Introduction The following terms and conditions (Terms and Conditions) apply for the Promoter's promotion relating to the Fitbit Ionic Pledge to Swim and Win competition (Promotion).
The Promoter is Swimming Australia Limited (SAL), ABN 14 109 333 628 of Level 2, 50-56 York Street, South Melbourne, Victoria (Promoter).
Entry is open to all Swimming Australia Facebook followers (Entrants). Entrants who submit a valid entry during the Competition Period will be entered into the competition.
Information on how to enter this Promotion forms part of the conditions of entry to the competition and participation in the Promotion is deemed acceptance of these Terms and Conditions. Entries not completed in accordance with these Terms and Conditions within the Registration Period are void.
Employees of the Promoter and its agencies associated with this promotion and their immediate families are ineligible to enter the competition. Otherwise, entries are open to anyone who satisfies all competition eligibility criteria referred to in these Terms and Conditions.
Entries to the Promotion open at 3pm on Thursday 4 January 2018 AEST
and close at 11:59pm on Monday 8 January AEST (Competition Period).Method of Entry
In order to validly enter the Promotion, the Entrant must during the Competition Period complete an entry using the following method of entry:
Follow the Swimming Australia Facebook account (if not already following) and complete the competition form at swimmingaustralia.com.au/competitions.
A maximum of one entry per Entrant may be submitted. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including but not limited to an Entrant's identity and place of residence) and disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.
Prize
There will be one prize winner. The prize winner will receive a single Fitbit Ionic at a value of $299 (inclusive of GST). The prize must be redeemed within 12 months from the date of issue. The prize is not transferable or exchangeable and cannot be taken as cash.
Prize is subject to the standard terms and conditions of individual prize and service providers.
The winning entry will be selected based on creativity and originality from the valid entries and judged by a panel appointed at Swimming Australia’s discretion. The Promoter's decision on the winning entrant is final and no correspondence will be entered into.
The Promotion is a game of skill. Chance plays no part in determining the winning entrants.
The winning Entrant will be selected by the Promoter at Level 2, 50-56 York St, South Melbourne, VIC 3205 on Tuesday 9 January at 12pm AEST.
The winning Entrants will be notified on Tuesday 9 January 2018.
The Prize will be delivered to the winning Entrant via post to an address supplied by the winner.
In the event that the winner cannot be contacted by the Promoter, using all reasonable efforts, the winner will be deemed to have forfeited their right to the prize and the next best Entrant as deemed by the judges will be awarded the prize.
The Promoter at all times reserves the right to withdraw, cancel or substitute the designated prize with another prize of similar or like value without notice to any Entrants should such withdrawal, cancellation or substitution be deemed necessary in the Promoter’s sole discretion. In such situation, all entrants agree to be bound by these changes as part of the conditions of entry into the Promotion and forego any rights or entitlements resulting from such change to the Promotion.
General
All entries to the Promotion become the sole property of the Promoter and the Promoter may publish entries on Promoters social media channels.
The Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. By participating, the Entrant hereby releases and holds harmless Facebook and Instagram from any and all liability associated with the Promotion.
It is each Entrant's responsibility to adhere at all times to the requirements under these Terms and Conditions.
If for any reason this Promotion is not capable of running as planned including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion.
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Promotion within the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel or vary the Promotion and recommence it from the start on the same conditions.
The Promoter reserves the right, at any time, to verify the validity of entries, Entrants and other any other persons submitting entries (including a person's, identity, age and place of residence, and, where an Entrant is aged under 18, that the person submitting their entry is their parent or legal guardian). Proof of, identification, age, residency, entry and parenthood or legal guardianship considered suitable for verification is at the discretion of the Promoter.
The winning Entrant agrees to participate and cooperate as required in all editorial and promotional activities relating to the Promotion, including but not limited to being interviewed and photographed. The winners agree to grant the Promoter a perpetual and non-exclusive license to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.
The Promoter collects personal information in order to conduct the Promotion and entry into the Promotion is conditional on the provision of this information by an Entrant. All personal information will be collected, used and disclosed in accordance with the Promoter’s Privacy Policy which can be found at
www.swimming.org.au. By submitting an entry into this Promotion, you acknowledge that the Promoter may use or disclose your personal information for the purposes of promoting, conducting, developing and/or administering a junior swimming program, providing you with member information or promotional material or otherwise in accordance with the Promoter's Privacy Policy. The Promoter may share my information with third parties; companies engaged by the Promoter to carry out functions and activities on their behalf including direct marketing; professional advisers, including accountants, auditors, lawyers and insurers; however, your information is not generally disclosed to anyone outside Australia. You understand that the Promoter's Privacy Policy contains information about how you may access and request correction of your personal information held by the Promoter or make a complaint about the handling of your personal information, and provides information about how a complaint will be dealt with by the Promoter. If you do not wish to receive promotional material from the Promoter's sponsors and third parties, you must advise the Promoter in writing or via the opt-out procedures provided in the relevant communication. It is your responsibility to read and understand the Privacy Policy of the Promoter. You understand that if you have any concern or complaint about the way the Promoter handles your personal information, you must contact SAL.
