Terms And Conditions
Introduction
In these Terms and Conditions, the following words have these meanings, unless the context otherwise requires:

“Budget Direct Motorcycle Insurance” means a Motorcycle insurance product issued by the Insurer.

“Commencement Date” means 26 October 2022.

“End Date” means 30 June 2023.

“Entry Website” means www.budgetdirect.com.au/landingpages/win-an-indian-motorcycl...

“Promoter’s Draw Website” means www.budgetdirect.com.au/terms-conditions/win-an-indian-motor...

“Unclaimed Gift Draw Date” means 28 April 2023, 31 July 2023 and 30 October 2023

Budget Direct Motorcycle Insurance is arranged by Auto & General Services Pty Ltd (Promoter) (ABN 61 003 617 909, AFSL 241 411 Registered Office: 13/9 Sherwood Rd, Toowong 4066) on behalf of the insurer, Auto & General Insurance Company Limited ABN 42 111 5 86 353 (Insurer).

Subject to these Terms and Conditions the Promoter is giving persons the chance to win one (1) of three (3) new Indian FTR R Carbon Motorcycles including on road costs (RRP $25,995 each & Total Prize value $77,985) (each a Gift) when they complete an online form, obtain a new Budget Direct Motorcycle Insurance quote from Budget Direct, or purchase a new Budget Direct Motorcycle Insurance policy as set out under the heading “Eligibility and Participation” (Promotion). One (1) Gift will be drawn for each Prize Period on the Draw Date as set out below:

Any offer of Budget Direct Motorcycle Insurance is subject to the Insurer deeming that the risk is acceptable in accordance with its underwriting criteria. Any advice is general only and doesn't consider an individual’s needs. Before purchasing a policy, a prospective customer needs to consider if the product is right for them by reading the Product Disclosure Statement, Target Market Determination and Financial Services Guide.

Information on how to enter, mechanics of entry and prizes form part of these Terms and Conditions. Entry into the Promotion is deemed acceptance of these Terms and Conditions. If there is any conflict between these Terms and Conditions and any other published material, these Terms and Conditions prevail.

The Promotion commences at 12:01am AEST on the Commencement Date and ends at 11:59pm AEST on the End Date (Promotion Period). Despite the Promotion Period, the Promoter may elect to cease the Promotion at any time in its sole discretion

Entries into each Prize Period draw will open at 12.01am on the on the start date of each Prize Period and finish at 11.59pm on the end date of each Prize Period. For the avoidance of doubt, entries in each Prize Period draw will not be entered into subsequent Prize Period draws

Eligibility and Participation
In order to be eligible for the Gift, the customer must meet all of the following criteria (Eligible Participant):

be an Australian resident aged 18 or over at time of entry;

provide a valid email address;

not be an officer or employee of the Promoter, its related bodies corporate, or their immediate family; and

during the Promotion Period:

complete the online competition entry form on the Entry Website (Form Entry); or

obtain a quote for a new Budget Direct Motorcycle Insurance policy through Budget Direct’s website or over the phone by calling 1300 306 560 and fully and accurately complete the online entry form at the conclusion of the quote (Quote Entry); or

purchase a new Budget Direct Motorcycle Insurance policy through Budget Direct’s website or over the phone by calling 1300 306 560; and

ensure the new Budget Motorcycle Insurance policy purchased pursuant to clause 7(d)(3) remains active and valid for a period not less than 21 days from the purchase date (collectively under clause 7(d)(3) and this clause, Policy Entry).

Eligible Entrants will be awarded a maximum of:

one (1) entry into the Promotion for completing the Form Entry in a relevant Prize Period. The entry will only be included in the draw for the Prize Period in which it was completed. Additional entries will not be awarded for multiple Form Entry’s in any one Prize Period. The maximum number of entries into the Promotion that could be awarded for Form Entry’s is three (3), being one (1) in each Prize Period.

five (5) entries into the Promotion for completing the Quote Entry in a relevant Prize Period. The entry’s will only be included in the draw for the Prize Period in which it was completed. Additional entries will not be awarded for multiple Quote Entry’s in any one Prize Period. The maximum number of entries into the Promotion that could be awarded for Form Entry’s is fifteen (15), being five (5) in each Prize Period.

ten (10) entries into the Promotion per Policy Entry during the Promotion Period. Additional entries will be awarded for multiple Policy Entry purchases.

If the Eligible Entrant completes a Quote Entry, they will also have completed the Form Entry. For avoidance of doubt, if the Eligible Entrant completes a Quote Entry they will receive five (5) entries into the Promotion for completing the Quote Entry and also, an additional one (1) entry into the Promotion for completing the Form Entry. Where the Eligible Entrant completes a Quote Entry and receives the Form Entry, further additional entries will not be awarded for Form Entry’s in any one Prize Period.

Entries will be deemed accepted at the time of receipt by the Promoter. Entries received will be considered final by the Promoter.

For avoidance of doubt, if a person wins a Gift, they become ineligible to win any further Gift.

For the avoidance of doubt this Promotion is only open to customers purchasing a new policy for the purposes of the Policy Entry, not customers renewing their policies with Budget Direct.

Draw and Prizes
The Gift draw will take place at 10:30am (AEST) on each Draw Date at Suite 2, Level 2, 105 Reservoir Street, Surry Hills NSW 2010

A Gift winner will be notified via their nominated email address within two (2) business days of each Draw Date. The Gift winner will be published on the terms and conditions page of the Promoter’s Draw Website within twenty-one (21) days of the applicable Gift draw and will remain on the Promoter’s website for no less than twenty-eight (28) days. All reasonable steps will be taken by the Promoter to notify the Gift winner.

The Promoter may draw five (5) additional reserve entries on each Draw Date and record them (in order) in case of an invalid entry or the entrant is ineligible to accept the Gift. In the event of an invalid entry or an ineligible entrant, or if the entrant declines to accept a Gift, the Gift will be awarded to the first reserve entry drawn. If a Gift cannot be awarded to an entrant drawn, the Promoter will continue this process until the Gift is awarded. If after this process, a Gift has still not been awarded, or if an entrant drawn cannot be notified, the Promoter will hold an unclaimed gift draw in accordance with the below clauses.

A Gift will be deemed unclaimed if the Promoter is not reasonably able to contact a Gift winner within three (3) months and one (1) day of each Draw Date via the contact details provided at the time of completing the Entry.

An unclaimed gift draw will be held in order to distribute any Gifts that remain unclaimed, at Suite 2, Level 2, 105 Reservoir Street, Surry Hills NSW 2010, subject to any written directions made under applicable State or Territory Legislation, at 10:00AM (AEST) on the Unclaimed Gift Draw Date.

Any unclaimed Gift winner will be notified via their nominated email address, within two (2) business days of the relevant Unclaimed Gift Draw Date. Each Unclaimed Gift winner’s name will be published on the terms and conditions page of the Promoter’s Draw Website on the Unclaimed Gift Draw Date and will remain on the Promoter’s website for no less than twenty-eight (28) days. All reasonable steps will be taken to notify the winner of the unclaimed Gift draw.

Privacy Statement and Marketing Consent
The Promoter is committed to protecting Personal Information and agrees to be bound by the Privacy Act 1988 (Cth). The Promoter’s privacy policy is available on the website www.budgetdirect.com.au and further details of how the Promoter will collect, store, use and disclose Personal Information can be found there. In these Terms and Conditions, Personal Information has the meaning given to it in the Privacy Act 1988 (Cth).

Personal Information is collected in connection with entry into this Promotion for the purpose of facilitating access to the Gift. If the Personal Information requested is not provided, then a person will be ineligible to participate in this Promotion. By entering into the Promotion, the customer consents to the Promoter disclosing the Personal Information to the Gift supplier, and to any of the Promoter’s related entities, using the Personal Information to process and validate the customer’s claim for the Gift, and to arrange delivery to the customer (if eligible).

By entering the Promotion, entrants acknowledge that a further primary purpose for collection of the entrant’s Personal Information is to contact the entrant in the future with information about the Promoter, including special offers, market research or to provide marketing materials via any medium including mail or any other form of non-real time electronic, emerging, digital or conventional communications channel whether existing now or in the future.

The Promoter will never sell an entrant’s Personal Information to other companies, however the Promoter may share an entrant’s Personal Information with its Australian and overseas related bodies corporate, promotional partners, servants, employees, agents and trusted third parties who may contact the entrant for their legitimate commercial purposes. By entering the Promotion, entrants acknowledge and agree that the Promoter and any applicable third parties may use their Personal Information in the manner set out in this condition.

General
This Promotion is not available in conjunction with any other promotion or offer, and the Promoter reserves the right to disqualify any person from receiving the Gift if any of the following occurs:

If it suspects fraudulent activity; or

for a breach of these Terms and Conditions; or

if it decides the person has not acted in good faith; or

for any false or misleading conduct of any kind.

The Gift is not refundable, reloadable, transferable or exchangeable and cannot be taken as cash. If a Gift or receipt of it incurs a tax liability, the relevant recipient of the Gift Card is liable for payment of such tax.

The Promoter is not responsible for, or liable in respect of, products and services provided by the Gift supplier.

The Promoter reserves the right in its sole discretion or subject to any written directions from a regulatory authority, to modify, suspend, terminate, withdraw, or cancel the Promotion at any time without notice. The Terms and Conditions may be varied at any time without notice.

If the offer of the Gift is withdrawn or the Promotion terminated by the Promoter, the Eligible Participant will only be eligible for the Gift after the withdrawal or termination date if the offer was applied while the offer was still in market and Promotion active.

The Promoter reserves the right to request that an Eligible Participant provides supporting documentary evidence of their identity (e.g. driver’s licence, passport, birth certificate). If the Eligible Participant fails to do so, or the Promoter determines the policy does not meet the eligibility criteria of the offer, the Eligible Participant will not be eligible for the Gift.

The Promoter and/or Insurer (including their officers, employees and agents) will not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) including any theft, unauthorised access, third party interference, any technical difficulties or equipment malfunction, or personal injury (including loss of opportunity) suffered or sustained in connection with the Promotion, or the receipt, acceptance, or use of the Gift (whether negligent or not), except for any liability that cannot be excluded by law.

The Promoter reserves the right to substitute the Gift with another incentive of the same value.
