1. Information on how to enter forms part of these terms and conditions. Entry into the Ocean of Fun competition
(Promotion) is deemed to be an acceptance of the following terms and conditions. Entries must comply with these
conditions to be valid.
2. Entry is only open to residents of Australia aged 18 years old or over. Employees of the Promoter and their immediate
families and retailers within Sunshine Plaza (Centre) and the retailers’ employees and their immediate families are
ineligible to enter.
3. The Promotion commences from 9.00am on Thursday 3 November 2016 until 5.30pm on Wednesday 31 November2016
(Promotion Period).
4. For a customer to go into the draw to win a Flight Centre Sunshine Plaza travel voucher valid for use until the 30th of June
2017 for an Ocean View Cabin on a 7 night P&O Cruise for up to four (4) persons up to the value of $3,000, he or she is
required to take a photo at the Ocean Life hoarding, located between the Kmart and ANZ centre entries using the hashtag
#anoceanoffun and tagging @SunshinePlazaOfficial during the Promotion Period. The entrant’s Instagram account must
be set to “Public” in order to participate in this competition. Entries are limited to one entry per person, per day during
the Promotion Period.
5. The first correct and eligible entry drawn will win Flight Centre Sunshine Plaza travel voucher valid for use until the 30th
of June 2017 for an Ocean View Cabin on a 7 night P&O Cruise for up to four (4) persons up to the Value of $3,000.
Separate terms and conditions apply to the travel voucher. Full terms and conditions can be found accompanying the
voucher. The total prize pool is valued at up to $3,000.
6. The draw will take place in the Centre at Sunshine Plaza on Thursday 1 December 2016. The winner will be notified via
reply message on Instagram by Thursday 1 December 2016. The results will be published on the Sunshine Plaza Website
and Facebook Page on Thursday 1 December 2016. The winner must claim their prize by attending the Customer Service
Centre by Wednesday 1 March 2017.
7. The Promoter may conduct such further draws at the same place as the original draw as is necessary at 12.00pm on
Thursday 2 March 2017 in order to distribute any unclaimed prize by that date.
8. The Judge’s decision is final and no correspondence will be entered into.
9. Where requested by the Promoter, the winner must provide evidence which, to the reasonable satisfaction of the
Promoter, demonstrates that he or she is the winner, is eligible to enter and has complied with these terms and
conditions.
10. The prize(s) is/are not redeemable for cash and cannot be transferred or exchanged.
11. All prizes should be claimed and collection in person by the winner at their own cost within three months from the date
of winning (unless otherwise advised). Unless specified otherwise, it is the sole responsibility of winners to collect their
prize. The Promoter will not notify winners of the time remaining.
12. Nothing in these terms and conditions is intended to exclude, restrict or modify rights which you may have under any law
(including the Australian Consumer Law (‘ACL’), and consumer guarantees relating to goods or services under the ACL)
which may not be excluded, restricted or modified by agreement (‘Your Consumer Rights’). Subject to Your Consumer
Rights, the Promoter is not liable for any loss or damage however caused (including by negligence), suffered or incurred
in connection with the Promotion or the prize. Any condition or warranty which would be implied by law into these
terms and conditions is excluded.
13. Lend Lease is the Promotor only. Flight Centre Sunshine Plaza is the supplier of the Flight Centre Sunshine Plaza travel
voucher valid for use until the 30th of June 2017 for an Ocean View Cabin on a 7 night P&O Cruise for up to four (4)
persons up to the value of $3,000. The terms and conditions of Flight Centre apply to the supply of Flight Centre Sunshine
Plaza travel voucher valid for use until the 30th of June 2017 for an Ocean View Cabin on a 7 night P&O Cruise for up to
four 4 persons up to the value of $3,000. Visiting Flight Centre for terms and conditions.
14. As a condition of accepting a prize, the winner, and any other person(s) sharing the prize with the winner, may be
required to sign legal documentation as and in the form required by the Promoter including but not limited to a further
agreement to exclude liability of the Promoter for certain loss, damage or injury arising from the use or participation in
a prize to the extent the prize is or includes a recreational service or activity.
15. The promotion is in no way sponsored, endorsed or administered by Instagram.
16. All entries become the property of the Promoter. As detailed in the privacy statement which accompanies these terms
and conditions, all entries will be entered into a database and the entrants’ names and addresses may be used for future
promotion, marketing and publicity purposes.
17. All prizes are accepted entirely at the risk of the winner, and the Promoter excludes all warranties in connection with any
prize to the extent permitted by law. The Promoter reserves the right to substitute any prize with a prize of equal or
greater value (including where the prize is unavailable) for whatever reason, subject to approval of the gaming
authorities in each State and Territory where required. The prize and/or any element of the prize must be taken as stated
and cannot be varied by the winner. No compensation will be payable if the winner is unable to use their prize and/or any
element of the prize as stated.
18. By entering into the Promotion you accept all conditions of entry including these terms and conditions.
19. Liability and release: The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but
not limited to indirect or consequential loss) or for any personal injury, loss or damage suffered or sustained (even
caused by negligence) in connection with accepting or using a prize or participating in this Promotion, except for any
liability which cannot be excluded by law. The Promoter is not responsible for defective prizes, lost or stolen prizes or
misuse of any prize. All entrants release from, and indemnify the Promoter against, all liability, cost, loss or expense
arising out of acceptance of any prize(s) or participation in this Promotion including (but not limited to) personal injury
and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or
otherwise.
