TERMS AND CONDITIONS
Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions. By submitting an entry to this competition, entrants agree to be bound by these terms and conditions. In the event of any inconsistency between these terms and conditions and any other published material, these terms and conditions prevail.

The Promotor is Michael Hill Jeweller (Australia) Pty Ltd ACN 003 181 333 of 34 Southgate Avenue, Cannon Hill QLD 4170, Australia.  

Entry is open to persons over the age of 18 years, legally and ordinarily resident in Australia and who are members of Michael Hill’s Brilliance loyalty program. Directors and employees of the Promoter and its affiliate companies, and their immediate families, are ineligible to enter.

Competition Period. The competition commences on 17 October 2022 at 12:01 am AEST and concludes on 13 November 2022 at 11:59 pm AEST. All entries must be received by the promoter during this period.

Entry to Competition

To enter: (i) Register for, or sign into your existing, Michael Hill Brilliance account on michaelhill.com.au, and (ii) add at least one item to your 'Wishlist' during the Competition Period. Some items displayed on the website may not be available to add to your Wishlist. Membership to Michael Hill’s Brilliance program is subject to the Brilliance terms and conditions available on the registration site located at michaelhill.com.au/brilliance.If you have an existing Wishlist on your Michael Hill Brilliance account prior to the Competition, you must add at least one further item to your Wishlist during the Competition Period to be eligible to participate.

One entry per Michael Hill Brilliance member. You can add as many items as you wish to your Wishlist over the Competition Period however all items will only constitute one entry per person.

If any items which you have added to your Wishlist during the Competition Period are removed automatically for any reason whatsoever (including as a result of stock depletion or the item being discontinued), your entry will remain valid.

There is no cost to enter this competition, however, each entrant must have access to internet facilities in order to complete the entry requirements.

The time of entry will in each case be the time the item is added to the entrant's Wishlist. The Promoter accepts no responsibility for any late, lost, or misdirected entries due to technical disruptions, network congestion, or for any other reason.

Any entry that is made on behalf of an Entrant by a third party will be invalid.

Prize

There is a total of one prize consisting of one$2,500eGift Card to use in-store or online. Use of the eGift Card is subject to Michael Hill’s Gift Card terms and conditions which are available at michaelhill.com.au/gift-card-terms.Any ancillary costs (excluding postage) associated with redeeming the prize are not included which will be the responsibility of the winner. Prize cannot be transferred or redeemed for cash, except at Promoter’s sole discretion.  

Reservation of rights and limitation of liability

The Promoter, reserves the right, in its absolute discretion, to verify the validity of all entries and to disqualify any entrant if: (a) any of the requested information on the entry is incomplete; or (b) the Promoter suspects the entrant has tampered with the entry process, or submitted an entry that is not in accordance with these terms and conditions; or (c) if the Promoter considers that the entrant has engaged in conduct that is fraudulent, misleading, deceptive, or which may damage the goodwill or reputation of the Promoter, or which may jeopardise the fair and proper conduct of the competition. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address, and/or proof of entry validity (including email address) in order to claim a prize. Proof of identification, residency, and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

The Promoter accepts no responsibility for any tax liabilities that may arise from winning the prize. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

Once prizes have left the Promoter’s premises or the dispatch point operated by a third party under the Promotor’s instructions, the Promoter takes no responsibility for prizes damaged, delayed, or lost in transit.

By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed, photographed, and filmed. The winner acknowledges that the Promoter is free to use any resulting works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.

In the case of the intervention of any outside act, agent, or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any directions given under any applicable law.

The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

The Promoter and its associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

Draw of Winner

The draw will be conducted, in the presence of an independent witness, at 34 Southgate Avenue, Cannon Hill QLD 4170, Australia, on Friday 18 November 2022at 12:00 midday (AEST).

Winners will be notified by email within five (5) business days of the draw and must follow the instructions contained in the notification to claim a prize. Winners will have their first initial and last name published online at michaelhill.com.au/win. If you have any concerns about having your name published in this manner please contact us as soon as we notify you that you are a winner.  

Prizes will only be awarded to the person named in the entry.  

Should an entrant’s contact details change during the Competition Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

Subject to any direction given under relevant State legislation, an unclaimed prize draw will take place at the Promoter’s offices located at 34 Southgate Avenue, Cannon Hill QLD 4170, Australia on Wednesday Monday 5 December 202212:00 midday (AEST). Any redraw winner will be notified by email on Wednesday 7 December 2022 and their first initial and last name will be published online at michaelhill.com.au/win. If you have any concerns about having your name published in this manner please contact us as soon as we notify you that you are a winner.

The Promoter’s decision is final and the Promoter will not enter into correspondence regarding its decision. The Promoter accepts no responsibility for late, lost, or misdirected entries or other communications including as a result of technical difficulties or fault in the transmission. Entries will be deemed void if forged, manipulated, or tampered with in any way. Entries not submitted in accordance with these terms and conditions will be invalid.

It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

Privacy

The Promoter will collect and use your personal information to conduct this competition and for other purposes set out in the Promoter’s Privacy Policy available at micahelhill.com.au/privacy.The Promoter’s Privacy Policy describes how it manages your personal information and complies with its obligations under applicable privacy laws. It also tells you how you can access your information, have it corrected, or make a complaint.  

In consideration of being awarded the prize, the winner agrees that the Promoter may use the winner's name, image, likeness, voice, or quote for any purpose, including for marketing and promotion purposes anywhere in the world and in any form of media. The Promoter may require you to agree to this in writing in the form of a release in a reasonable format, in which case, being awarded the prize is conditional upon you signing that release.
