Terms and Conditions
Participation
1) These terms and conditions relate to the “Perfect Italiano Appliance Package Promotion” competition, under which entrants can go in the draw to win a major prize of a kitchen Appliance Package Voucher and daily bake set prizes (“Competition”). Fonterra Brands (Australia) Pty Ltd, ABN 80 095 181 669, of 327 Ferntree Gully Road, Mount Waverley VIC 3149 is the Promoter of the Competition (“Promoter”).
 
2) Entry to the Competition constitutes acceptance of these conditions.
 
3) The Competition is only open to Eligible Entrants. An "Eligible Entrant" is an individual who is:
     (i) a resident of Australia aged 18 years or older as at the time of entry; and
     (ii) not an employee of the Promoter or any of its related corporations, or any of their agencies associated with the Competition;
     (iii) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee.
 
Entry
4)  Competition entry opens at 9am on 05/07/17 and closes at 11:59pm on 01/08/17 ("Entry Period"). Unless otherwise indicated, all times and dates are times and dates in Melbourne which may be AEST or AEDT depending on the date.
 
5)  To enter, an Eligible Entrant must, during the Entry Period, first make a Qualifying Purchase from any Woolworths Supermarket retail outlet anywhere in Australia or online (www.woolworths.com.au). A “Qualifying Purchase” is the purchase, in one (1) transaction, of any two (2), or more Perfect Italiano products (each a “Qualifying Product”).
 
6)  To submit a valid entry, an entrant must use a compatible browser to visit
www.perfectitaliano.com.au/kitchen ("Competition Website") and follow the directions
there. For each entry, the entrant must:
     (i) keep their original purchase receipt(s) and the two (2) product barcodes from the
Qualifying Purchase;
     (ii) enter the product barcodes on the two (2) Qualifying Products being used to enter; and
     (iii) provide all other details required by the Competition Website, including the entrant’s first
and last names, contact telephone number, e-mail address and suburb or postcode.
 
7) Upon entry via the Competition Website, entrants will be offered up to 1 bonus entry if they complete any one of the following during the promotional period.
     (i) Go to Facebook™ and share their unique referral link to the promotional website (1 extra entry);
     (ii) Go to Twitter and share their unique referral link to the promotional website (1 extra entry); or
     (iii) Share the promotional URL generated on the Competition Website (1 extra entry);
 
Subject to the other conditions, an Eligible Entrant may enter the Competition once for every Qualifying Purchase that they make during the Entry Period. IMPORTANT: If more than two (2) Qualifying Products are purchased in the same transaction, there is still only ONE Qualifying Purchase. Accordingly only ONE entry may be submitted based on that Qualifying
Purchase transaction.
 
9)  Entry can only enter via the Competition Website.
 
10) All entrants must ensure that their entries are received by the Promoter during the Entry Period. The Promoter takes no responsibility for, and will not compensate any entrant for, any late or misdirected entry or for any delays or failures in any telecommunications service or equipment.
 
11)  For each and every Qualifying Purchase that an Eligible Entrant uses to submit an entry, he/she MUST retain: (i) the original barcodes of the Qualifying Products comprising the Qualifying Purchase, and (ii) a copy of the Woolworths store receipt(s) and/or Woolworths online receipt(s) issued when that Qualifying Purchase was made.
 
12)  All entries to the Competition may be subject to varication by the Promoter, as set out below:
     (i) An entrant MUST, within 7 days of being asked, deliver to the Promoter (by a means reasonably determined by the Promoter) all of the items which condition 11 requires the entrant to retain and which are requested by the Promoter. The Promoter may elect not to return those items.
     (ii) An entrant MUST also deliver to the Promoter (by a means reasonably determined by the Promoter) copies of any other documents the Promoter may request establishing eligibility to enter or win, including evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, an entrant MUST also, within 7 days of being asked, allow the Promoter
to inspect and copy the original of any such document.
 
13) The Promoter may in its sole discretion, reimburse an entrant for any reasonable costs incurred in complying with this condition.
 
14) The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Competition to the Promoter's reasonable satisfaction; or (ii) fails to produce items as required by conditions 11 and 12 or produces items that, in the Promoter's reasonable opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter's reasonable opinion, tampers with the entry process or benefits from such tampering; or (iv) in the Promoter's reasonable opinion, submits an entry which is incomplete, inaccurate, erroneous, ineligible, offensive, misleading, inappropriate or incomprehensible, or otherwise is not in accordance with these conditions.
 
15) An entry by more than one person (i.e. a joint entry) is invalid.
 
16) Any costs associated with accessing the Competition Website are the responsibility of the person seeking access and are dependent on the internet service provider used.
 
17) Eligible Entrants must make their internet entries manually using an internet browser. The Promoter may reject internet entries if it reasonably forms the opinion that they have been entered using automated entry means or by use of a competition entry service.
 
Major Prize Draw and Prize
 
18) The Major Prize Draw for the Competition will be conducted at 12:00pm on 04/08/17 at Peazie Social Media (Group) Pty Ltd, Level 2, 27 St Edmonds Road, Prahran VIC 3181 Australia, (“Draw Location”) by a person nominated by the Promoter who will choose the winner at random selection from all valid entries received during the Entry Period (“Prize Draw”). The first three (3) unique Eligible Entrants with a valid entry drawn in the Prize Draw will each win a Kitchen Appliance Package Voucher (“Major Prize”) as detailed in paragraph
19.
 
19) The Major Prize is a Kitchen Appliance Package Voucher. (“Voucher”) (a Voucher is deemed a ‘Gift card’ or ‘e-Gift Card’ or ‘unique redemption code’) to be won. Valued at a maximum of AUD$45,000 and comprise of the following:
     i. 3 x Harvey Norman Gift Cards to the value of AUD $15,000 each;
     ii. The Voucher or Gift Card is awarded from the retailer as the issuer of the Voucher but is not the Promoter of the offer, Harvey Norman is not responsible for fulfilment of the offer terms. Vouchers are valid for 24 months from date of issue and are redeemable at participating stores and locations only. Participating stores and locations may change from time to time. 20) There are three Major Prize’s to be won. Each Major Prize winner may win a maximum of ONE Major Prize.
 
21) Unless expressly stated within these conditions, all expenses incurred in relation to the prize (including insurance) are the responsibility of the winner.
 
22) If for any reason the winner does not take the Major Prize (or an element of the Major Prize) within the time stipulated in paragraph 18 (ii) above, then the Major Prize (or that element of the Major Prize) will be forfeited and will not be redeemable for cash.
 
Daily Prize and Draw
 
23) There are 28 “Bake Sets” to be won, one per day, as part of the Competition, valued at AUD$446 RRP each.  The total value of the Bake Sets  is AUD$12,4388 RRP.
The “Bake Set” refers to;

     i.   2 x Emile Henry Baking Dish
     ii.  1 x Emile Henry Ceramic Pot
     iii. 1 x Baking mitts
     iv. 1 x Scanpan stainless steel spatula
 
Each day of the Entry Period, one entrant will be randomly allocated as a “daily winner”. The daily winner draws will occur randomly each day via computer generated random instant win at Peazie Social Media (Group) Pty Ltd, Level 2, 27 St Edmonds Road, Prahran VIC 3181 Australia. Winners will be notified immediately on-screen and via email.
 
Prizes Generally
 
24) The total prize pool value is RRP AUD$57,488
 
25) There is one prize pool with 31 prizes in total.
 
26) The prizes are valued as at 21/03/17 at Australian prices in AUD$. The Promoter takes no responsibility for any variations in value of the prize.
 
27) If the prize (or part of the prize) is unavailable for any reason, the Promoter may, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Competition. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if the prize (or part of the prize) is unavailable for any reason.
 
28) To the maximum extent permitted by law, the Promoter and its related companies shall not be liable for any loss, damage, or personal injury whatsoever by or to any person in connection with the Promotion or with winning or benefiting from a prize.
 
29) A right to receive the prize is not transferable or exchangeable and cannot be taken as a monetary payment.
 
30) All prizes from the advertised prize pool will be distributed and all existing claims, unless due to fraud or ineligibility, for prizes and entitlements will be met notwithstanding that the advertised prize pool has been exceeded and printing errors and other quality control matters will not be used as a reason for refusing payment of prizes.

Winners
 
31) Each winner, (of either the Major Prize or Bake Set), whenever determined, will be notified in writing sent to the e-mail address provided in their entry or by telephone. So far as practicable, the notification will be sent to each winner within two days of their determination. The notification will include instructions as to how each winner is to claim the prize and establish his/her entitlement to it.
 
32) The names of each winner will be published at www.perfectitaliano.com.au/kitchen within 7 days of the prizes being won, for a period of at least 14 days.
 
33) Subject, where relevant, to any directions given under the legislation regulating the Competition, if any of the prizes are not claimed by a winner within 3 months of the draw for that prize, the prize will be awarded to another Eligible Entrant in a redraw commencing 12:00pm on 03/11/17 at Peazie Social Media (Group) Pty Ltd, Level 2, 27 St Edmonds Road, Prahran VIC 3181 Australia.
 
34) No compensation will be payable to any person whose entry is drawn but who does not claim their prize.

General
 
35) The Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
 
36) Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition.
 
37) CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION, TO CAUSE DAMAGE TO OR TO INTERFERE WITH THE FUNCTIONING OF ENTRY PROCESSES OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH AN ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
 
38) All of the Promoter’s decisions are final and no correspondence will be entered into.
 
39) The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in the Competition. Entrants should obtain independent tax and financial advice.
 
40) To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Competition or prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify an Australian entrant’s rights under the Competition and Consumer Act 2010.
 
41) If any provision of these conditions is unenforceable for any reason, it will be severed and the remaining provisions will remain in full force and effect.
 
42) The winner of the prize consents to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without remuneration for the purpose of promoting this Competition, the Promoter and/or any of the Promoter's products.
 
43) Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise its winner(s) and, if an entrant consents, may be used to market its products to the entrant. The personal information of each winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers, and to regulatory authorities. Persons may contact the Promoter by post at the address stated in paragraph 1 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize.
