CONDITIONS OF ENTRY
1. Information on how to enter, mechanics of entry and prizes form part of these Conditions
of Entry. Entry into the promotion is deemed acceptance of these Conditions of Entry.
2. Entry is only open to residents of Australia aged 18 years or older (Eligible Entrants).
3. Employees (and their immediate families) of the Promoter, participating retailers and
agencies associated with this Promotion are ineligible to enter. Immediate family means
any of the following: spouse, de-facto spouse, child or step-child (whether natural or by
adoption), parent, step-parent, grandparent, uncle, aunt, niece, nephew, brother, sister,
step-brother, step-sister.
4. The promotion starts at 12:01am (AEDT) on 14/03/2016 and ends at 11:59pm (AEST) on
19/06/2016 (Promotional Period).
5. To enter the promotion, Eligible Entrants must, during the Promotional Period:

a. Retain the neck tag with unique code and store receipt of their Eligible
Purchase (Proof of Purchase); and enter via one of the following methods:

i. SMS: send a text message from their mobile phone in the required
SMS format to 19982222 (SMS cost is 55c Inc. GST per msg sent)
containing (in this order, separated by spaces):

a. Unique Code
b. Last five (5) digits of the Eligible Purchase’s barcode located
on the product packaging
c. Entrant’s full name
d. Entrant’s postcode
e. Store purchase (Coles, Dans, or Others)

and complete the entry form as required.

6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants
(including an entrant’s identity, age and place of residence) and to disqualify any entrant
who submits an entry that is not in accordance with these Terms and Conditions or who
tampers with the entry process. Errors and omissions may be accepted at the Promoter's
discretion. Failure by the Promoter to enforce any of its rights at any stage does not
constitute a waiver of those rights.
7. The SMS entry mechanic is only open to consumers with a SMS compatible mobile
phone connected to a service provider, which permits text messaging to the promotional
SMS number. It is recommended that entrants check with their individual service
provider in this regard. Entries submitted by SMS will be deemed to be received at the
time of receipt by the Promoter and not the time that they were sent by the entrant.
8. The Promoter accepts no responsibility for any late, lost or misdirected SMS entries not
received by the Promoter or delays in the delivery of the SMS message due to technical
disruptions, network congestion or for any other reason. SMS entries via the Internet or
computer generation and not attributable to a valid mobile phone account are invalid and
will not be accepted.
9. Incomplete, indecipherable or illegible entries will be deemed invalid and unrecognised
barcode numbers and or unique codes will deem the entry to be invalid.
10. Each Eligible Purchase will entitle the Entrant to one (1) entry. Multiple entries will be
accepted up to a maximum of five (5) entries per person per day however each entry
must be based on a separate Eligible Purchase, must be submitted separately and must
independently comply with these Conditions of Entry.
11. Entrants must retain a copy of their Proof of Purchase(s) for all entries. Failure to
produce the Proof of Purchase(s) for all entries when requested may, in the absolute
discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and
forfeiture of any right to a prize. A prize will only be awarded following any winner
validation and verification that the Promoter requires in its sole discretion. Prizes will only
be awarded where the Eligible Purchase’s barcode and Unique Code and the Store
Receipt fulfils all of the requirements of the Promoter's verification tests and procedures.

The verification tests and procedures shall be determined by the Promoter in its absolute
discretion.
12. INSTANT WIN PRIZES: There are 50 instant win prizes of $250 Visa gift cards (GST
inclusive) available to be won.
Instant win prizes will be awarded randomly during the
promotional period. The Promoter will deliver the Instant Win Prizes within twenty-eight
(28) days from verification, directly to the winners address provided at the time of
verifying their entry and claiming their prize.
13. Any costs in excess of the (GST inclusive) value of the cash prize and all ancillary costs
associated with redeeming this prize are not included and are the sole responsibility of
the Instant Win Prize winner.
14. Total potential Instant Win Prize pool value is up to $12,500. (Inc. GST).
15. Each Instant Win prize will be randomly allocated at a pre-determined day and time slot
during the Promotional Period, by an electronic drawing system. Entrants who submit a
valid entry on a predetermined day and time slot, or submit a valid entry closest to the
pre-determined day and time slot once it has passed, will be notified by reply SMS or
email (depending on entry method) advising that they are a provisional Instant Winner.
Provisional Instant Winners will be issued a Unique Prize Claim Number as determined
by the Oxygen Interactive Pty Ltd Instant Win system. The Unique Prize Claim Number
must be recorded by the Instant Winner for prize verification purposes. In the event of
any dispute with the Promoter, or at the Promoter’s request, Instant Winners will be
required to correctly quote their Unique Prize Claim Number to be awarded their Instant
Win Prize. The Promoter reserves the right to withhold the awarding of an Instant Win
Prize to a provisional winner who cannot provide a valid Unique Prize Claim Number.
Any Instant Win Prizes awarded to ineligible or invalid entrants will be awarded during a
second chance draw. All instant win prizes will be distributed.
16. Instant Win Prizes must be claimed by 19/09/2016 at 5pm (AEST).
17. MAJOR PRIZE DRAW: There are 3 major prizes. Each major prize is a $20,000 Flight
Centre Voucher. Each eligible entrant who submits an entry into this Promotion in
accordance with these Terms and Conditions will be entered into the Major Prize Draw.
There will be three (3) separate major prize draws, one (1) for each database of entrants
from participating retailers: Coles Liquor Group, Dan Murphy’s, Independent stores. The
three (3) major prize winners will be the first (1) eligible entrants drawn from their
respective store database and who have entered in accordance with the competitions
terms and conditions and can provide the requested proof. Each Major prize winner will
win 1 x $20,000 Flight Centre Voucher.

18. The Major Prize Draw will take place at 11:00am (AEST) on 22/06/2016 at Oxygen
Interactive Marketing, 117 Wellington St, St Kilda VIC 3182. The Major Prize winners will
be contacted by telephone and in writing within two (2) days of the Major Prize Draw and
their details will be published in The Australian on 29/06/2016.
19. The Winners (3) as drawn in the Major Prize Draw must have their entry verified by the
Promoter. The Winner must produce entry validation for all entries into the promotion
inclusive of unique codes and corresponding receipt of purchase clearly stating the
participating products. No other form of verification will be acceptable. If a prize winner
complies with these Terms and Conditions and the Promoter verifies and accepts the

entry in accordance with these Terms and Conditions, the Promoter will deliver the prize
within twenty-eight (28) working days of the prize being won.
20. The first (1) entrant drawn for each database of entrants from participating retailers:
Coles Liquor Group, Dan Murphys, Independents store in the Major Prize Draw will each
receive one Twenty thousand dollars flight centre voucher ($20,000). The Flight Centre
prize valued at $20,000 (Inc. GST) will be paid in full addressed to the Winner’s name as
nominated by the Winner in writing at the time of verifying their entry and claiming their
prize.
21. The Flight Centre voucher will be awarded within twenty-eight (28) working days from
verification and will be handed to the Winner by a Brown Brothers sales representative.
22. Total Major Prize pool value is $60,000 (Inc. GST).
23. Total maximum prize pool value is up to $72,500 (Inc. GST).
24. The Promoter may draw five (5) additional reserve entries from each retailer (Coles
Liquor Group, Dan Murphy’s, Independent stores) in the Major Prize Draw and record
them (in order) in case an invalid entry or ineligible Entrant is drawn. In the event of an
invalid entry or an ineligible Entrant, the Major Prize will be awarded to the first reserve
entry drawn. If the Major Prize cannot be awarded to the Entrant drawn, the Promoter
will continue the process until the Major Prize is awarded. If, after this process, the Major
Prize has still not been awarded or if the Entrant drawn cannot be notified, the Promoter
will hold an Unclaimed Prize Draw in accordance with Condition 25.
25. A draw for any Unclaimed Prizes may take place on 20/09/16 at 11:00am (AEST) at
Oxygen Interactive Marketing, 117 Wellington St, St Kilda VIC 3182 in order to award
any unclaimed prizes by that date, subject to any written directions given by the relevant
authority under applicable State or Territory legislation. In the event of any Winner/s in
the unclaimed prize draw, the Winner/s will be notified in writing within two (2) days of
the draw and the Major Prize Winner’s details will be published in The Australian on
26/09/2016.
26. Prizes are not exchangeable. The Promoter accepts no responsibility for any tax
implications that may arise from prize winnings. Independent financial advice should be
sought. The Promoter accepts no responsibility for any variation in prize value.
27. The Promoter’s decision in relation to any aspect of this Promotion, including the
selection of any Winner and the criteria it applies in determining the Winner, is final and
binding on every entrant. No correspondence will be entered into.
28. The prizes are not transferable or exchangeable. If any prize is unavailable, the
Promoter, in its absolute discretion and subject to written directions from state/territory
regulatory authorities if required, reserves the right to substitute all or any part thereof
with a product or prize to the equal value or to pay the balance of any remaining prizes
as cash in lieu (based on the recommended retail value in Australian dollars of the
remaining prizes and including GST where applicable).
29. Should an Entrant’s contact details change during the Promotion Period, it is the
Entrant's responsibility to notify the Promoter. A request to access or modify any
information provided in an entry should be directed to the Promoter in writing.
30. The Promoter accepts no responsibility for loss or damage to any prize in transit.

31. All values and amounts that appear in these Terms and Conditions are in Australian
Dollars and are inclusive of GST unless expressly stated otherwise.
32. Subject to the unclaimed prize draw clause, if for any reason a Winner does not take a
prize, then the prize will be forfeited.
33. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute
the prize with a prize to the equal value and/or specification, subject to any written
directions from a regulatory authority.
34. Entrants consent to the Promoter using their name, likeness, image and/or voice in the
event they are a Winner (including photograph, film and/or recording of the same) in any
media for an unlimited period without remuneration for the purpose of promoting this
Promotion (including any outcome), and promoting any products manufactured,
distributed and/or supplied by the Promoter.
35. If this Promotion is interfered with in any way or is not capable of being conducted as
reasonably anticipated due to any reason beyond the reasonable control of the
Promoter, including but not limited to technical difficulties, unauthorised intervention or
fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted
by law, subject to any written directions from a regulatory authority (a) to disqualify any
entrant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.
36. The use of any automated entry software or any other mechanical or electronic means
that allows an entrant to automatically enter repeatedly is prohibited and will render all
entries submitted by that entrant invalid.
37. All Instant Win Prizes from the advertised prize pool will be distributed. At the end of the
promotion, all existing valid claims for prizes and entitlements to prizes will be met
notwithstanding the advertised prize pool has been exceeded. Printing errors or other
quality assurance matters outside the control of the individual player will not be used as
the sole basis for refusing to award a prize.
38. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit,
exclude or modify the statutory consumer guarantees as provided under the Competition
and Consumer Act, as well as any other implied warranties under the ASIC Act
or similar consumer protection laws in the States and Territories of Australia (“NonExcludable
Guarantees”).
39. Except for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, the Promoter (including its respective officers, employees and agents) is not
responsible for and excludes all liability (including negligence), for any personal injury; or
any loss or damage (including loss of opportunity); whether direct, indirect, special or
consequential, arising in any way out of: (a) any technical difficulties or equipment
malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised
access or third party interference; (c) any entry or prize claim that is late, lost, altered,
damaged or misdirected (whether or not after their receipt by the Promoter) due to any
reason beyond the reasonable control of the Promoter; (d) any variation in prize value to
that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or
entrant; or (f) use/taking of a prize.
40. The Promoter collects personal information in order to conduct the Promotion and may,
for this purpose, disclose such information to third parties, including but not limited to
agents, contractors, service providers, prize suppliers and, as required, to Australian
regulatory authorities. Entry is conditional on providing this information. If the Entrant has

elected to receive electronic commercial messages from the Promoter, the Promoter
may, for an indefinite period, unless and until otherwise advised by an Entrant to the
contrary (e.g. through the use of an unsubscribe facility), use the Entrant’s personal
information for promotional, marketing, publicity, research, profiling and customer
satisfaction purposes, including sending electronic commercial messages to the Entrant.
Entrants should direct any request to opt out, access, update or correct information to
the Promoter. All entries become the property of the Promoter. A copy of the Promoter’s
Privacy Policy in relation to the treatment of personal information collected is available at
http://www.brownbrothers.com.au/privacy.
41. Entrants can only enter in their own name. Entrants who provide incorrect, misleading or
fraudulent information are ineligible to participate in the promotion and all entries of an
Entrant who is deemed by the Promoter to have provided incorrect, misleading or
fraudulent information may, at the discretion of the Promoter, be deemed invalid. The
Promoter reserves the right to request the Entrant produce (within the requested time)
appropriate photo identification or other documentation (to the Promoter’s satisfaction, at
its sole discretion) in order to confirm the Entrant’s identity, age, residential address,
eligibility to enter and claim a prize, that the Entrant obtained the bill payer’s consent to
enter by SMS before submitting their entry, that the Entrant has a clear relationship with
the end mobile device used to enter via SMS and any information submitted by the
Entrant in entering the promotion, before issuing a prize. If the documentation required
by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or
entry has not been verified or validated to the Promoter’s satisfaction then all the entries
of that Entrant will be ineligible and deemed invalid.
42. The Promoter encourages consumers to enjoy alcohol in moderation. Legal aged
consumers are advised to consider the 'low risk drinking' guideline recommended in the
National Health & Medical Research Council Australian Alcohol Guidelines which states:
for healthy men and women, drinking no more than two (2) standard drinks on any day
reduces your risk of harm from alcohol-related disease or injury over a lifetime. Drinking
no more than four (4) standard drinks on a single occasion reduces the risk of alcoholrelated

Participation in the promotion is subject to relevant liquor legislation in each applicable
State or Territory, including responsible service of alcohol. Consumers are also
