The Toy Dash competition commences Wednesday 15th November 2017 until Sunday 10th December 2017.

By entering the Toy Dash competition, winners must be available to participate in the event on Friday 15th December, 2017.

Southgate Toy Dash
TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in
this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to NSW residents aged 18 years or over. Employees (and their immediate
families) of the Promoter and agencies associated with this promotion, including retailers and staff of
Southgate Shopping Centre are ineligible to enter. Immediate family means any of the following:
spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, stepparent,
grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, stepsister
or first cousin.
3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including
a entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry
that is not in accordance with these Terms and Conditions or who tampers with the entry process.
Errors and omissions may be accepted the Promoter’s discretion. Failure by the Promoter to enforce
any of its rights at any stage does not constitute a waiver of those rights.
4. Promotion commences Wednesday 15 November 2017 at 9am and closes Sunday 10 December
2017 at 4.00pm (AEDST) (“Promotional Period”). The Promotion will be conducted at Southgate
Shopping Centre as set out in Annexure A ‘Participating Retailers’.
How to Enter:
5. To be eligible to enter (eligible entry) individuals must, during the promotional period, undertake the
following steps:
(a) Spend $15 or more at any participating retailer to receive an entry form.
(b) Complete the entry form including Full Name, Phone Number, Email Address, Postcode and
Southgate Retailer which $15 was spent at.
(c) Place the completed entry form in the competition barrel (located opposite Michael Hill
Jewellers)
Draw:
6. There will be three winners during the Promotional Period. Three “Toy Dash” tickets will be issued
to the winners –
a) 1 Toy Dash ticket distributed from the barrel, located in Southgate Shopping Centre, Sylvania,
Corner Princes Highway & Port Hacking Road, Sylvania NSW 2224 on Monday 11th
December 2017, out the front of Michael Hill Jewellers.
b) 1 Toy Dash ticket distributed via social media (Southgate Sylvania Facebook page:
https://www.facebook.com/southgatesylvania)
c) 1 Toy Dash ticket distributed from local newspaper, The Leader, via their publication or
Facebook page: https://www.facebook.com/SutherlandShireStGeorgeNews/
7. The three winners will be notified no later than Tuesday 12th December 2017 by 5:30 PM.
The winners will be contacted by email and if unavailable, will also be contacted by phone. Winners
have until Wednesday 13th December 2017 CLOSE OF BUSINESS (5:30 PM) to respond to the
winning email/phone call. If no response is received, the promoter has the right to redraw a winner.
Major Prize:
8. The major prize for the three Toy Dash ticket winners is: one 90 second Toy Dash throughout
Kmart Sylvania’s Toy Section during trade (15 December 2017) per winner. The Toy Dash ticket
winners must nominate a child (12 years or under) to complete the dash. Prize values will be based
on the value of goods that the nominated child has placed in their trolley in the 90 seconds allowed –
to the maximum values of $1,000 per winner.
9. Prize winners may choose any goods from the Toy section(s) of Kmart Sylvania during the 90
second Toy Dash. Any excess products will be removed at the end of the trolley dash, prior to the
calculation of the final prize value.
10. The prize winners must provide the Promoter with certified copies of all required documentation
as required by the Promoter before the prize is awarded. It is a condition of accepting the major prize
that the major prize winner may be required to sign a legal release in a form to be determined by the
Promoter in its discretion. The prize winner and the nominated child who undertakes the Toy Dash
agrees to being recorded for marketing and promotional purposes.
General:
11. Prize values will be determined by the amount of eligible goods the prize winners nominated child
has in their trolley after the completion of the Toy Dash. Maximum total prize pool value is $1,000 per
winner.
12. Incomplete or indecipherable entries will be deemed invalid.
13. If there is a dispute as to the identity of the entrant, the entrant will be deemed to be the person
whose name is entered on the entry form provided the person is a New South Wales permanent
resident of at least 18 years of age. The entrant must provide an authorised identification card to
prove their identity.
14. If the prize is unavailable due to reasons beyond the control of the Promoter, the Promoter in its
discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification,
subject to any written directions from a regulatory authority.
15. The prize, or any unused portion of the prize is not transferable or exchangeable and cannot be
taken as cash, unless otherwise specified.
16. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably
anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited
to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole
discretion, to the fullest extent permitted by law: (a) to disqualify any claimant; or (b) subject to any
written directions from a regulatory authority to modify, suspend, terminate or cancel the Promotion,
as appropriate.
17. The Promoter’s decision is final and no correspondence will be entered into.
18. Any cost associated with accessing the promotional website is the entrant’s responsibility and is
dependent on the Internet service provider used. The use of any automated entry software or any
other mechanical or electronic means that allows an entrant to automatically enter repeatedly is
prohibited and will render all entries submitted by that entrant invalid.
19. Each entrant acknowledges that when they submit any materials via the promotion including
comments, recordings and images (“Content”), the entrant, unless the Promoter advises otherwise,
licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free,
perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish
and display such Content for any purpose in any media, without compensation, restriction on use,
attribution or liability. Each entrant agrees not to assert any moral rights in relation to such use. Each
entrant warrants that they have the full authority to grant these rights.
20. The Promoter shall not be liable in any way for such Content to the full extent permitted by law.
The Promoter may remove any Content without notice for any reason whatsoever. Each entrant
warrants and agrees that: (a) they will not submit any Content that is unlawful or fraudulent, or that the
Promoter may deem in breach of any intellectual property, privacy, publicity or other rights,
defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing,
threatening, objectionable with respect to race, religion, origin or gender, not suitable for children
aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any
person or property that appears in their Content; (c) they will obtain full prior consent from any person
who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their
Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will
comply with all applicable laws and regulations, including without limitation, those governing
copyright, content, defamation, privacy, publicity and the access or use of others' computer or
communication systems.
21. Without limiting any other terms herein, each entrant agrees to indemnify the Promoter for any
breach of the above terms in Clauses 18 and 19.
22. Except for any liability that cannot be excluded by law, the Promoter (including its officers,
employees and agents) exclude all liability (including negligence), for any personal injury; or any loss
or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in
any way out of the promotion, including, but not limited to, where arising out of the following: (a) any
technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any
theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost,
altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any
reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in
these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
23. The Promoter collects personal information in order to conduct the promotion and may, for this
purpose, disclose such information to third parties, including but not limited to agents, contractors,
service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is
conditional on providing this information. By opting in, entrants agree to become a member of the
Southgate Shopping Centre customer database and the Promoter may, for an indefinite period,
unless otherwise advised, use the information for promotional, marketing, publicity, research and
profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should
direct any request to access, update or correct information to the Promoter. All entries become the
property of the Promoter.
24. The laws of the State of New South Wales, Australia apply to this promotion to the exclusion of
any other law. Entrants submit to the exclusive jurisdiction of the courts of New South Wales,
Australia.
25. Any questions, comments or complaints regarding the promotion should be directed to the
Promoter.
