TERMS AND CONDITIONS:

1. Information on how to enter and prizes form part of the Terms and Conditions. Entry into this competition deems acceptance of these Terms and Conditions.
2. To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.
3. Eligible Entrants acknowledge that fulfilment of this prize requires meeting several specific terms and conditions, including meeting Zero-G medical requirements, being able to enter the United States of America on August 17 2018, and signing a Zero-G Liability Waiver Form and Zero-G Photo and Publicity Release. If an Eligible Entrant or their companion cannot meet these requirements, they will not be able to claim the prize. Please refer to paragraph 26 for all information regarding these requirements.
4. Eligible Entrants acknowledge that participation in the Promotion and prize fulfilment may involve risk. The Promoter may require a winner (and their companion) to sign an indemnity and release prior to participation in the prize fulfilment or participation in the Promotion.
Who can enter
5. Subject to clause 4, entry is open to all residents of Australia that have a valid passport, who are over the age of 18, as of the date of entry, and who have fulfilled the requirements set out below ('Eligible Entrants').
6. Employees, and their immediate families, of the Promoter, associated agencies and companies, contractors or individuals are not eligible to enter this competition. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or first cousin.
7. The Promoter is Kellogg (Aust.) Pty Ltd ACN 004 110 105 of 41-51 Wentworth Avenue, Pagewood NSW 2035 ('Promoter').
Promotional period
8. The competition commences at 3:30pm AEST on 9 July 2018 and closes at 11:59pm AEST on 3 August 2018. (‘Promotional Period’).
9. The promotion start and close time and date are subject to change at the Promoter's discretion and all changes will be notified on the Kellogg’s Australia Facebook Page.
How to enter
10. Eligible Entrants can enter the competition via Facebook or Instagram.
a. To enter via Facebook:
i. During the Promotional Period, the Promoter will make a post on the Kellogg (AU) Facebook Page inviting Eligible Entrants to enter the competition by creating a video or GIF (under 60 seconds) of them trying the Crunchy Nut Glorious Oat Granola (“Promotional Post”).
ii. Eligible Entrants must, during the Promotional Period:
1. Purchase a 380g gram pack of Crunchy Nut Glorious Oat granola (any flavour) (‘Eligible Product Purchase’); and
2. Visit the Kellogg’s Australia Facebook page, and post the video or GIF of them trying the Crunchy Nut Glorious Oat Granola as a comment on the Promotional Post.
b. To enter via Instagram Eligible entrants must, during the Promotional Period:
ii. Purchasing a 380g gram pack of Crunchy Nut Glorious Oat granola (any flavour) (‘Eligible Product Purchase’); and
iii. post on their personal Instagram account (with privacy settings set to public) a video or GIF (under 60 seconds) of them trying the Crunchy Nut Glorious Oat Granola and use the hashtag #CrunchyNutCrew.
11. The winner will be contacted via private message on the social media platform they entered the competition on.
12. The Promoter will require the winners to provide their full name, contact number, email address proof of a current passport and passport number (“Necessary Information”). The Promoter will handle all Necessary Information in accordance with its Privacy Policy.
13. Failure to provide Necessary Information within 48 hours of being requested may, in the absolute discretion of the Promoter, result in invalidation of all of the Eligible Entrant’s entries and forfeiture of any right to a prize and the Promoter may select a replacement winner from any of the valid entries.
Video and Graphics Interchange Format (“GIF”) requirements
14. All videos and GIFs must feature Crunchy Nut Glorious Oat granola (any flavour).
15. Videos and GIFs must be under 60 seconds in length.
16. All entrants must submit ONLY their own original video or GIF. Any such video or GIF cannot be previously published in any forum worldwide. Entries that are found to have been derived from the designs of a third party will be considered invalid and, if awarded a prize, that prize must be returned to the Promoter. The winner may be required to sign a statutory declaration regarding the originality of the entry.
17. All entrants must have permission from any person easily identifiable in the video or GIF before entering the competition.
18. Entry videos and GIFs must not contain any material which is, in the opinion of the Promoter, offensive, defamatory, inappropriate, obscene, unsuitable, infringing content, rude or otherwise objectionable.
Judging of Entries
19. This is a game of skill and winners will be chosen on the basis of skill, creativity, originality and the Crunchy Nut brand of fun (‘Judging Criteria’). Judging of valid entries will be undertaken within a reasonable period after the end of the Promotional Period by a Kellogg’s representative at 41-51 Wentworth Avenue, Pagewood, Sydney 2035 (NSW).
20. The judge’s decision is final and binding on each person who enters and no correspondence will be entered into.
21. The Promoter reserves the right, in its sole discretion, to reject any entries that do not comply with these Terms and Conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition and will not provide any reasons for rejection. Entries that do not comply with these Terms and Conditions of entry will be deemed invalid and are not eligible to win. The Promoter's legal rights to recover damages or other compensation are reserved
22. The Promoter may, at its absolute discretion, select alternative valid entries as replacement winners in the event that any of the Eligible Entrants cannot satisfy these Terms and Conditions or take a prize.
Number of Entries permitted
23. Multiple entries are permitted, provided that each entry complies with these Terms and Conditions.
Prizes on offer
24. Total prize pool value is up to $10.000 AUD (including GST).
25. The Prize consists of, for the winner and the winner’s companion:
b. A place on a Zero-G flight on 18 August 2018 in Las Vegas, Nevada, United States of America valued at USD$5,000.
c. Return economy flights from the nearest capital city to Las Vegas, Nevada (including connecting flights), leaving Australia on 17 August 2018. Return date is to be negotiated with the Promoter.
d. Two nights’ accommodation in a three (3) star hotel in Las Vegas, Nevada, United States of America;
e. All meals consumed during the two-night stay in Las Vegas on 17/08/2018 and 18/08/2018.
f. All transfers, including between home and the applicable capital city airport;
g. Visa application fees.
26. The winner and their companion must:
a. be 18 years or over;
b. have a valid passport;
c. be able to enter the United States of America;
d. be able available to fly to Las Vegas, Nevada on 17 August 2018;
e. complete the Zero G Medical History Form;
f. complete the Zero-G Flyer Registration Form;
g. complete the Zero-G Liability Waiver Form;
h. complete the Zero-G Photo and Publicity Release.
27. Eligible Entrants acknowledge that Zero-G has specific restrictions around participating in the zero gravity flight. In some cases, a physician must be consulted to sign the medical history form before the form is complete. If an Eligible Entrant or their companion cannot meet these conditions, they will not be able to claim the prize. 28. The winner and their companion must complete a prize acceptance form and must submit their passport details in order to assist with booking their prize trip.
29. The dates for flying to Las Vegas, Nevada and for the zero gravity flight are non-negotiable. Return flight date to Australia is to be negotiated with the Promoter. Subject to clause 34, excluding the economy flight returning to Australia and transfer, the Promoter will not cover any costs the winner and their companion incur after 18/08/2018 (Las Vegas time).
30. Travel insurance will be provided to the winner and their companion before departure, so long as both persons do not have any pre-existing medical conditions. Travel insurance is subject to restrictions and the terms and conditions of the insurance provider. It is the responsibility of the winner and their companion to meet any additional costs relating to obtaining insurance cover for any pre-existing medical conditions and/or for any additional costs as may be specified for persons aged over 75 years.
31. Unless expressly stated otherwise in the description of the Prize in these Terms, the winner and their companion are solely responsible for all costs and expenses with meeting all government, health and travel requirements applicable to the destination (including obtaining a valid passport, travelling to an embassy or vaccinations).
32. The Promoter makes no representation as to the safety or other conditions at the destination and recommends that the winner and his/her companion consult the web site of the Department of Foreign Affairs and Trade http://smartraveller.gov.au/Pages/default.aspx for travel advice.
33. The winner or their companion may be required to provide a valid credit card imprint or cash deposit at Hotel check-in for the purposes of covering incidental or other charges at the hotel. Unless expressly stated otherwise in the description of the Prize in these Terms, the Prize does not include the cost of telephone calls, internet access, breakfast, in-room dining, in-room movies, mini bar, gratuities or any other costs or expenses incurred by the winner or their companion at the hotel.
34. In the event the Zero-G flight is postponed to due unforeseen circumstances for a period of up to 48 hours, the Promoter will provide accommodation for up to two nights in a three (3) star hotel. The prize winner and their companion will be responsible for all other costs in the case of postponement.
35. Unless expressly stated otherwise under these Terms, any non-flight or airline associated taxes or charges, sightseeing or other activities and spending money will be the sole responsibility of the winner and their companion.
Further Terms and Conditions
36. The Promoter reserves the right to amend these Terms and Conditions if this competition cannot be run as originally planned. The Promoter may also cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition.
37. The Prize is not transferable and not redeemable for cash or other goods or services. The Prize must be taken as a whole (to the extent relevant) and as stated in these Terms. No alternative will be provided and no compensation will be payable if the winner is unable to use the Prize as such. Subject to any written directions from a regulatory authority, if a prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value.
38. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier's requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
39. The Promoter reserves the right to request winners to sign a winner's deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
40. The Promoter, its employees, agencies and representatives associated with this Promotion will not be liable or responsible for any problems or technical malfunction of any telephone network or lines, computer or line systems, servers, or providers, computer equipment, software, technical problems of the phone or of any phone network, or any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur which is connected with their entry or as a consequence of late, lost or misdirected mail or email.
Privacy Collection Statement
41. The Promoter and its related entities collect entrants' personal information for the purpose of conducting and promoting this competition (including determining and notifying winners). The Promoter may also disclose personal information collected to Australian regulatory authorities, such as the regulators of trade promotions.
42. The Promoter will otherwise handle your personal information in accordance with its Privacy Policy available on request.

Copyright, Statutory guarantees, Waiver and liability
44. All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received at any time.
45. All entrants consent to the Promoter sharing or reposting at any time any video or GIF that is uploaded to the Promotional Post or any Instagram post that uses the hashtag #CrunchyNutCrew. In participating in the prizes, the winner and their companion agree to participate and co-operate as required in all promotional and editorial activities relating to the competition including, without limitation, being interviewed, videoed, and photographed during the trip to Las Vegas and during the Zero-G flight. The winner and their companion agree to granting the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winner and their companion will not be entitled to any fee for such use.
46. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.
47. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ('Non-Excludable Guarantees').
48. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use of a prize.
