Carlton Dry X Live Nation Promotion Terms and Conditions
CUB Pty Ltd (ABN 76 004 056 106), 58 Queens Bridge Street, Southbank VIC 3006. Only Australian residents who are aged 18 or over.
12.01am (AEST) on 08/05/2023 to 11.59pm (AEST) on 04/08/2023.
The competition will run in participating Bottlemart, Sip'n Save and Harry Brown outlets in Australia and Thirsty Camel outlets (Western Australia only) including the online stores of those outlets which are stocking specially marked products (Outlets).

Who can't enter?
Directors, officers, management and employees (and their immediate families) of:
(a) the Promoter; and
(b) the agencies, companies or participating premises associated with this competition.
Entry instructions
To enter, you must:
(a) make a Qualifying Purchase from an Outlet and collect your itemised purchase receipt;
(b) locate the unique code inside the carton of the Qualifying Purchase product; and
(c) then during the Competition Period visit the Website, locate the entry page and fill out and submit the online entry form, including by providing the unique code from inside the Qualifying Purchase packaging and providing all other requested information to enter the major prize draw and to see which instant prize you have provisionally won.
There will be a total of up to 100,000 specially marked Carlton Dry cartons available. Each carton will include 1 unique code.
The Promoter is not responsible if your mobile device/desktop is not sufficiently capable for the purpose of submitting an entry, including having the requisite photograph capability.
How are instant prizes awarded?
All entrants will win a prize. There are up to 100,000 instant win prizes to be awarded via a random computerised drawing system during the Competition Period at iGoDirect Pty Ltd, 41 Stubbs Street, Kensington VIC 3031 (iGoDirect).
How many major prize winners will there be and how will they be chosen?
There will be 1 major prize winner determined in respect of this competition.
There will be 1 draw conducted. The draw will be held at 2pm (AEST) on 16/08/2023 at Gadens, Level 13, 447 Collins Street Melbourne VIC 3000.
The first valid entry drawn randomly from the entries received during the Competition Period will win the major prize.
The Promoter may draw additional reserve entries in a draw and record them in order, in case a winning entry/entrant is deemed invalid or a prize is unclaimed (Reserve Entrants).

Instant win prizes will be sent to each winner's nominated email address as specified on the entry form within 28 days of verification. It is an entrant's responsibility to ensure that they enter their email address correctly. If they fail to enter their email address correctly, the relevant prize will be forfeited.
Any ancillary costs associated with redeeming the Ticketmaster gift card are not included. Redemption and use of the Ticketmaster gift cards is subject to the terms and conditions available at www.ticketmaster.com.au/giftcards, as amended from time to time.
Major prize
The major prize is a VIP concert experience (of the winner's choice) for the winner and 9 adult companions, valued at up to $30,000.

Major prize
If you win the major prize, your prize will be a trip for you and 9 adult companions to attend one Live Nation concert (to see an artist/band of your choice, based on options provided by the Promoter and Live Nation) in any Australian state or territory (depending on where the concert takes place), valued at up to $30,000 (depending on the winner's point of departure and chosen concert destination), and includes:
(a) return economy airfares (including airfare taxes) from your nearest Australian capital city to the Australian airport nearest to your chosen concert and road transfers between the destination airport and the hotel location for you and your companions (flights are not included if you live within 200km of your selected concert location, and if so, you and your companion must make your own way to and from the accommodation at your own cost, or the Promoter may in its absolute discretion provide road transfers. Benefits equivalent to the value of flights will be offered in these circumstances, such as private transfers to the concert, upgrade in accommodation or additional accommodation nights, activities or spending money (as determined by the Promoter in its sole discretion));
(b) corporate box tickets to your chosen concert (subject to availability) for you and your companions including food and hospitality (ticket is valued at $1,000 per person); and
(c) 1 night accommodation (twin share) in a minimum 4 star hotel near (in so far as possible) your chosen concert location for you and your companions (as determined by the Promoter).
Flights, transfers and accommodation is valued at up to $2,000 per person.
The major prize and the concert selected as part of a major prize are subject to ticket and accommodation availability, a pandemic, any travel/government restrictions/directives, border closures, health advice and the like.
The chosen concert must be held within 12 months of the draw date (that is, no later than 16/08/2024).
In the event a concert is cancelled and cannot be rebooked, the Promoter will work with the major prize winner and use best endeavours to book another Live Nation concert for the major winner and their 9 companions to attend (subject to availability), including providing the major prize winner accommodation and travel as required.. The Promoter's travel agent, Mavel Group ABN 99 767 225 342 (the Prizing Agency), will handle all travel, accommodation and ticket arrangements, as required, however bookings will be governed by the conditions outlined in these Terms and Conditions (including, but not limited to, the prize must be redeemed within twelve (12) months of the draw date, for the prize must be taken a single event holiday and cannot be separated into different holiday vacations, and winner and their nominated guests must travel together on the same flights and stay at the same property).
As the major prize winner:
(a) you must work with the Promoter to determine which Live Nation concert you would like to attend (subject to ticket availability) and inform the Promoter which 9 adult companions you would like to attend with you; and

(b) you and your companions must finalise the major prize booking with the Prizing Agency within 4 weeks of claiming your major prize and being verified by the Promoter as a major prize winner.
All travel taken under the major prize will be on set days (as determined by the Promoter and/or the Prizing Agency) and is dependent on the concert selected by the major prize winner. The concert date and travel dates must be within 12 months of the prize draw date. Any unused amount of the major prize remaining at this time will be forfeited.
By accepting or participating in any major prize, your companions accepts these Terms and Conditions.
Total prize pool
The instant prize pool is up to $1,030,000.
The major prize pool is up to $30,000.
The overall total prize pool is up to $1,060,000.
How many times You can enter up to 5 times, provided you only enter once per Qualifying Purchase and can I enter? per unique code. Each entry must be submitted separately in accordance with these
Terms and Conditions.
How and when will the winner/s be informed?
All entrants will get a return online message acknowledging their entry, informing them of which instant prize they have won and how to verify their entry and claim their instant prize.
The major prize winner will be notified by phone and in writing within 5 business days of determination and will have their name and postcode published on the Website on 23/08/2023 for a period of 28 days. To claim the major prize, you must respond to such notification and confirm that you meet the entry criteria as outlined in these terms and conditions.
Proof of purchase
You must keep the following as proof of purchase for all entries:
• original itemised purchase receipt(s).
• unique code/s.
If you don't produce the above proof of purchase for all entries when asked the Promoter may disqualify all of your entries and you will lose any right to a prize.
The unique code/s must be identical to that provided by you with your entry.
Your purchase receipt must clearly identify where the Qualifying Purchase was made, the product/s purchased (which must be/comprise a Qualifying Purchase) and the date of purchase (which must be before you submitted your entry).
If, in the Promoter's opinion, you have shared any proof of purchase with another person, your entries will be invalid and you will lose any right to a prize.
Unclaimed prize/s
There will be no unclaimed instant prizes. All instant prizes will be automatically awarded to winners via email to the email address associated with their entry. It is an entrant's responsibility to ensure that they enter their email address correctly. If they fail to enter their email address correctly, the prize will be forfeited.
Major prize claim date: 5pm (AEST) on 18/09/2023.
Unclaimed major prize determination: 2pm (AEST) on 19/09/2023 at the same location
as the original draw.
If the major prize has not been accepted or claimed by the major prize claim date above or if, after making all reasonable attempts, the Promoter can't contact the major prize winner (or the major prize winner does not contact the Promoter) by the major prize claim date above, the relevant entry will be discarded and the Promoter will re-award the relevant major prize to a Reserve Entrant and/or carry out an unclaimed major prize draw at the date, time and place stated above to randomly distribute the major prize.
Any such major prize winner (Reserve Winner) will be notified by phone and in writing within 5 business days of determination and will have their name and postcode published on the Website on 26/09/2023 for a period of 28 days. Any Reserve Winner will have 2 weeks from the unclaimed major prize determination to claim the major prize, including completing all required paperwork (as determined by the Promoter).
If a major prize winner cannot be found, that information will be published on the Website on 30/10/2023.

Collection and use of your personal information
If you are a winner, you and (if applicable) your companions must take part in all publicity, photography and other promotional activity as the Promoter requires, without any compensation. You/your companions consent to the Promoter using your name/s and image/s in any promotional or advertising activity.
The Promoter may collect your/your companions' personal information directly or through its agents or contractors. The Promoter will use your/your companions' personal information to conduct and manage the competition. The Promoter may disclose your/your companions' personal information to its related companies, agents and contractors to assist in conducting this competition, communicating with you/your companion or storing data. This may include disclosures to organisations outside Australia including in places such as the Philippines, New Zealand, the UK and the Netherlands.
By entering, you consent to the Promoter keeping your personal information on its database to use for future marketing purposes, including contacting you by electronic messaging provided that where required by the Spam Act 2003 (Cth), the Promoter includes a functional unsubscribe facility in each direct marketing communication it sends you that you may use to opt-out of any further such communications and provided that the functional unsubscribe facility complies with the Spam Regulations 2021 (Cth). By entering, you consent to receive email or SMS messages from the Promoter without any functional unsubscribe facility if they relate primarily to the conduct of this competition. .

(a) how to seek access to the personal information the Promoter holds about you and seek correction of the information; and
(b) how to complain about a privacy breach and how the Promoter will deal with such a complaint.

1 These Terms and Conditions incorporate and must be read together with the details outlined in the table above. Information about prizes and how to enter forms part of these Terms and Conditions. By entering, you accept these Terms and Conditions.
Entry
2 Your entry must be received during the Competition Period and will be deemed to be received only when received by the Promoter. Unique codes from any other competition cannot be used for this competition, and are void if copied, forged, stolen or interfered with. If you return a Qualifying Purchase your entry may be deemed invalid at the Promoter's discretion (unless the product is defective). You will receive a return message confirming your entry. The Promoter is not liable for any problems with communications networks. You are responsible for your own costs associated with entering. If you enter using automatically generated entries or multiple phone numbers/email addresses/addresses/aliases, you may be disqualified.
Prizes
3 Prizes and all elements of prizes must be taken as specified, as and when offered and cannot be altered or changed in any way by you or will be forfeited, and if forfeited, the Promoter will not be liable. If you or any of your companion/s forfeit the prize or any element of the prize for whatever reason, you will not be given cash or any alternative prize as a substitute. Prize/s are subject to any additional terms and conditions imposed by the relevant supplier, the Prizing Agency or the Promoter, including, as relevant:
(a) validity period/s;(b) booking and availability of flights, accommodation and events;
(c) conditions of travel and conditions of entry into any event venues (including age restrictions, behaviour requirements, COVID safety requirements and applicable dress codes);
(d) conditions of ticket validity and any restrictions on ticket on-sale or transfer;
(e) travel dates and specified travel exclusion periods;
(f) any additional fees (payable by you) relating to changes made by you/your companion to a travel/event prize after it has been booked; and
(g) a requirement to present your credit card when checking in to accommodation for any incidental charges.
4 In addition to all other specified prize conditions, the major prize is subject to the following additional terms and conditions:
(a) the major prize cannot be separated into multiple travel periods;
(b) travel date availability for the major prize cannot be guaranteed during Australian public holidays, school holidays and special event periods;
(c) the major prize winner and their companions must comply with all travel requirements and conditions of entry for all third-party suppliers, such as hotels, airlines, restaurants, events and activity suppliers. The Promoter and event organisers hereby expressly reserve the right to eject a major prize winner and any of their companions from an event venue for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the major prize;
(d) the major prize winner and their companions must travel together on the same flights and stay at the same accommodation;
(e) no compensation or alternative travel plans will be arranged should the major prize winner and/or their companion/s miss their outbound or return flights, or fail to meet any check-in requirements for any reason. Any costs incurred in these circumstances will be the responsibility and expense of the major prize winner and their companion/s;
(f) if applicable, the major prize winner must provide their bank account details (or account name and postal address for cheque) in order for any spending money portion of the major prize to be awarded;
(g) once a booking is confirmed no changes are allowed, unless otherwise authorised by the Promoter in its absolute discretion. Any changes permitted by the Promoter will incur a fee of $150 per person (including GST plus supplier charges) which is payable by the major prize winner and/or their companion/s;
(h) where the major prize is cancelled due to unforeseen travel restrictions related to COVID-19 (as determined by the applicable local or federal government), the Prizing Agency will use its best endeavours to reschedule to an alternative date (one revision only). The major prize winner and their companions each acknowledge that, in this instance, some elements of the trip may be non-refundable and therefore that element of the prize will be forfeited when re-booking. Any further date changes permitted (as a result of government determined COVID-19 restrictions) will be determined by the Promoter in its absolute discretion;
(i) should the major prize winner wish to extend their trip, permission must be sought from the Promoter, who will decide whether to grant such permission in its absolute discretion. In the event the Promoter agrees for the major prize winner and/or their companion/s to extend their trip, all additional expenses will be at the major prize winner's and or their companion's expense, including any costs to add travel insurance policy/ies for the full duration of the trip; and
(j) it is recommended that major prize winner and their companions obtain their own travel insurance.
5 Unless expressly stated in these terms and conditions, you/your companion/s are responsible for all other unspecified costs related to any prize, including (as relevant) meals, additional spending money, additional transport, insurance (including excesses), in-room charges (such as mini-bar, room service, laundry and telephone calls), additional taxes and costs associated with ongoing use of a prize, etc. Event tickets can only be used once and will be deemed invalid if copied. The Promoter does not control entry to any event location. The major prize winner must keep their tickets safe and the Promoter will not replace lost or stolen tickets.
6 The Promoter is not responsible for any dispute between you and any person with whom you choose to, or choose not to, share a prize.

7 The Promoter accepts no responsibility if one or more of the events or activities awarded as part of the major prize are abandoned, called off or postponed for any reason. In that case you/your companion/s forfeit your entitlement to that event/activity.
General
8 Any failure by you or (if applicable) your companion/s to comply with the conditions imposed by the prize supplier(s) may result in the prize being cancelled or withdrawn without liability for the Promoter or the prize supplier(s).
9 If specified, in order to participate in the activity/activities awarded as part of the major prize, you/your companion/s must comply with any applicable conditions (e.g. height, weight, health and fitness requirements). You must ensure that you/your companion/s are healthy and fit enough to take the prize. You/your companion/s must follow all requirements of the people responsible for managing the relevant activity/ies.
10 If you win the major prize, you/your companion/s must, if required by the Promoter, sign prize booking forms (including a liability and publicity waiver) and disclaimer and release forms provided by the Promoter in favour of the Promoter and other parties within 1 month of the major prize being successfully claimed and verification of the major prize winner. If you or any companion/s do not sign, your entry will be deemed invalid and you will lose any entitlement to the major prize.
11 If you or your entry are deemed by the Promoter to breach these Terms and Conditions, your entry (or at the Promoter's discretion, all of your entries) may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries and/or verifying your identity (including documentation establishing your identity, age, place of residence and place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.
12 You must not:
(a) tamper with the entry process (including but not limited to manipulating the system via bots, script use, or any other means to circumvent the entry process);
(b) engage in any conduct that may jeopardise the fair and proper conduct of the competition;
(c) act in a disruptive, annoying, threatening, abusive or harassing manner;
(d) do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this competition;
(e) breach any law; or
(f) behave in a way that is otherwise inappropriate.
13 If you win the major prize, you are responsible for any companion/s you choose to take to any element of the major prize and the Promoter may disqualify all entries from, and prohibit further participation in this competition by, you or any or all of your companion/s if they breach these conditions, whether or not legally bound by them.
14 If you (or your companion/s, if applicable), in the opinion of the Promoter (and/or a medical professional, as relevant to the circumstances), are intoxicated, under the influence of alcohol or any other drug, behave aggressively or offensively, or behave in a manner which may diminish the good name or reputation of the Promoter or any of its related entities or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate, the Promoter may cancel the prize or restrict you (and your companion/s) from participating in any elements of the prize, at its discretion.
15 The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.
16 If any dispute arises between you and the Promoter concerning the conduct of this competition or claiming a prize, the Promoter will take reasonable steps to consider your point of view, taking into account any facts or evidence you put forward, and to respond to it fairly within a reasonable time. In all other respects, the Promoter’s decision in connection with all aspects of this competition is final.
17 Prizes cannot be transferred or exchanged nor (except where cash is specified) redeemed for cash. Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement. The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in prize value. You agree that if a prize (or element of a prize) is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities.
18 By entering, you request that your full address not be published.
19 Printing and other quality control errors outside the Promoter’s control will not invalidate an otherwise valid instant win prize claim. Every instant prize claim in excess of the advertised prize pool will be honoured, unless the claim is rejected due to fraud or ineligibility under these Terms and Conditions.
20 If this competition cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, government directives, pandemic, public health orders and the like, the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants, subject to any necessary approval by the state/territory gaming authorities.
21 The Promoter is not responsible for any tax implications arising from you winning a prize. You should seek independent financial advice. If for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
Liability
22 Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).
23 Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury (including allergies, skin conditions or other reactions, as relevant), illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
24 Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to or delay in delivery of prize/s, or for any damage that occurs to displayed prize/s (where relevant). Unless otherwise specified, prize/s will only be delivered to addresses in Australia.
25 This competition is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram and Twitter. You provide your information to the Promoter and not to any social media platform. You completely release any relevant social media platforms from any and all liability.
