1. Information on how to enter and prizes form part of these Conditions of Entry. Registration for and/or participation in this competition is deemed acceptance of these Conditions of Entry. Acceptance of these Conditions of Entry is a condition of entry to this competition.

2. For the avoidance of doubt, the daily prize element of this promotion is a game of chance and skill plays no part in determining the daily prize winners. Prize recipients determined in accordance with the Daily Prize Section of these conditions of entry, are authorised under,Permit No: SA T23/2065; ACT TP 23/02688; Ends 21/02/2024.

3. Entry to this competition commences at 7am AEST on Tuesday 06/02/2024 and closes at 11:59pm (midnight) AEST on Wednesday 21/02/2024 (Entry Period).

ENTRY

4. Entry is open to Australian residents living in Australia with a live human child or grandchild (who is also an Australian resident) aged from newborn to 3 years. Entrants must be members of the Bonds & Me Loyalty Program and subscribe to receive marketing emails from the Promoter. In these terms and conditions, once an eligible child is entered into the Competition, the child is referred to as the Entered Child.

5. There are three categories of entry (“Category”), based on the age of the Entered Child as at Wednesday 21/02/2024, as follows:

Newborn – aged up to 6 months (ie born on and from 21/08/2023 to 21/02/2024)
Baby – aged between 6 months and 2 years old (ie born on and from 21/02/2022 to 20/08/2023)
Toddler – aged between 2 years old and 3 years old (ie born on and from 23/02/2020 to 20/02/2022)

If requested by the Promoter, entrants agree to provide a copy of the Entered Child’s birth certificate to allow verification of their date of birth.

6. A child that has been a major winner or on a published shortlisted in a previous Bonds Baby Search competition is not eligible to be entered in the competition.

7. A child that has previously been engaged by the Promoter as a model is not eligible to be entered in the competition.

8. Entrants may only enter their own child or grandchild, and must be, or have the approval of, each of the Entered Child’s parents and/or legal guardians. If an objection to entry is raised by someone who provides apparent proof of guardianship, the entry will be removed and no further discussion will be entered into by the Promoter.

9. Children from the same multiple birth (e.g. children who are twins, triplets etc.) may be entered either individually or as a group (“Multiple Birth Entry”) but not both individually and as part of a Multiple Birth Entry. In any Multiple Birth Entry, all children from the same multiple birth must be included in the entry and depicted in a single photograph. References to a baby, child or Entered Child in these Conditions of Entry refer to each child in any Multiple Birth Entry.

10. Any Entered Child depicted in an entry must be decently presented and wearing at least a nappy or have equivalent cover.

11. To enter the competition entrants must:

visit the Bonds Baby Search website http://www.bonds.com.au/babysearch (Competition Website);
Log in to your Bonds & Me Account and ensure you are subscribed to receive emails, or register as a Bonds & Me Member and subscribe to receive emails;
register as an entrant;
upload a single photograph of their Entered Child that meets the requirements stated on the Competition Website, including the following requirements:
photographs must be in jpeg, gif or png form and under 5MB in size;
only a single photograph, depicting a single image of the Entered Child, is accepted;
no person’s face other than that of the Entered Child can appear in the entered photograph;
photographs must be of the Entered Child and taken no more than 1 month prior to entry; and
entrants must own the copyright of any photograph uploaded or otherwise be entitled to use the photograph in this way;
fill in and submit the entry form online at the Competition Website.

12. An Entered Child may only be entered once in the competition.

13. Employees of the Promoter and the Promoter’s suppliers and agencies associated with this competition (and those employees’ immediate families) are ineligible.

14. Entrants warrant and agree that, without limitation:

they will not submit any material (including without limitation, the entry itself, images, answers to questions, posts or comments on the Competition Website or elsewhere in relation to this competition or any entrant or entry) (Content) that is unlawful or fraudulent or that may be in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, politically incorrect, violent, abusive, harassing, threatening, racist, ageist, sexist, objectionable with respect to religion, origin or gender, not suitable for children under 15, or otherwise unsuitable for publication in the context of this competition;
they will only submit Content which they have personally created or have the right to submit;
their entry will not contain viruses or cause injury or harm to any person or entity;
they have the approval of all parents and/or legal guardians of the Entered Child;
they will comply with these Conditions of Entry and with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems;
they have the full authority to grant to the Promoter the rights referred to in these Conditions of Entry; and
they will indemnify the Promoter against all costs and claims by third parties arising from a breach these Conditions of Entry.

15. Entrants agree:

they are fully responsible for the Content which they submit. The Promoter may, in its sole discretion, determine whether an entry will be posted, or remain posted on its websites. The Promoter reserves the right to vet or remove any Content at any time in its absolute discretion. However, the Promoter is not responsible for any Content uploaded to the site and visitors to the site view it at their own risk. Notwithstanding any decision by the Promoter to post Content on its website, the terms and warranties set out in these Conditions of Entry continue to apply;
to waive, and hereby do waive, any legal or equitable rights or remedies they have or may have against the Promoter with respect to the entries and Content they submit and their use of the Competition Website, and agree to indemnify and hold the Promoter, its officers, agents and affiliates harmless to the fullest extent allowed by law regarding all matters related to their use of the site;
to report abuse, harassment, inappropriate content or privacy complaints by emailing bondssupport@hanes.com. The Promoter reserves the right to remove any Content from the Competition Website and invalidate any associated entry without prior notice and for any reason it sees fit in its sole discretion, including if properly notified that such material infringes on another's intellectual property rights.

16. The Promoter reserves the right, at any time, to verify the validity of entries and entrants. The Promoter has the right to invalidate any entry which it considers to be (or may be) in breach of these Conditions of Entry. Promoter’s decision in relation to all aspects of the promotion is final and no correspondence will be entered into. Any materials provided to the Promoter to verify an entry will be used solely for that purpose and will not be publicly disclosed by the Promoter.

17. Following entry, entrants will receive confirmation via email that their entry has been accepted or rejected based on adherence to the entry terms and conditions. Where an entry is accepted, each confirmed entrant will receive:

DAILY PRIZE WINNERS

18. Each 24 hours from midday date to midday date (except the first and last draws which will be from 7am 6/02/24 – Midday 7/02/24 and from midday 20/02/24 – midnight 21/02/24), the Promoter will select a winner from all approved Entered Childs that remain on the Competition Website in each Category at the time of selection (ie three daily prize winners each period). This is a game of chance. Each winner will be drawn at random at 1pm following the relevant time period each day by representatives of the Promoter on the Promotor’s premises. Three separate prize pools exist for the three age Categories with 15 Daily Prizes in each Category. Entrants may only win one Daily Prize.

19. Each Daily Prize winner in the each age Category will receive a $200 Visa digital gift card. Use of the gift cards is subject to Visa standard gift card terms and conditions as described on www.visa.com.au.

20. The total prize pool value of the Daily Prizes is $9,000.

21. Daily Prizes are provided for use by the Daily Prize winners and not for re-sale. All Daily Prize winners remain eligible to be a Bonds Major Category Winner in their Category.

22. Daily Prize winners will be announced on the Competition Website and/or Promoter owned social media pages at approximately 4pm AEDT on the day of the relevant draw (from 7th Feb – 22nd Feb 2024) and notified by email on that same date. Daily Prizes will be sent to the Daily Prize winners from Bonds using the details (including contact number and email address details) provided by the winners with their entries. Prizes will be fulfilled within seven business days of announcement.

23. If for any reason a Daily Prize winner fails to claim their prize within 14 days after the date of the last daily draw, they will forfeit the prize. The Promoter will conduct a draw to determine an unclaimed prize winner (or winners as required to distribute all unclaimed daily prizes) in each Category from all approved Entered Children that remain on the Competition Website in that Category at the time of selection, other than any major category winners. Unclaimed Daily Prize winners will be announced on the Competition Website at approximately 4pm AEDT on draw date and notified by email on that date. Prizes will be sent to the daily winners using the email address details provided by the winners with their entries.

SELECTING THE major category WINNERS

24. Each entry which remains on the Competition Website at the time of judging will be individually judged by representatives of the Promoter in its Category based on the photograph included with the entry and the apparent fit of the Entered Child with the Promoter and its values. The Promoter will also select a second placed entrant who will be the unclaimed prize winner if required under clause 31. The Promoters decisions are final.

25. All Entrants give permission to the Promoter to use their entry Content for the promotion of the Competition during the competition and in relation to the announcement and publicity of winners.

26. This element of the promotion is a game of skill and chance plays no part in determining the major category winners.

ANNOUNCEMENT OF major category WINNERS

27. The major category winners (those chosen by the Promoter) will be announced on Thursday 28th February 2024 from 4pm on the Competition Website and Promoter owned social media pages. All winners will be notified individually by telephone and / or email using details provided in their entry form. The winners may also be announced in other media, for example, in a television program and winners consent to participate, together with their Entered Child, in such reasonable announcements as requested by the Promoter.

major category WINNERS’ PRIZES

28. The prize for each major category winner is $10,000 AUD cash.

29. The total prize pool value for the major category winners is $30,000 AUD.

30. Prizes will be awarded to the winning entrants being the Entered Child’s parent or legal guardian. Winners will need to provide details to the Promoter to enable a oneoff electronic payment directly to their nominated account. Winners will not be requested to provide these details until after the public announcement of winners to reduce the risk of Phishing.

31. If for any reason any Major Category Winner fails to claim their prize within one (1) month of winner announcement, the winner’s prize will be forfeited and the Promoter will award the prize to the unclaimed prize winner from the relevant Entry Category as selected pursuant to clause 24.

32. If requested by the Promoter, winners will sign a legal disclaimer on reasonable terms determined by the Promoter as a condition of taking any prize.

33. All entrants consent to the use of their name and any other Content they submit, including the name and photograph of their Entered Child, by the Promoter for an unlimited period and for any purpose including promoting, publicising or marketing the Competition Website and this competition including any outcome of this competition in any media including at the Competition Website and Bonds social media pages. Without limitation, the Promoter may continue to make the Competition Website available for viewing by the public after the end of the competition, but will allow entrants to remove their entry after the end of the competition. The Promoter shall ensure that any such use is reasonable and reputable. The opportunity to participate in the competition and the chance to win a prize constitutes the entire consideration payable by the Promoter in respect of such use.

34. All taxes (excluding GST) which may be payable as a consequence of receiving the prize(s) are the sole responsibility of the winners.

35. If for any reason this Competition is not capable of running as planned, including but not limited to tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter reserve the right in its sole discretion, subject to any written directions given by any relevant authority in each State and Territory, to cancel, terminate, modify or suspend the Competition.

36. The Promoter may, in its sole discretion, disqualify any entries from, and prohibit further participation in this Competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the Competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.

37. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction or otherwise.

38. The Promoter and associated agencies and companies (and their officers, employees and agents) will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

39. Any change in the value of the prizes occurring between the date of these terms and conditions and the date the prizes are claimed is not the responsibility of the Promoter.

40. All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition and, in the case of the winners, in relation to the delivery of prizes. Detailed information regarding the use and storage of such information is available in the Competition site’s Privacy Policy . The Promoter may disclose Entrants’ personal information to contractors and agents to assist in conducting this Competition including the delivery of prizes, , to communicate with Entrants and where relevant, to State and Territory gaming authorities. Winners’ names will be published if required under the relevant lottery legislation. The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988. 41. The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
