, passes or vouchers issued as part of the Prize may be subject to prevailing prize supplier terms and conditions of use. A Prize cannot be used in conjunction with travel discounts or special offers.


18.Redemption of Flight Centre vouchers is subject to the following additional terms and conditions:


1.Gift Cards are redeemable at participating Flight Centre Travel Group (FCTG) retail stores located within Australia.


2.Unless otherwise stated on the Gift Card, Gift Cards are valid for use within 12 months from the date of issue.


3.Gift Cards may only be applied up to the maximum value loaded onto the Gift Card which is unspent at the time of use. Where the cost of purchase exceeds the available balance of the Gift Card, the excess amount must be paid by another payment method.


4.Gift Cards may be redeemed in whole or part during the validity period. Where used in part, no change will be given. Any unused balance may be used against future purchases, but will not be refunded or credited when the Gift Card expires.


5.Gift Cards cannot be reloaded.


6.Gift Cards may not be redeemed or exchanged for cash, traveller's cheques, cash passports or any other form of currency.


7.You are responsible for the use and security of your Gift Card. Lost or stolen Gift Cards may not be replaced or refunded. You are liable for all transactions on your Gift Card except those caused by fraud or negligence by FCTG or its employees.


8.Defaced, mutilated or altered Gift Cards may not be accepted, replaced or refunded.


9.Gift Cards may not be used for payment of credit or retailer accounts.


10.Personal information collected in relation to your Gift Card will be handled in accordance with FCTG’s Privacy Policy which is available at www.flightcentre.com.au or in store.


11.The laws of Australia apply to these terms and conditions and any disputes arising in relation to them.

19.The Promoter accepts no responsibility for any tax implications that may arise from the award of a prize. Independent financial advice should be sought by entrants.


20.The winner's travel companion/s must be over the age of 18. The Promoter reserves the right to request a winner's travel companions (if any) to produce within the requested time appropriate photo identification or other documentation (to the Promoter's satisfaction, in its sole discretion) in order to confirm the travel companion's identity and age before issuing a prize.


21.The Winner and their companion/s are solely responsible for any travel insurance, medical and/or any other similar insurance cover required either for the trip or for personal injury associated with participation in activities and expenses not listed in these Terms and Conditions of entry. The Winner may extend their stay at their own expense.


22.The Promoter is not responsible for cancellation, delays or changes to flights or any part of the prize or for the inability of a prize winner to take up any part of the prize due to problems with flights, travel or other factor outside the Promoter's control.


23.Subject to the approval process required by any relevant gaming or lotteries authority, in the event that a prize item is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion and/or if necessary, to provide an alternative prize or prizes to the same value as an original prize(s), subject to regulatory approval.


24.The winner (and their companion/s) is responsible for all other expenses including spending money over what is stated, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.


25.The winner and their travelling companion/s must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to the airport in their nearest capital city for flight departure.


26.To the full extent permitted by the law neither the Promoter nor any of their associated agencies accepts any liability for any injury, damages, expenses or loss whatsoever (whether direct or consequential) to persons or property arising from or in connection with this offer.


27.It is the traveller's personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s.


28.Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.


29.A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.


30.The prize draw will take place at Red Jelly, 34-36 Elizabeth Street, Hobart TAS 7000 on 12pm (noon) AEDT on Friday 12 February 2016.


31.The first eleven (11) valid entries randomly drawn will be the winners. The prize winners will be contacted in writing (by email) and the winners' details will be published online at www.mydanmurphys.com.au and each winner's first initial, surname, suburb or city of residence and State of residence in the Public Notices section of The Australian newspaper on Friday 19 February 2016. If the winning entry is invalid, that entry will be discarded and the prize will be awarded by randomly drawing another entry in accordance with these Terms & Conditions of Entry.


32.In the event that there is a dispute concerning the competition, the judge's decision is final and no correspondence will be entered into.


33.In the event that for any reason whatsoever a winner does not claim or redeem the prize, the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize. The Promoter, after allowing reasonable and fair time and having pursued all reasonable endeavours, may conduct such further draws at the same place as the original draw as may be necessary to distribute the prize in the draw which is unclaimed subject to any written direction given under state regulations.


34.The unclaimed prize draw will take place at 12pm (noon) AEDST on Friday 13 May 2016 at Red Jelly, 34 – 36 Elizabeth Street, Hobart, 7000. In the case of an unclaimed prize draw the winner will be notified by phone, in writing and on www.mydanmurphys.com.au by Friday 20 May 2016 and published in The Australian on Friday 27 May 2016.


35.Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the competition and all entries of an entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid.


36.The Promoter reserves the right to request the entrant to produce within the requested time appropriate photo identification or other documentation (to the Promoter's satisfaction, in its sole discretion) in order to confirm the entrant's identity, age, residential address, eligibility to enter and claim a prize, and any information submitted by the entrant in entering the competition, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter or an entrant or entry has not been verified or validated to the Promoter's satisfaction then all the entries of that entrant will be ineligible and deemed invalid.


37.If the Promoter forms the view in its sole discretion that an entry or the entry process for any entrant has been tampered with or otherwise does not comply with these rules or the My Dan Murphy's program terms and conditions, the Promoter reserves the right in its sole discretion to disqualify that entry.


38.If for any reason the Promoter determines in good faith and its sole discretion that this competition is not capable of running as planned due to any agent or event beyond the control of the Promoter, which might corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition or which may change the intended result or prevent or hinder its determination, the Promoter may in its absolute discretion cancel the competition at any time and recommence it on similar terms and conditions when and as determined by the Promoter.


39.All entries become the property of the Promoter and entries will not be returned. 40.If you enter this competition, the Promoter will collect personal information about you so that you can participate in the competition and the Promoter can administer the competition. The Promoter may use any Personal Information that an entrant has provided to it as part of the competition for the purpose of running the competition and also in advertisements, publications, media statements and other promotional material associated with the competition. To do this, the Promoter may disclose your personal information to its related bodies corporate and organisations to which the Promoter outsources functions, and organisations associated with this competition.


41.If you are a winner, the Promoter will disclose your first initial, surname and suburb or city of residence and State of residence to the media, who will publish these details. If you do not provide your personal information, you cannot participate in the competition. 42.As a condition of entering this Promotion, an entrant consents to, in the event they are a winner, the Promoter using their (and their guest(s)' if applicable) name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The entrant agrees that, in the event they are a winner, they will participate in all reasonable promotional activities in relation to the Promotion as requested by the Promoter and its agents.

44.If you have opted-in to marketing communications as part of the membership of the My Dan Murphy’s program, the Promoter may use the entrant's name and email address for future marketing communications. If an entrant no longer consents to their details being used for future marketing communications, the entrant should contact the Promoter at the address below or by email at privacy@woolworths.com.au. If the entrant no longer wishes to receive marketing emails, the entrant may make use of the ‘Unsubscribe’ feature included in all marketing emails at any time.
