Competition Terms and Conditions
Your entry and participation in the Competition is conditional upon your agreement to, acceptance of and compliance with the Terms and Conditions set out below (Terms and Conditions). Your submission of an entry into the Competition constitutes your agreement with these Terms and Conditions.

TERMS AND CONDITIONS

The Promoter is Pet Resorts of Australia Pty Ltd (ABN 48 122 613 709)

1. Relevant States and Territories

The Competition is open to NSW & QLD residents ages 18 years and older (Participants)

2. Competition Period

The Competition commences at 12:01am AEST on 1st August 2022 (Commencement Date) and closes at 23:59pm AEST on 31st August 2022 (End Date). The period between the Commencement Date and End Date is the Competition Period

The Competition will be conducted during the Competition Period. To enter the Competition, Participants (as defined in clause 5.1 below) must follow the Entry Methods and Restrictions as set out in these Terms and Conditions and comply with all of these Terms and Conditions during the Competition Period

3. In order to enter the Promotion, participants need to undertake the following steps during the Promotional Period:

       a. Visit the competition entry page

       b. Complete the entry form in full including uploading a photo of your pet

4. Incomplete or indecipherable entries will be deemed invalid

5. Judging will take place between 9:00am and 18:00pm AEST on 5th September 2022 (Draw Date)

This is a game of skill and chance plays no part in determining the winners.  Each entry will be individually judged based on the creative merit of the submitted photo

6.  Total prize pool consists of 3x Pet Resorts of Australia gift vouchers valued at AUD$500 redeemable at a Pet Resorts Australia location of the winners choice. Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash

7.  Any ancillary costs associated with redeeming the gift voucher are not included. Any unused balance of the gift voucher will not be awarded in cash. Redemption of the gift voucher is subject to any terms and conditions of the issuer including those specified on the gift voucher

8.   The judges’ decision in relation to any aspect of the Promotion will be final and binding on every person who enters. No correspondence will be entered into

9.   The prize winners will be notified on the 6th September 2022 by phone

10. The winners must claim their prize by 19th September 2022

11. If the Promoter cannot contact a prize winner, or if a prize does not accept or claim their prize by the Prize Claim Date, that prize winner’s entry will be deemed invalid, and the next best entry, as determined by the judge(s) shall be awarded the prize and notified accordingly

12. Entrants agree that they are fully responsible for any materials they submit via the promotion including but not limited to comments, recordings and images (“Content”). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that:

(a)     they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;

(b)     their Content shall not contain viruses or cause injury or harm to any person or entity;

(c)     they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;

(d)     the Content is the original literary work of the entrant that does not infringe the rights of any third party;

(e)     they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and or communication systems.

13. Entry Restrictions

Employees (and their immediate families) of the Promoter, its related entities, are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

14. Promotion

Entrants consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome).

The Promoter needs to collect the personal information required to be submitted with your Entry so it can enter you in the Competition. The Promoter may use personal information about you for related purposes including sending you information (including electronically) about its products, events, news and further competitions.

16. Disclaimers and Limitation of Liability

Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following:

Any technical difficulties or equipment malfunction (whether or not under the Promoter’s control)
Any theft, unauthorised access or third-party interference
Any claim or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter
Any tax liability incurred by a Participant; or use of the Prize
The Promoter and its associated entities shall not be liable in any way if the performance of obligations hereunder is delayed or becomes impossible by reason of any act of God, war, fire, earthquake, strike, sickness, accident, civil commotion or any other cause
The Promoter is not responsible for:
any malfunction, delay or traffic congestion on any computer on-line system, servers or providers, computer equipment, software, or website
any failure of any email or Entry to be received by the Promoter
any injury or damage to Participants or any other person related to or resulting from participation in the Competition
