Terms and Conditions of Entry for the "Swann Insurance – Get a Quote, Win a Honda Motorcycle” Promotion (Promotion) 
Information on how to enter and prize information form part of these conditions of entry (“Conditions of Entry”). 
The Promoter is Swann Insurance (Aust.) Pty Ltd (ABN 80 000 886 680) of 414 Latrobe Street, Melbourne, VIC 3000 (“Promoter”). 
Entry into the Promotion is deemed to constitute acceptance of these Conditions of Entry.
 
An entrant is responsible for ensuring their familiarity with the Conditions of Entry at the time of participation. The Promoter’s decision not to enforce a specific restriction (whether communicated to an entrant or not) does not constitute a waiver of an entitlement to enforce that restriction or of the Conditions of Entry in general.
 
All entrants acknowledge that the Promoter can rely on these Conditions of Entry even if the Promoter only learns of an entrant’s ineligibility after the Promoter has awarded the prize. Return of the prize or payment of its equivalent value to the Promoter may be required by the Promoter in this scenario.
 
The Promoter’s decision in relation to any aspect of these Conditions of Entry and the Promotion is final and binding on each entrant. No correspondence will be entered into.
  PROMOTION PERIOD 
The Promotion will commence at 00:01 AEDT on 26/02/2016 and conclude at 23:59 AEDT on 31/03/2016 (“Promotion Period”).  WHO CAN ENTER
Entry in the Promotion is only open to Australian residents 18 years and over, excluding:
management, employees, directors and contractors of the Promoter, its related entities and other  agencies, firms or companies associated with the Promotion (including suppliers of the prize);
a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 8(a) of these Conditions of Entry;
persons who have breached the terms and conditions of any prior promotion run by or on behalf of the Promoter,
         (“Entrant”). The Promoter is responsible for determining whether a person is an Entrant in its absolute discretion.        HOW TO ENTER 
To receive one (1) entry in the prize draw and be eligible to win, Entrants must, during the Promotion Period:
visit  www.swanninsurance.com.au (“Swann Insurance Website”) or call 13 RIDE (13 7433);
follow the links/prompts to obtain an obligation free quote for motorcycle insurance; 
complete and submit the online insurance quote form or provide the relevant information to the call centre representative (as the case may be), including a response to all requested details, and agree to be contacted by the Promoter with future promotional and marketing materials (however, you may, at any point, revoke such consent); and
retain, and if requested produce, a copy of the email which is automatically generated after submitting a quote application,  (“Eligible Entry”).
Entrants may submit a limit of one (1) Eligible Entry in the Promotion.
The Promoter is not responsible for any technical difficulties encountered in accessing the Swann Insurance Website. Any costs associated with accessing the Swann Insurance Website are the Entrant’s responsibility and are dependent on the internet service provider used.
 
The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter the Promotion repeatedly is prohibited and will render entries submitted using such means as invalid.
Eligible Entries are deemed to be received at the time of receipt into the Promoter's database, not time of transmission by the Entrant. VERIFICATION
If requested by the Promoter, Entrants must produce, within the time stipulated by the Promoter, their emailed quote and appropriate photo identification or other documentation required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim the prize, and compliance with these Conditions of Entry.
If the items required by the Promoter are not received or an Entrant has not verified to the satisfaction of the Promoter within the time period stipulated by the Promoter, the entry submitted by the Entrant will be deemed invalid.
The prize will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction. In the event that the Entrant cannot provide suitable validation or verification, the Entrant will forfeit the prize and no substitute will be offered.
All costs associated with or arising in connection with the receipt of the prize are the responsibility of the prize winner.
Entrants can only enter the Promotion in their own name. Entrants who enter using multiple aliases (e.g. multiple names, addresses and/or email addresses) will be disqualified.
            PRIZE DRAW AND PRIZE INFORMATION 
A random electronic prize draw will be conducted by a representative of the Promoter at Prime Focus, Level 1, 500 Chapel Street, South Yarra, VIC 3141 (“Draw Location”) at 12 noon AEST on 04/04/2016 (“Prize Draw”). Entrants will not need to be present at the Prize Draw. 
The first Entrant with an Eligible Entry drawn in the Prize Draw will, subject to any validation and verification requirements stipulated by the Promoter being met, win a Honda Motorcycle of their choice, but only from the 3 options below, and valued as stated below (including GST and on road costs) (“Prize”).  The Prize winner can choose one (1) of the following Honda Motorcycle models: 
VT1300CX (valued at up to $15,999 including GST and on road costs);
FR800X (valued at up to $15,099 including GST and on road costs); or 
CBR600RR (valued at up to $14,999 including GST and on road costs).
 
The Prize is accompanied by a 2 year manufacturer warranty and the first 12 months of registration (inclusive of compulsory 3rd party insurance). However, the Prize does not include motor vehicle insurance.
The Prize will be delivered to an Authorized Honda dealer (nominated by the Promoter) in the Prize winner’s nearest capital city. If the Prize winner’s principal residence is in Victoria, New South Wales or Queensland, the Prize winner will be able to collect their Prize from the Honda Advanced Rider Training Center (HART) and get a free one-on-one HART tuition. The Prize winner will be responsible for any expenses incurred in connection with the collection of the Prize.   
The Prize winner will be able to select the colour of their Prize, provided such colour is within the individual colour range for their nominated model, and subject to availability at all times.
Any number plate details used in the Promotion materials are for promotional purposes only.
To be eligible to claim the Prize, the Prize winner must provide a copy of their proof of identity, such as a passport, to a representative of Promoter as and when requested. 
The Prize is not transferrable or redeemable for cash.
As a condition of accepting the Prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or Prize provider in their absolute discretion, including but not limited to a legal release and indemnity form. NOTIFICATION OF PRIZE WINNER
The Prize winner will be notified by phone and via email, and will subsequently be posted on the Swann Insurance Website (www.swanninsurance.com.au) from 06/04/2016. RE-DRAW (IF ANY)
If the Prize is undeliverable (i.e. the Prize winner cannot be located), or for whatsoever other reason the Prize cannot be conferred, by 11.00am AEST on 04/07/2016, a random electronic re-draw will be conducted at 12 noon AEST on that date at the Draw Location by a representative of the Promoter from all remaining Eligible Entries received in the Promotion, subject to any directions from the relevant State and Territory Gaming Departments (“Prize Re-Draw”). Entrants will not need to be present at the Prize Re-Draw.  NOTIFICATION OF RE-DRAW WINNER (IF ANY)
The Prize Re-Draw winner (if any) will be notified by phone and via email, and will subsequently be posted on the Swann Insurance website (www.swanninsurance.com.au) from 22/07/2016.  GENERAL
If more than one person attempts to claim the Prize, the Promoter has sole and absolute discretion to determine which of those persons will be the Prize winner.
 
The Promoter shall not be liable for the Prize being lost, stolen, damaged or tampered with in any way before it reaches the Prize winner or after it has been provided to the Prize winner.
 
The Promoter accepts no responsibility for any variation in the value of the Prize from the time of printing Promotion materials.
 
If the Promoter is unable to provide the Prize winner with the Prize, the Promoter reserves the right to supply an alternative prize of similar monetary value to the Prize, subject to any directions given by State and/or Territory Gaming authorities. 
The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period.  No responsibility will be taken for lost, late or misdirected entries. The Promoter does not warrant that the entry mechanisms will be available at all times during the Promotion Period.
 
If, for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs, network failure, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to States and/or Territory gaming regulations, including cancelling, terminating, modifying or suspending the Promotion.
 
Any Entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.
 
The:
  (a)  Promoter, the Promoter's related entities, and all agencies associated with the Promotion; and   (b)   the employees, agents, directors and contractors, of all entities referred to in paragraph 38(a),   shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of the Prize, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law). 
The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of the Prize.     
The Prize winner must, at the Promoter's request, participate in any Promotion activity (such as publicity and photography) relating to the winning of the Prize, free of charge, and they consent to the Promoter using their name and image in any future promotional material.   PERSONAL INFORMATION
Immediately upon submission by an Entrant, their entry becomes the sole property of the Promoter.
All information Entrants provide (“Personal Information”) will be used by the Promoter for the purpose of administering this Promotion and contacting and verifying the winner, as well as providing a quote for motorcycle insurance.     
Should an Entrant's Personal Information change during the Promotion Period, it is the Entrant's responsibility to notify the Promoter by contacting the Promoter using the contact details at http://www.swanninsurance.com.au/webform/contact-swann-insurance 
The Promoter may disclose Entrants' Personal Information to its contractors and agents to assist in conducting this Promotion and as required, to Australian regulatory authorities. MANDATORY OPT-IN FOR MARKETING PURPOSES
By requesting a quote and submitting an Eligible Entry in the Promotion, Entrants understand that the information provided will be entered into a database and may be used by the Promoter, the Promoter's related entities, and agencies engaged by the Promoter, for the Promoter's future promotional and marketing purposes without further reference or compensation to the entrant. 
Entrants may request to update or correct their Personal Information held by the Promoter and/or may request that they not receive further Promotional or marketing communications from the Promoter at any time by contacting the Promoter at Swann.Compliance@swanninsurance.com.au or by electing to ‘opt out’ by using the ‘opt out’ function on any marketing materials received.
