‘Lights On Christmas’ Competition
Terms and Conditions
General
1. The Lights On Christmas competition (Competition) commences at 9am (AEDT) on
Monday 28 November 2016 and concludes at 8.30pm (AEDT) on Tuesday 13 December
2016 (Competition Period).
2. The Promoter is Vicinity Centres PM Pty Ltd (ABN 96 101 504 045), Melbourne
Corporate Office, 1341 Dandenong Road, Chadstone Vic 3148 (Promoter).
3. By entering the Competition, all entrants (Entrants) are subject to, and must adhere to,
these terms and conditions. Information about prizes and how to enter forms part of
these terms and conditions.
4. Entry into the Competition constitutes the Entrant’s unconditional acceptance of these
terms and conditions.
Prizes
5. The Competition will award four (4) finalists (Finalist Winners); 1 from each of the
following regions: NSW/ACT, VIC, SA/WA, QLD/TAS, and one (1) national winner (Major
Winner) with a prize (each a Prize and together, the Prizes). Finalist Winners and the
Major Winner are together referred to as Winners.
6. Finalist Winners will each win an EFTPOS Card valued at $500 (Finalist Prize) and the
Major Winner will win an EFTPOS Card valued at $3000 (Major Prize). The Prize pool
has a total value of $5000.
7. The Prizes are supplied by Edge Loyalty Systems Pty Ltd ABN 96 138 299 288 (the
Supplier).
8. The Prizes are subject to the terms and conditions of the Supplier, including validity
periods.
9. The Prizes are not transferable, refundable or exchangeable for cash or kind. If a Prize is
unavailable for whatever reason, the Promoter reserves the right to substitute that Prize
for a Prize of equal or greater value, subject to any applicable statutory requirements.
How to Enter
10. To enter the Competition, Entrants must, during the Competition Period:
a. visit addalittlesparkle.com.au or any other website as specified by the Promoter;
b. navigate to the Competition tile (the Competition Entry Page);
c. upload a photo which the Entrant has taken which shows the Entrant's most
creative and festive Christmas light display (Photo);
d. complete all mandatory fields as required on the Competition Entry Page; and
e. agree to the terms and conditions of the Competition and enter the Competition
(completion of steps (a) to (e) constitutes an Entry).
11. Entry is limited to one (1) Entry per eligible person during the Competition Period (each
an Entry and collectively the Entries). Entrants must not enter using multiple aliases.
12. Photos must be the relevant Entrant's original work.
13. The Promoter may copy and amend Entries (including Photos) and may use (or allow
others to use) Entries and any rights in relation to Entries, to publicise this competition or
for any other purpose, including to reproduce, modify, adapt, publish or display (in whole
or in part) any intellectual property contained in the content of their Entry, without royalty,
payment or other compensation. These rights are perpetual, royalty free, world-wide,
non-exclusive, irrevocable, sub-licensable and transferable. For example, the Promoter
may publish all or any part of an Entry or any amended version of it. Each Entrant
agrees not to assert any moral rights in relation to such use and warrants that they have
full authority to grant such rights. The Promoter may also decide not to publish an Entry,
to cease publication of an Entry, or to publish an edited Entry.
14. Each Entrant warrants that their Entry and Photo does not breach any third party rights
(for example, intellectual property rights) and its use by the Promoter or any other person
will not breach such rights nor otherwise breach any law (for example, it is not
defamatory, in contempt of court or in breach of any privacy law). Entries and Photos
must not be obscene, offensive, malicious, discriminatory, indecent or (in the Promoter's
opinion) otherwise objectionable or inappropriate (for example it must not include nudity
or language the Promoter deems offensive).
15. Entrants must not include any person in their Photo unless that person has consented to
the Entrant submitting it in this Competition. Entrants must not include any person in
their Photo who is under the age of 18 years unless the Entrant has the consent of that
person's parent or guardian and, if the person is aged 13 or above, that person's
consent.
16. Entrants must ensure their Entry does not contain any virus, malware or other malicious
or inappropriate computer code or material.
17. Entries must be received during the Competition Period. Entries are deemed to be
received at the time they are received by the Promoter (and not at the time the Entrant
submits the Entry).
18. Entry into the Competition is free.
19. The Finalist Winners and the Major Winner must take part in all publicity, photography
and other promotional activity as the Promoter requires, without any compensation. The
Finalist Winners and the Major Winner consent to the Promoter using their name/s and
image/s in any promotional or advertising activity.
Winners and Prizes
20. One Major Winner and four Finalist Winners will be selected on Thursday 15 December
2016 at Vicinity Centre NSW Office, MLC Centre, 19 Martin Place, Sydney NSW 2000.
21. The Competition is a game of skill, and chance plays no part in determining the Winners.
All valid Entries will be judged based on the most interesting, original and creative Photo
to determine Winners.
22. The best valid Entry received overall in the Competition will win the Major Prize. Then,
the best valid Entry received in each of the following four (4) regions will win a Finalist
Prize: NSW/ACT, VIC, SA/WA, QLD/TAS. The Major Prize Winner is not eligible for a
Finalist Prize. All judging decisions are as determined by the judging panel in their
absolute discretion.
23. The Winners will be notified that they are a Winner via email or phone by 5pm (AEDT) on
Friday 16 December 2016 and must respond as directed by 9am (AEDT) on Tuesday 20
December 2016 to claim their Prize.
24. If any Winner does not respond to the Promoter as directed by 9am (AEDT) on Tuesday
20 December 2016 to claim their Prize, that Winner will no longer be entitled to the Prize
and the Promoter, subject to any statutory requirements, reserves the right to select an
alternative Winner for that Prize (Replacement Winner) on the basis set out in clause 22
on Tuesday 20 December 2016. The Replacement Winner is then the Winner of the
relevant Prize for the purposes of these terms and conditions. If the Entrant who won the
Major Prize does not claim their Prize and is deemed invalid, the Promoter will firstly
judge all 4 Finalist Prize winning Entries in order to determine the new Major Prize
Winner (and this Major Prize Winner will receive only the Major Prize, not the Finalist
Prize). Then, the Promoter will re-award the relevant Finalist Prize to the next best Entry
received in the original Winner's region. Any Replacement Winner/s will be notified via
email or phone immediately after determination. If a Replacement Winner does not claim
their Prize by the time specified by the Promoter, the Promoter may (in its absolute
discretion) retain the Prize and is under no obligation to find a further alternative winner.
25. The Promoter will use reasonable endeavours to arrange a time with the Winners to pick
up their Prizes from a mutually convenient Vicinity Centre at times and on days mutually
convenient to the Promoter and each Winner. Proof of identity will be required to claim
any Prizes.
26. All costs, associated with collecting any Prizes (including, but not limited to travel and
parking costs) are the sole responsibility of the Winners and will not, under any
circumstances, be compensated by the Promoter.
27. If a Winner is aged under 18 years of age, the relevant Prize will be awarded to the
Winner’s nominated parent/guardian upon presentation of photo identification. The
parent/guardian shall be deemed the Winner for the purposes of these terms and
conditions.
Compliance with terms and conditions
28. All Entries must conform with all of these terms and conditions. No responsibility will be
accepted for late, non-conforming, lost, incomplete or misdirected Entries. Entries or
Entrants that are deemed to breach these terms and conditions (as determined by the
Promoter) may be deemed invalid, at the Promoter's discretion.
29. The Promoter reserves the right in its sole discretion to disqualify any Entrant who the
Promoter has reason to believe has breached any of these terms and conditions, or who
has:
a. tampered with the entry process;
b. engaged in any conduct to jeopardise the fair and proper conduct of the
Competition;
c. acted in a disruptive, annoying, threatening, abusive or harassing manner;
d. done anything to diminish the good name or reputation of the Promoter or any of
its related entities or of the agencies or companies associated with this
competition;
e. breached any law;
f. engaged in plagiarism or defamation; or
g. behaved in a way that is otherwise inappropriate.
The Promoter’s legal rights to recover damages or other compensation from such a
person are reserved.
30. Any attempt to cause damage to any website or the information on any website
associated with this Competition or to otherwise undermine the fair and legitimate
operation of this Competition may be a violation of criminal and civil laws. The Promoter
reserves the right to seek damages from the offender to the fullest extent permitted by
law in the event that any such attempt is made, whether or not that attempt results in any
such damage.
31. Any decision made the Promoter in respect of the Competition is final and binding and no
correspondence will be entered into.
Eligibility
32. Without limiting clause 33, the Competition is open to persons aged 13 years or older
residing in Australia. All Entrants under 18 years of age must have prior consent from a
parent or guardian before entering the Competition and must be able to provide evidence
of such consent on request.
33. The Competition is not open to directors, officers, management, contractors and
employees of:
a. the Promoter;
b. the agencies or companies associated with the Competition or the Promoter; or
c. the retail stores located at the Promoter's shopping centres,
and the immediate families of those people. Immediate families means spouse, defacto
spouse, parent, child or sibling (whether natural or by adoption) and grandparents. For
the avoidance of doubt, lessees, licensees and, in the case of a corporation, directors of
retail stores located at any of the Promoter's shopping centres, cannot enter.
34. The Promoter reserves the right to verify the validity of Entries submitted to the
Competition. The Promoter may request any document which establishes an Entrant’s
eligibility to enter to the Competition including, without limitation, an Entrant’s identity,
age and place of residence. Failure by the Promoter to enforce any of its rights at any
stage does not waive those rights.
Limitation of Liability
35. Nothing in these terms and conditions restricts, excludes or modifies any consumer
rights under any statute including the Competition and Consumer Act 2010 (Cth).
36. Subject to the previous clause, the Promoter (including its related entities) and its
respective officers, employees, contractors and agents shall not be liable (including in
negligence) for any loss, expense, damage or liability whatsoever which is suffered or
incurred (including, but not limited to, indirect or consequential economic loss) or for
personal injury, illness or death suffered or sustained, as a result of the Competition or in
connection with any Prize, including any loss, expense, damage or liability arising as a
result of (but not limited to):
a. any late, lost, incomplete, incorrectly submitted, delayed, illegible or misdirected
Entry;
b. any technical difficulties or equipment malfunction;
c. any theft, unauthorised access or interference by another person;
d. use of, or taking of, a Prize; or
e. participation in the Competition,
except for any liability which under statute cannot be excluded (in which case that
liability is limited to the greatest extent allowed by law).
37. The Promoter assumes no responsibility for:
a. any error, omission, interruption, or delay in the operation or transmission of any
communication sent to (or by) the Promoter or any entrant whether caused by
problems with communication networks or lines, computer systems, software or
internet providers, congestion on any carrier networks or otherwise;
b. any theft, destruction or unauthorised access to, or alteration of such
communications; and
c. any problem with, or technical malfunction of, any computer system or other
equipment used for the conduct of the Competition.
38. All internet, mobile phone and/or SMS charges in relation to the Competition are the sole
responsibility of the Entrant.
39. The Promoter accepts no responsibility for any tax implications that may arise from a
Prize.
Privacy
40. The information Entrants provide will be used by the Promoter for the purpose of
conducting this Competition and communicating with Entrants. The Promoter may collect
Entrants' personal information (including through its contractors or agents) or disclose
Entrants' personal information to its related companies, contractors and agents to assist
in conducting this Competition, storing data or communicating with Entrants. By entering
this Competition, Entrants consent to the storage of their personal information on the
Promoter’s database and the Promoter may use this information for future competition
and marketing purposes regarding its products, including contacting Entrants via
electronic messaging. By entering this Competition, Entrants consent to receiving SMS
or email messages from the Promoter that do not contain any functional unsubscribe
facility. The Promoter is bound by the Privacy Principles in the Privacy Act 1988 (Cth).
The Promoter’s Privacy Policy, located at http://www.vicinity.com.au/privacy-policy
contains information about how Entrants can seek access to the personal information the
Promoter holds about them and seek the correction of such information.
Changing the competition
41. If the conduct or operation of the Competition is interfered with or disrupted in any way
by any cause outside the reasonable control of the Promoter or the Competition is not
capable of running as planned (including, but not limited to, by reason of misdirected
Entries, tampering, unauthorized intervention, fraud or technical failure), the Promoter
reserves the right (in its absolute discretion) to (subject to any statutory requirements)
suspend, modify, cancel, recommence or terminate the Competition as appropriate. For
the avoidance of doubt, any cause which is outside the reasonable control of the
Promoter includes, but is not limited to, vandalism, power failures, natural disasters, acts
of God, civil unrest, strikes or computer viruses.
Severability
42. Any provision of these terms and conditions which is prohibited or unenforceable in any
jurisdiction is ineffective as to that jurisdiction to the extent of the prohibition of
unenforceability. That does not invalidate the remaining provisions of these terms and
conditions nor affect the validity of the provision in any other jurisdiction.
