1. STANDARD TERMS 1.1. Information on how to enter forms part of the terms of entry.
 
2. THE PROMOTER 2.1 The Promoter of the competition is Nuttelex Foods Pty Ltd. This competition is in no way sponsored, endorsed or administered by, or associated with Facebook and/or other Social Media channels. You completely release Facebook and/or other Social Media channels from any and all liability associated with this competition.  
 3. WHO CAN ENTER  3.1       This competition is open to all residents aged 18 years and over of both New Zealand and Australia.  
 3.2      This competition is not open to employees of Nuttelex, its agents, contractors, consultants, or their families (including de facto spouses) or to other persons assisting with the Competition.
 4.  HOW TO ENTER  4.1 The Competition commences on 11 November 2019 9:00am (Australian Eastern Standard Time) and concludes on 9 January 2020 11:59pm (Australian Eastern Standard Time) (“the Competition Period”). The Competition Draw Date is 10 January 2020 10 am (Australian Eastern Standard Time).

5.          PRIZES 5.1        There will be one (1) winner who will win one (1) prize package detailed in clause 5.2               below.
 5.2       There is one major prize consisting of a trip for two people in April, 2020 to Borneo to join a  select group of 18 people on Kobe Steele’s “Borneo & the Orangutans of Kalimantan Ecotour”.    Prize includes two economy class international airfares to and from Jakarta. Total prize value is AUD$10k.  
 5.3.   PRIZE INCLUSIONS   o Return airfares to AND from Jakarta  o Return airfares from Jakarta to Pongkolonbun in Borneo o Hotel/Lodge accommodation as specified  o All transfers/transport & tours as specified including vehicles and klotok boats o Breakfast in Jakarta on Monday morning o Meals at Rimba Lodge & Grand Kecubung Hotel. o One visit to the Orangutan Foundation International Care Centre o Tour Escorted by OFI Australia Founder & President Kobe Steele o Ranger fees, police registration handling fees, airport porters, national park charges including park entrance fees & camera charge. 5.4.     PRIZE EXCLUSIONS • Travel Insurance – which is mandatory for this trip • Items of a personal nature • Drinks, laundry, phone calls • Applicable visa/passport fees • Any additional airport taxes • Tips to guides/drivers/cooks/porters • Dinner in Jakarta on Sunday night 5.5         See attached brochure below called “Borneo Orangutans Eco Tour April 19-25th 2020”                for Eco tour detail,  itinerary and highlights.  
 5.6        VERY IMPORTANT: The facilities in some cases are very basic this is not a luxury eco tour. This is a not-for-profit trip, funds raised from this trip go to the Orangutan Foundation International Care Centre.  
 5.7.       In accepting this prize the winner and their companion must arrange their own travel    insurance. Winners will be supplied with a travel insurance and indemnity form to    complete and send back no later than one month prior to departure.   5.8        In accepting this prize the winner and their companion understands and agrees to  undertaking the compulsory inoculations and medical tests also necessary for this   trip. The completed medical form signed and stamped by your doctor, along with a copy of your “negative” TB test result will be required as proof, and needs to be supplied no later than Friday, 13th March, 2020. See attched OFI medical information form below for details.    5.9      In accepting this prize the winner and their companion will also need to start malaria pills prior to                  going to Borneo. This is highly recommended as the tour takes place in a known malaria area.  
 5.10.    Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken.            CONT/3

 6.   In conjunction with clause 5, prize winners must abide by the following conditions: a) Winners and their companion must be able to travel between April 18 to 26th or prize is      forfeited. These specific travel dates and arrangements are subject to Kobe Steeles Eco Tour b) Winner and their companion must hold eligible passport/all relevant visas.
7.  Prizes detailed in clause 5 are not exchangeable, transferable or redeemable for cash and subject to the further terms and conditions below at 7.1 to 6.6.
7.1    If the Winner elects to partake in any or all portions of his/her Prize without a Guest, the Prize will be awarded to Winner and any remainder of the Prize will be forfeited and shall not be subject to further or alternative compensation. All elements of the Prize must be redeemed at the same time, and no changes will be permitted after confirmation of any redemption.
7.2     The Winner cannot take a minor as a companion under any circumstances.  
7.3      The Prize does not include any other item or expense not specifically described in these Terms and Conditions, and all additional expenses, if any, are the sole responsibility of the Winner.  Prize may not be transferred or assigned except by the Promoter. Only the listed Prize will be awarded and no substitutions or cash equivalents or redemption will be made, except that the Promoter reserves the right to award a Prize of equal or greater value if any advertised Prize (or any component thereof) becomes unavailable, subject to legislative approval.  Prize cannot be used in conjunction with any other promotion or offer.
7.4       The Prize is subject to booking, availability and any terms and conditions imposed by the relevant providers. Winner and any travelling companion must depart and return at the same time using the same air carrier. Winner and any travelling companion are responsible for ensuring they have all necessary travel insurance (it is not included in the Prize) and documents to travel to the relevant place(s) (including passports and visas). Any alterations or extensions to Prize details must be approved in advance by the Promoter (at its sole discretion) and will be at the expense of Winner. The Promoter is not responsible for the cancellation, delay or rescheduling of any part of a travel or accommodation component of Prize and any costs incurred by Winner or any travelling companion as a result (including accommodation costs) will be the responsibility of the Winner.  Winner is responsible for ensuring that they and their travelling companion are fit to travel and have received appropriate immunizations and/or health checks prior to taking the Prize.
7.5       Unless expressly stated in these terms and conditions all other expenses related to the Prize become the responsibility of the Prize Winner and their nominated companion. All costs associated with the Prize which are not expressly stated in these Terms and Conditions to be included, including but not limited to ground transportation, meals, gratuities, incidental hotel expenses additional to spending money, passport and visa costs, transfer costs, insurance, luggage costs and all other ancillary costs, are the responsibility of the Winner.
7.6       No compensation or alternative travel plans will be arranged should the Prize winner and/ or their companion miss their outbound or return flights or fail to meet any check in requirements for any reason. These costs will be the responsibility and expense of the prize winner and companion. The Promoter is not responsible for any costs associated with flights that are cancelled or delayed for any reason, including but not limited to accommodation and transfer costs. The Promoter is not responsible if cancellation or delay of flights causes the prize winner and companion/s to miss the Eco tour that makes up part of this prize.            CONT/4

 8.         HOW TO WIN 8.1       The winner will decided by a jury of judges nominated by Nuttelex drawn on 10 th January                    2020 at 10 am at Nuttelex Pty Ltd, 2 Millennium Court Knoxfield VIC. 3181 8.2       The Winner will be notified by Facebook or Instagram Messenger within 2 days of the draw, and      Winner’s name will be published on the competition page on the Nuttelex website. 8.3       Nuttelex’s  decision is final and will not enter into correspondence regarding the result. 8.4       It is a condition of accepting the prize that the winner (and any companion) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 8.5       The Promoter may in its absolute discretion deem entries invalid subsequently to a winner being notified or a winner’s name being announced if it is discovered that the winner did not enter the Competition in accordance with these terms and conditions. 8.6.      Subject to state government legislation, in the event that the prize is not claimed within 3 months, an unclaimed prize draw will occur on March 2nd  2020 at 10:00am at Nuttelex Pty Ltd, 2 Millennium Court Knoxfield VIC 3181. The Winner of the unclaimed prize draw will be notified by Facebook or Instagram Messenger and their details published on the Nuttelex website within two days of the draw. 9.         NO LIABILITY 9.1       In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to state government legislation. 9.2      Nuttelex is not responsible or liable for any late, lost or misdirected entries or for any problems or technical malfunction, which may result in delay or failure to enter the competition     9.3      By entering the competition, and by collecting a prize, the winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoter nor Kobe Steele’s Eco tour are responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling.
