Terms and Conditions
Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
The Promoter is Hawai’i Tourism Oceania (Australia) Pty Ltd (ABN 48 107 369 531) of Suite 3, Level 3, 189 Kent Street, Sydney NSW 2000 Australia, telephone (02) 9286 8951.
Entry is open to Australian and New Zealand residents aged 18 years or older.
Employees (and their immediate families) of the Promoter, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The promotion will begin on 16/04/22 and close at 11:59pm AEDST on 30/04/22 (“Promotional Period”). The individual prize will be offered on Instagram with a game of skill component to be entered into by the Eligible Entrant.
To receive an entry into the draw, Eligible Entrants must complete the following steps during the Promotional Period:
(1) Post a photo or video taken on the Hawaiian Islands, AND
(2) Caption the post with the hashtags #IslandsOfAloha and #DreamingOfHawaii, AND
(3) Tag @gohawaiiau in the post
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete, indecipherable, or illegible entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
This is a game of skill and a winner will be selected based on the creativity of their entry. The judging will take place at Suite 3, Level 3, 189 Kent Street, Sydney NSW 2000 within 14 days of the promotion ending. The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant. The winners will be notified by Instagram direct message.
The prizes will be awarded to the best answer to the task outlined in the post on Instagram as determined by the judges. The prize includes but is not limited to;

The Promoter’s decision is final and no correspondence will be entered into.
If for any reason a winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited.
If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
Total prize pool value is up to AUD $2,700.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
The Prizes do not include any ancillary costs associated with taking each Prize including, but not limited to, any travel costs associated with getting to and from the event location, and food or beverage consumed at the event location. For example, if the Eligible Entrant is not resident in that town city, the Eligible Entrant will be required to make their own arrangements to travel to that city. For Eligible Entrants that are resident in a different country to the country in which the event is located, each Eligible Entrant will also need to satisfy all immigration and biosecurity requirements for that country.
As the Prizes are supplied by third party suppliers who are independent of the Promoter, each Prize is subject to the applicable supplier’s terms and conditions, including any applicable age restriction. For further details, please visit the applicable website listed in clause 13 above. The Promoter and each supplier hereby expressly reserve the right to eject any winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the Prize. Hawai’i Tourism Oceania is not liable for any damage to property caused by winners.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, pandemic, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
(a) to disqualify any entrant; or
(b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the social website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
(a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
(b) any theft, unauthorised access or third party interference;
(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(d) any variation in prize value to that stated in these Terms and Conditions;
(e) any tax liability incurred by a winner or entrant; or
(f) taking of the prize.
Hawai’i Tourism Oceania will receive the entrants’ personal data such as name, telephone number, email address and postal address from the entrants for the purpose of their participation in the promotion and the data will only be retained as long as necessary for such purpose. By participating in the Promotion, winners consent that their personal data may, for the same purpose as stated above, also be transferred to Promoter’s third-party contractors including (The Hero Co) as necessary to process the winners’ participation in the Promotion. Receiving a prize is conditional on providing the requested personal data.
The Promoter reserves the right to cancel, suspend, terminate or modify the Promotion if fraud, technical failures or any other factor beyond the Promoter's reasonable control adversely affects the Promoter's ability to conduct the Promotion as contemplated in these Terms and Conditions, subject to state or territory regulation. In such event, the Promoter reserves the right to award the Prizes to one of the eligible entries received up to the time of the cancellation or modification in accordance with the judging criteria set out at condition 12. The Promoter also reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in breach of these Conditions of Entry or in breach of any law. Any attempt by any person to deliberately cause damage or undermine the operation of the Promotion may be a violation of criminal and civil law.
