Win a Mentor - Cosmopolitan Competition

1. Instructions on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is open to residents of Australia and New Zealand aged 18 years and over. Employees of the Promoter, associated agencies and companies and their immediate families are ineligible to enter.

3. To redeem the prize all entrants must have access to a computer, internet and must have successfully completed English at a Year 12 level.

4. One entry per person will be permitted.


5. The promotion commences on 9 March 2017 and closes at 23:59pm (AEST) on 5 April 2017. The judging will be done by a panel of judges appointed by the Promoter. The first round of judging to determine the shortlisted finalists to move to the second round of judging will take place at Bauer Media, 54 Park Street, Sydney, NSW, 2000 and will begin on 6 April 2017. All finalists will be notified by email using the email address given in their entry. The shortlisted Finalists will be contacted by a member of Cosmopolitan Magazine for a telephone interview to take place on a date and time agreed between the Finalist and Cosmopolitan. The telephone interviews will take place between 13 April 2017 and 20 April 2017.

The second round of judging to determine the winner will take place at Bauer Media, 54 Park Street, Sydney, NSW, 2000 and will begin on 21 April 2017. The winner will be notified by telephone and e-mail using the contact details given in their entry.

6. To enter, individuals must go to the www.cosmopolitan.com.au during the promotional period and follow the prompts to the competition page. Individuals must complete the entry form including their full name, mailing address, current valid email address, date of birth, daytime telephone number and answer the competition question in 100 words or less “Tell us what mentor you want and why you believe they’re the mentor for you?” and submit the entry as instructed.

7. This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided and suitability to the promotion. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.

8. The Promoter is neither responsible nor liable for late, lost or misdirected entries, or entries not received by the Promoter for any reason whatsoever. Entrants should not send in original copies of their entries as entries will not be returned. No responsibility will be taken by the promoter in the event that the original entry is lost or damaged in editing.

9. Incomplete or incomprehensible entries will be ineligible and discarded.

10. An entry must not be, without limitation:

a) late;
b) delayed;
c) incomplete;
d) incomprehensible;
e) unlawful;
f) obscene;
g) defamatory;
h) discriminatory;
i) libellous;
j) threatening;
k) pornographic;
l) harassing;
m) hateful;
n) racially or ethnically offensive;
o) capable of encouraging of conduct that would be considered a criminal offence;
p) capable of violating any law;
q) capable of giving rise to civil liability.
Any entry which the judges deem inappropriate will be invalid.

11. All decisions relating to the conduct of the Promoter and Promotion, including, but not limited to, the selection of any and all parts of an entry to be published, and the awarding of prizes, are at the sole and exclusive discretion of Promoter and are final and not subject to appeal.

12. Failure to comply with any term or condition may result in disqualification and/or forfeiture of Prizes at the Promoter’s sole discretion.

13. The Promoter reserves the right to verify the validity of entries at anytime during or after the promotional period, and reserves the right to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

USE OF ENTRIES

14. The Entrant warrants to the Promoter that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.

15. Each entrant grants to the Promoter an irrevocable, worldwide and perpetual licence to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future Promoter’s or their agents book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The Promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of any submitted entry.

16. The promoter will not be liable for any breach of copyright. The entrant will be solely responsible for their own entry and the consequences of submitting them. The entrant represents and warrants that:
Their entry is their own and:
a) They own or have all necessary licences, rights, consents and permissions to use and authorize the promoter to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all entries to enable inclusion and use of the entries in the manner contemplated by these terms and conditions.

17. It is a condition of entering the competition, that the entrant agrees to the use of their entry, to be interviewed or photographed as determined by the Promoter to be used by the Promoter or their agents for a story or feature on the promotion to be developed and featured in Cosmopolitan Australia magazine, website or social media pages (or any other form of media it deems suitable) without further remuneration or reference to the entrant. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoter at all times.

18. Entrants must disclose any issues that may generate negative publicity and impact on the success of this promotion and/or COSMOPOLITAN magazine. The Promoter can disqualify an entrant for failure to disclose any issues that may generate negative publicity and impact on the success of the COSMOPOLITAN Win a Mentor Competition and/or COSMOPOLITAN magazine.

19. The Promoter reserve the right to disqualify an entrant if, in their complete discretion the Promoter deem that nominee’s continued involvement in the COSMOPOLITAN Win a Mentor promotion will (in any way) negatively impact on the success of the promotion and negatively influence the general purpose of the promotion. For the removal of doubt the Promoter have the right to remove and/or disqualify a participant at any stage of the promotion. No correspondence will be entered into.

20. Each entrant agrees to inform the Promoter, before acceptance of any finalist/winner status related to this promotion of any unspent criminal convictions of any kind subsisting at the date of entry and will notify the Promoter immediately if there are any criminal charges brought against them after the date they are nominated up to and including the date of the start of the announcement of the winner.

21. Except with our prior written consent, no entrant must supply commentary related to the Promotion and/or COSMOPOLITAN magazine, of any nature to any company or person engaged in the television, pay television or radio broadcasting, printed or electronic publishing, online media, telecommunications or advertising industries (or any company, person or entity which supplies services or programs to any such companies, persons or entities) from the date entry.

PRIZE:
22. The best (1) valid entry as determined by the judges will be deemed the prize winner and will win:

A twelve (12) month mentorship - This mentorship includes: A mentor providing guidance over e-mail and telephone correspondence and a one (1) week internship with the mentor.

23. The mentor will provide advice on career choices and any questions the winner may have relating to the career choices only. The winner will be able to have a maximum of one (1) telephone call for a maximum of thirty (30) minutes and one (1) email per week during the twelve (12) month period. Any additional questions or telephone calls will be determined by the Mentor at their complete discretion. The Promoter will not be held liable for any advice given by the Mentor during the redemption of the prize.

24. Internship component of the prize – is a non-paid internship only. Redemption of this component of the prize must be completed within twelve (12) months from the date of winner notification. Travel to and from the internship including but not limited to domestic or international (new Zealand resident only) flights, car/public transport, transfers and accommodation (if required) costs are the responsibility of the winner. The dates of the internship must be agreed upon with the Mentor. The Promoter makes no guarantees of the availability of the Mentor. In the event, the winner is unable to attend a day during the week internship the winner will forfeit that day and no make-up days will be provided. The winner is also responsible for all other expenses including all meals and beverages, work insurance and all other ancillary costs whist interning at the mentor’s office. These costs will be the responsibility of the winner.


25. In the event the winner is unable to redeem the internship component of the prize, the winner will forfiet this component of the prize.

26. It is a condition of accepting the Prize that the winner signs all legal documentation (including but not limited to a Cosmopolitan Mentorship Agreement) as provided to them by the Promoter and Mentor. Form of documentation will be determined by the Promoter in its complete discretion.

27. If for any reason whatsoever the winner chooses to ether not sign the Agreement or any other documents provided by the Promoter or Mentor, or requests to not be bound by the terms of the Agreement they have signed with the Promoter or Mentor then the winner will forfeit the prize.

28. It is a condition of entering the Promotion that the entrant warrants to the Promoter that they understand that any arrangement entered into in relation to the publication of their entry does not create a relationship between the winner and the Promoter or Mentor of employer and employee, principle and agent, partnership or joint venture.

29. At the time of winner notification, the winner maybe asked by Cosmopolitan to participate in a photo-shoot, be filmed and be interviewed for the feature appearing in COSMOPOLITAN magazine/website/social media accounts (or any other form of media it deems suitable) without further remuneration or reference to the winner. Any feature date will be determined by the Promoter. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoters at all times. Interview, video and photo-shoot dates and times will be determined by the Promoter in its complete discretion. Travel including but not limited to domestic flights, transfers, accommodation, meals, beverages, spending money will not be included.

30. Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoters accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. .

31. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements

32. The Promoter’s decision is final and no correspondence will be entered into. The winner will not be compensated for unused portions of the prize.

33. In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.

34. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

35. When an entrant submits any materials via the promotion including comments, recordings and images (“Content”), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants warrant that the Content is their original work and that it does not infringe the rights of any third party. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

36. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster) the Promoter reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.

37. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.

38. If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoter requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize the winner sign any such legal documentation.

39. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

40. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

41. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Privacy:
42. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.bauer-media.com.au/privacy.htm. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter.

43. New Zealand: The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http:///www.bauermedia.co.nz/privacy (NZ). Under the Privacy Act 1993, entrants have the right to access and request the correction of any PI held by the Promoter. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy.
