VALENTINES DAY GIVEAWAY T&C's
This giveaway (Giveaway) is operated by Who Is Elijah Pty Ltd (ABN 84 641 759 168) (we, us or our). These terms and conditions (Terms) govern an entrant’s (Entrant) participation in the Giveaway. By participating in the giveaway, Entrants agree to comply with these Terms.

    Eligibility
    (a) The Giveaway is open to Entrants worldwide.
    (b) No purchase is necessary to enter or win. A purchase does not increase the chances of winning. (c) Entrants must have access to the internet and an Instagram account.

    Entry Period
    (a) The Giveaway commences at 9am AEDT on the 1st February 2024 and closes at 9am AEDT on the 13th February 2024 (the Entry Period).

    How to Enter
    (a)  To enter the Giveaway, Entrants must, during the Entry Period:
    i. follow our Instagram pages, @whoiselijahparfum and @raquelbour
    ii. tag a friend in the comments on our Giveaway post on Instagram (one comment = one entry)
    iii. like the Giveaway post
    iv. share the Giveaway post on their Instagram story (bonus entry)

    (b)  Unlimited entries allowed.

    Prizes:
    (a)  The prizes are the following:

    i. 1st prize: Valentino Garavani Rockstud Wallet On Chain worth $1,595;
    ii. 2nd prize: Jacquemus Le Bisou Cadenas Bag worth $645; and
    iii. 3rd Prize: Saint Laurent Monogramme Quilted Cardholder worth $415 (each, a Prize).

    (b)  Where more than one Prize is available, each Winner may only win one Prize.

    (c)  Prizes are non-transferable and cannot be exchanged for cash.

    (d)  In case of unavailability of any Prize, we reserve the right to substitute with a prize of equal or greater value.

    (e)  Entrants are responsible for all expenses incurred when entering the Giveaway and accessing, claiming and/or using the Prize (unless otherwise stated on our Site).

    Selection of Winners:
    (a)  The winners (Winners) will be selected randomly from all eligible entries received during the Entry Period through an electronic random draw. The draw will take place on the 14th February 2024 (Draw Date).

    (b)  The Winners will be notified through Instagram direct message by us following the draw.

    (c)  If the Winner does not respond within 48 hours from the notification, another draw will be conducted.

    (d)  The Winner's full name and city of origin may be published on our Site or on our social media accounts, including but not limited to, Facebook, Twitter and Instagram, within 30 days of the Draw Date. By entering this Giveaway, all Winners grant us the right to use their full name, likeness, image, voice, and/or appearance as such may be embodied in any pictures, photos, video recordings, digital images, and the like, taken or made on behalf of the Giveaway.

    (e)  We agree to cover the cost of delivery of the Prize to the Winner.

    Liabilities
    (a) Non-Excludable Guarantees: Nothing in these Terms limits, excludes or modifies or purports to limit, exclude or modify any legislation which cannot lawfully be excluded or limited, including the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or any other applicable State or Territory legislation (Non-Excludable Guarantees).

    (b) Liability: Despite anything to the contrary, but subject to the Non-Excludable Guarantees, each party’s aggregate liability for any liability arising from or in connection with these Terms will be limited to the value of the Prize.

    Miscellaneous:
    (a)  Amendments: We reserve the right to modify these terms and conditions or cancel the Giveaway at any time.

    (b)  Disputes: In the event of a dispute, Entrants must contact us and attempt to resolve the dispute in good faith. If the matter cannot be resolved, either party may refer the matter to a mediator. The costs of the mediation will be shared equally between the parties.

    (c)  Governing Law: These Terms are governed by the laws of New South Wales.

    (d)  Instagram: This Giveaway is not sponsored, endorsed or administered by, or associated with Instagram. Please ensure that you comply with all the rules of Instagram when using their platform for the Giveaway.

    (e)  Intellectual property rights: All intellectual property rights in the entries vest in us upon submission of the relevant entry.

    (f)  Invalid entries: Incomplete and ineligible entries will be deemed invalid. Entries will also be deemed invalid if they breach these Terms or our content guidelines. If a Winner's entry is deemed or found to be invalid, we may redraw or decide on another winning entry.

    (g)  Privacy: We will handle your information in accordance with our privacy policy, available at whoiselijah.com.au .
