HOW TO ENTER

1. Spend $15 or more in one transaction at any St Marys Village retailer,

2. Write your full name, phone number, email address and postcode on the back of your receipt,

3. Place the receipt in the competition box located in front of the Kmart hoarding.

 

Every Friday, starting 17th March 2023, 4 entries will be drawn to each win $100 in St Marys Village Gift Vouchers.

The competition box will be emptied every week into the Grand Prize barrel to go in the draw to win an MG ZS Excite

The draw for the MG ZS Excite will be held on the morning of the Kmart grand opening and the winner must be present to claim the prize.

Terms & Conditions
1 Preliminary
1.1 Defined terms
In these T&Cs, capitalised words and expressions
have defined meanings. Those defined meanings
are set out in the Dictionary at the end of these
T&Cs.
1.2 About these T&Cs
These T&Cs:
(a) set out the rules of the Competition, and
specifically:
(i) what the Competition is, and what
Prizes may be won through the
Competition;
(ii) how You may become eligible to
win Prizes, and how to enter the
Competition; and
(iii) how We will announces winners
of Prizes;
(b) apply to You if You enter the Competition,
and if You enter the Competition, You are
deemed to have agreed to be bound by
these T&Cs;
(c) contain all the terms and conditions
applicable to the Competition, and no other
terms, conditions, rule and/or regulations
will apply to the Competition unless they
are contained in these T&Cs; and
(d) prevail over any marketing or promotional
material for the Competition distributed or
published though any means or medium.
2 The Competition
2.1 Promoter
We are the promoters of the Competition under
NSW permit number TP/02401.
2.2 Description of Competition
Subject to these T&Cs, the Competition is a game
of chance which allows Eligible Competitors to win
Prizes. Skill plays no part in determining winners of
Prizes. Winners will be randomly drawn in
accordance with clause 4.
2.3 Competition Period
The Competition:
(a) commences at 9:00am (AEST) on 10
March 2023; and
(b) closes at 5:00pm (AEST) on the date being
one day prior to the Kmart Store grand
opening, which as at the date of publication
of these T&Cs is anticipated to be 31 July
2023.
2.4 Prizes
(a) Subject to these T&Cs, Eligible
Competitors who enter the Competition
may win the following prizes:
(i) a Gift Voucher; and/or
(ii) the Motor Vehicle.
(b) The total value of the Prizes is $30,760.24.
This amount is (as applicable):
(i) the recommended retail value as
provided by the supplier of the
Motor Vehicle;
(ii) in Australian dollars; and
(iii) current as at the commencement
of the Competition Period.
(c) If for any reason, the Motor Vehicle is not
available, We reserve the right to, and may
in Our absolute discretion, substitute that
Prize with another prize of comparable
value.
(d) The Prizes are not transferable and not
redeemable for cash or credit or any other
type of payment.
3 Entering the Competition
3.1 General eligibility criteria
To be eligible to win:
(a) a Gift Voucher, You must:
(i) be a natural person;
(ii) be at least 18 years of age or
older;
(iii) be ordinarily resident, and
lawfully permitted to reside in
New South Wales; and
(iv) not be one of Our Related
Persons; and
(b) the Motor Vehicle, You must:
(i) meet the eligibility criteria
specified in clause 3.1(a);
(ii) hold, or be eligible to hold, a
drivers licence in Australia; and
(iii) be eligible to have the Motor
Vehicle registered in Your own
name in New South Wales.
3.2 Competition entry method
If You are an Eligible Competitor, You may enter the
Competition by doing all of the following things
during the Competition Period:
(a) spend $15.00 or more in any one
transaction at a Retailer;
(b) obtain a Receipt from that Retailer for that
transaction;
(c) clearly and legibly write all of the following
information on the Receipt:
(i) Your full name;
(ii) Your e-mail address;
(iii) Your phone number; and
(iv) Your postcode; and
(d) place that Receipt, which has Your details
written on it, in the Barrel located outside
the Kmart Store hoarding at the Centre.
3.3 Number of Entries
Each Receipt that complies with the requirements of
clause 3.2 shall constitute one Entry. You may make
more than one Entry, and there is no limit on the
number of Entries You may make.
3.4 Our rights
(a) We reserve the right to, and may in Our
absolute discretion:
(i) verify Your eligibility and any of
Your personal information,
including Your identity, age and
place of residence;
(ii) verify the validity of Entries,
including by requiring You to
provide satisfactory proof of
payment in respect of a Receipt;
(iii) disqualify any person from
eligibility for the Competition for:
(A) tampering with the entry
process, including the
Barrel; or
(B) making a misleading,
offensive or
discriminatory Entry,
and such disqualified person may
also be disqualified from any
future competitions or promotions
promoted by Us;
(iv) accept errors, omissions or
alterations in an Entry, or deem
as being invalid any Entry which
is incomplete, indecipherable, or
illegible;
(v) accept any Entries which are not
made within the Competition
Period, or do not otherwise strictly
comply with these T&Cs; and/or
(vi) change the location of the Barrel,
provided that the Barrel is at all
times located within the Centre.
(b) We accept no liability or responsibility for
Entries which are:
(i) made outside the Competition
Period;
(ii) lost; or
(iii) misdirected.
(c) We are not obliged or required to notify
You or give You reasons for any thing We
do or do not do under or in connection with
clause 3.4(a).
4 Winning Prizes
4.1 Weekly draw for Gift Vouchers
(a) On or about 9:00am on each Friday during
the Competition Period, We will collect all
Entries in the Barrel and take all Entries to
Our registered office.
(b) From all Entries collected under clause
4.1(a) for the relevant week, We will
randomly draw four valid Entries.
(c) For each valid Entry drawn in accordance
with clause 4.1(b) one Gift Voucher will be
awarded to the corresponding Eligible
Competitor.
(d) An Eligible Competitor does not need to be
present for the draw under clause 4.1(b) to
claim a Gift Voucher.
(e) We will, within two days of each draw
under clause 4.1(b), contact each winner of
a Gift Voucher using the contact details
provided on the Entry to arrange delivery
or collection of the Gift Voucher. If a Gift
Voucher remains unclaimed for a period of
seven days of Us notifying the winner, then
We may conduct a further draw for the
unclaimed Gift Voucher, in any manner We
consider appropriate, provided that the
winner of such redraw is selected
randomly.
(f) All Entries collected under clause 4.1(a)
(including all winning Entries drawn under
clause 4.1(b) or redrawn under clause
4.1(e)) will be placed into the major draw to
be drawn under clause 4.2. For the
avoidance of doubt, a winning Entry under
this clause 4.1 will remain valid Entry for
drawing as a winning Entry under clause
4.2.
4.2 Major draw for the Motor Vehicle
(a) On or about 10:00am on Monday, 31 July
2023, and at the Kmart Store, We will
randomly draw one valid Entry from all
Entries made during the Competition
Period. You acknowledge that this draw is
intended to coincide with the Kmart Store
grand opening, and if the Kmart Store
grand opening is moved to another date,
We may, in Our absolute discretion,
conduct this draw on such date that the
Kmart Store conducts its grand opening.
(b) An Eligible Competitor must be physically
present at the drawing conducted under
clause 4.2(a) to claim the Motor Vehicle. If
that person is not present at that time:
(i) that person shall not be entitled to
claim the Motor Vehicle, and shall
forfeit any entitlement they have
or may have to the Motor Vehicle;
and
(ii) We will draw another valid Entry,
and the redraw under this clause
4.2(b) may be done any number
of times until an Eligible
Competitor validly claims the
Motor Vehicle.
(c) The Eligible Competitor who validly claims
the Motor Vehicle in accordance with
clause 4.2(b) will be awarded the Motor
Vehicle.
(d) We will do all things necessary (including
signing documents) to ensure that the
registration to the Motor Vehicle is
promptly transferred to the winner of the
Motor Vehicle. For this purpose, the winner
must provide to Us all documents and
information reasonably required.
(e) If You are the winner of the Motor Vehicle:
(i) You accepts the Motor Vehicle as
stated and no compensation will
be payable if You are unable, for
any reason, to use the Motor
Vehicle as stated or intended;
(ii) upon taking possession of the
Motor Vehicle, You assume all
risk in respect of the Motor
Vehicle, and We shall not be
responsible for any damage, loss
or theft in respect of the Motor
Vehicle thereafter; and
(iii) You must not, without Our prior
written consent, sell or transfer
registration of the Motor Vehicle
to another person within 12
months of taking possession of
the Motor Vehicle from Us, and
We may require You, as a
precondition of giving You
possession of the Motor Vehicle,
to enter into an agreement with
Us to this effect and otherwise on
terms and conditions determined
by Us in Our absolute discretion.
4.3 Our rights
We reserve the right to, and may in Our absolute
discretion:
(a) refuse to award any Prize to any person
who fails to comply with these T&Cs, and
for this purpose:
(i) We may, in Our absolute
discretion, determine what
information We require to verify
Your compliance with these
T&Cs;
(ii) if You do not satisfy Us of Your
compliance with these T&Cs
within seven days of Us
requesting You to do so, We may
at any time thereafter refuse to
award a Prize to You; and
(iii) if We refuse to award a Prize to
You, then You forfeit Your
entitlement to the Prize in whole
and no substitute or
compensation will be offered; and
(b) agree or not agree to transfer the
registration of the Motor Vehicle to any
person nominated by the winner of the
Motor Vehicle.
4.4 Other matters
(a) Except to the extent expressly set out in
these T&Cs and being expressed as
included in a Prize, all taxes, costs, fees,
charge and other expenses of or
associated with any Entry (including the
making of an Entry), and/or wining or
claiming a Prize are Your responsibility.
Without limitation, such amounts may
include government fees, charges, levies
and taxes, motor vehicle and third party
insurances, dealer delivery fees, and all
other amounts incidental and/or ancillary,
and directly and/or indirectly arising from
taking a Prize.
(b) An Eligible Competitor may win more than
one Prize.
(c) No bonus prizes will be awarded under the
Competition.
5 General
5.1 Your own enquiries
You must make and rely on Your own enquires of
the Prizes. We make no representations or
warranties in respect of any matters arising from or
in connection with the Competition, and specifically
in respect of the Motor Vehicle.
5.2 Exclusion of Liability
We are not responsible for late, lost, misdirected,
incomplete, illegible, or unintelligible entries,
messages or post, or any other communications,
failures or circumstances affecting, disrupting or
corrupting the lodgement of any Entry in any manner
including without limitation, receipt of Entries, Your
ability to participate in the Competition, winner
notification or winner response to notification.
5.3 Our rights
If We do not exercise any of Our rights under or in
connection with these T&Cs at any stage, that does
not constitute a waiver of Our rights.
5.4 Interreference
If the Competition is interfered with in any way or is
not capable of being conducted as reasonably
anticipated due to any reason beyond Our
reasonable control, We reserves the right, in Our
sole discretion, to the fullest extent permitted by law
to:
(a) disqualify any person from being an
Eligible Competitor; or
(b) modify, suspend, terminate or cancel the
Competition, as appropriate.
5.5 Complaints & disputes
(a) If You have a complaint about anything in
relation to the Competition, You must lodge
Your complaint in writing to the email
address or postal address specified in
clause 5.6.
(b) We will endeavour to promptly resolve any
complaint You make. You accept that We
may make any decision, which We
consider reasonable, in respect of any
complaint You make. You also accept that
it is reasonable for Us to make any such
decision solely on the basis of these T&Cs
and Our commercial interests.
(c) The Competition and these T&Cs are
governed by the laws of New South Wales.
You agree that the law of New South
Wales apply to any dispute in relation to
the Competition and these T&Cs.
5.6 Enquiries

5.7 Privacy
By entering into or attempting to enter the
Competition, You consent to Your personal
information being handled as outlined in this clause
5.7. We collects personal information in order to
conduct the Competition and may, for this purpose,
disclose such information to third parties, including
but not limited to agents, contractors, service
providers and Prize suppliers. We may, for an
indefinite period, unless otherwise advised, use the
information for promotional, marketing (including
providing You with information about other services
and products), publicity, research and profiling
purposes, including sending electronic messages to
the Eligible Competitors. If You win a Prize, You
consent to Us announcing or publishing Your name
as a winner of a Prize for publicity purposes.
Collection, use and disclosure of information
collected in connection with this promotion will be
handled in accordance with Our privacy policy which
can be access at

5.8 Jurisdiction
These T&Cs are governed by the laws of New South
Wales, and the non-exclusive jurisdiction of courts
exercising jurisdiction in New South Wales.
Dictionary
In these T&Cs, the following words and expressions have the corresponding meaning:
Word or expression Meaning
Barrel A receptacle marked for the purposes of the Competition, and which We will provide for You to
deposit Your Entry.
Centre The St Marys Village Shopping Centre located at 10 Charles Hackett Drive, St Marys NSW 2760
Competition The competition the subject of these T&Cs.
Competition Period The period specified in clause 2.3.
Eligible Competitor A person who meets the general eligibility criteria specified in clause 3.1.
Entry An entry into the Competition which complies with the requirements specified in clause 3.2.
Gift Voucher A gift voucher or any number of gift vouchers, or other form of store credit, which:
(a) bears a total face value of $100.00 (inclusive of GST); and
(b) may only be used or redeemed at a Retailer.
