Instructions and information about this game of skill promotion and how to enter form part of these Terms and Conditions. Submitting an entry is deemed acceptance of these Terms and Conditions. Nothing in these Terms and Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
Participation in this promotion is only open to permanent Australian residents aged 18 years or over. Employees and officers (and their immediate families) of the Promoter, participating pharmacy retailers and agencies associated with the Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Entrants must retain their original Qualifying Purchase receipt as proof of purchase. Proof of purchase must clearly specify the product purchased, the store of purchase and that the purchase was made during the Promotional Period but prior to the entry.
The Promoter may disqualify, and prohibit further participation in this promotion by, any entrant who the Promoter reasonably believes has submitted an entry that is not in accordance with these Terms and Conditions or who: (a) manipulates or tampers with the entry process in any way (including, but not limited to soliciting votes, disguising an IP address, using multiple email addresses or aliases to submit multiple entries for the same person, or other electronic account); or (b) acts in a disruptive or dishonest manner, or otherwise with the intent to annoy, abuse, threaten or harass any person involved in the promotion or to jeopardise the fair operation of the promotion.
Prizes: The best ten (10) valid entries determined by the judges will each win an electronic EFTPOS gift card worth $500 (Gift Cards). Gift Cards are valid for 36 months (3 years) until December 2025. Gift Cards are subject to the terms and conditions imposed by the card provider which are available at: https://www.eftpos.gift/homepage#faqs Gift Cards are not transferable or exchangeable and cannot be redeemed for cash or for further vouchers. Gift Cards cannot be used in conjunction with any other discount, coupon or offer. Where a Gift Card is unavailable for any reason, the Promoter may substitute it for another item of equal or higher value determined at its sole discretion, subject to the approval of the gaming authority in each State and Territory, where required (Substitute Prize).
Judging: The judging will take place on 13/12/2022 at 45 Jones St, Ultimo NSW 2007 Australia. The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant. The judging panel will be looking for the most creative and original responses. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on literary and creative merit of the answer provided to the promotional question, as well as the quality of the response and how well the response is articulated.
Winners: The winners will be notified on 22/12/2022 by email and by telephone, to the email address and contact phone number provided on their entry form. Each winner’s name and State or Territory of residence will be published on www.neutrogena.com.au/summeressentials2022 on 23/12/2022 By entering this promotion, each entrant requests that his or her full address not be published if they are a winner. The Promoter will verify the identity of all winners before any prize is awarded. Gift Cards will be sent by email to each winner to the email address provided on their entry form, within 28 days of 22/01/2023. If a winner does not take or accept a Gift Card or Substitute Prize at the time stipulated by the Promoter, it will be forfeited. Only one Gift Card (or Substitute Prize, as applicable) per entrant will be awarded. If an entrant wins more than once, the first Gift Card (or Substitute Prize) won will be awarded and the remaining will be awarded to the entrant(s) with the next best valid entry determined by the judges. Each winner must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding winning, free of charge, and they consent to the Promoter using their name and image in promotional material in any medium throughout the world.
Redraw: If either: (a) a winning entry is deemed not to comply with these Terms and Conditions; or (b) a Gift Card or Substitute Prize is not accepted or claimed within 3 months of 23/12/2022, the relevant entry will be deemed invalid, and the entrant with the next best valid entry determined by the judges will be awarded the prize and notified accordingly. Any such winner’s name and State or Territory of residence will be published on www.neutrogena.com.au/summeressentials2022 on 13/02/2023. If there are any unclaimed Gift Cards or Substitute Prizes, each will be distributed to the next best valid entry determined by the judges until all prizes are awarded.
Entrants agree that they are fully responsible for their entries and the Promoter shall not be liable in any way for the statements, representations or other material contained in any entries to the full extent permitted by law. The Promoter may remove or decline to publish any entries without notice for any reason whatsoever. Entrants warrant and agree that:
a. they will not submit any entry that is or contains content which is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, [Censored]ographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
b. they will not submit any entry that is or contains a virus or which may cause injury or harm to any person or entity;
c. their entry is the original literary work of the entrant that does not infringe the rights of any third party;
d. they consent to any use of their entry, or any part of it, which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and or communication systems.
The Promoter reserves the right, at any time, to verify the identity of any entrant and the validity of any entry including proof of purchase. The Promoter will verify the identity of all winners before any prize is awarded. Failure to produce verfiying information or documents to the Promoter on request may, in the absolute discretion of the Promoter, result in invalidation of an entry and forfeiture of any right to any prize. What constitutes sufficient information or documents to verify an entrant’s identity will be determined by the Promoter in its sole discretion.
Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The judges’ decision in relation to any aspect of the promotion is final and no correspondence will be entered into.
Incomplete, ineligible, indecipherable, late or illegible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible or misdirected entries, entries or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telecommunications, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
All entries, barcodes and receipts received by the Promoter, become the property of the Promoter. As a condition of entering this promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry or any part of it for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
Any costs associated with participating in this Promotion (including registering online and submitting an entry) are the entrants’ responsibility.
If for any reason beyond the reasonable control of the Promoter any aspect of this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated (including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion) the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; (b) invalidate any entries; or (c) to modify, suspend, terminate or cancel the Promotion, as appropriate, subject to the approval of the gaming authority in each State and Territory, where required.
The Promoter accepts no responsibility for any tax implications that may arise from the receipt of any prize. Independent financial advice should be sought. Where the operation of this promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
Except for any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a claimant; (e) participation in the Promotion including submitting an entry which does not comply with these Terms and Conditions; or (f) use of a Gift Card or Substitute Prize.
