Terms and Conditions:
Information on how to enter the Competition and prizes forms part of these terms and conditions. By participating in this Competition you accept these terms and conditions. Entries not made in accordance with these terms and conditions will be disqualified.

Section 1: Competition
1. Competition: Play our “Tic Tac Fresh Entertainment” Online Competition and register to be eligible to win Daily Prizes and the Grand Prize.
2. Promoter: Ferrero Australia Pty. Ltd (ABN: 29 001 249 261), of Level 18, 168 Walker Street, North Sydney NSW 2060.
3. Competition Period: The competition commences at 00.01 EDT on <08/08/2010>and closes at 23.59 EDT on <28/08/2010> (“Competition Period”).

Section 2: Eligibility
1. Eligibility To be eligible to enter the Competition and win a prize, the entrant must:
(a) be above 18 years of age
(b) be an Australian resident
(c) complete a valid online entry form in accordance with these terms and conditions; and
(d) play the online game “Tic Tac Bounce” as a part of the “Tic Tac Fresh Entertainment” Online Competition and register a high score as per these terms and conditions. (“Eligible Entrant”)

2. Non-Eligibility
Entrants are not eligible to enter the Competition or win any prize if they are a director or manager of the Promoter or an employee or immediate family member of an employee of the Promoter, or an employee of the Promoter‟s agencies associated with the Competition. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
3. Any personal information or contact details entered incorrectly on the online entry form will result in that entry being invalid. Incomplete, indecipherable or illegible entries will also be invalid.

Section 3: To enter the competition
1. An Eligible Entrant must use a compatible browser to visit the Competition Website: www.tictac.com.au/freshentertainment during the Competition Period and play the online game “Tic Tac Bounce”. To be successful in the online game and be eligible to win a prize, the Eligible Entrant has to catch as many “Tic Tacs” as possible before their time runs out and score points, as explained in the “how to play” section within the website.
2. To be able to claim a prize, the entrant must provide all details requested at the Competition Website, including first and last names and e-mail address. If an Eligible Entrant is a winner he or she must also provide his or her street address details to the Promoter within the timeframe specified in any request from the Promoter to allow prize delivery.
3. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant:
(a) fails to establish their entitlement to enter the Competition; or
(b) tampers with the entry process, benefits from such tampering; or
(c) submits an entry which is not in accordance with these conditions.
The Promoter also reserves the right, at any time, to verify the validity of entries and entrants (including an entrant‟s identity, age and address). Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
4. Any costs associated with accessing the Competition Website are the responsibility of the person seeking access and are dependent on the Internet service provider used.
5. Eligible Entrants must complete their online entry forms manually using an Internet browser. The Promoter may reject any online entry form if the Promoter reasonably forms the opinion that it has been entered using automated entry means.

Section 4: The Game

1. This competition is a game of skill. Chance plays no part in determining the winners. All Eligible Entrants will be subject to the same rules and conditions while playing the online “game”. The score of each Eligible Entrant will be determined as a result of his or her skill and ability to negotiate the challenges of the game and the strategies employed to score more points.

The online game is played by controlling the hand and throwing the “Tic Tacs” towards the computer controlled characters in the game by moving the hand and placing the ”Tic Tac” in the best positions for the characters to catch, and score points.

Invite a minimum of 5 friends via the website during the Competition Period and receive 10 seconds of extra time in all of the next games played valid up until the end of that day. All email addresses must be valid. The invited friend does not have to play the game for the entrant to receive extra time (sending a valid invitation is sufficient).

Invite a minimum of 10 friends via the website during the Competition Period and receive an extra 10% of points each time you score in all of the next games played valid up until the end of that day. All email addresses must be valid. The invited friend does not have to play the game for the entrant to be eligible to receive the extra 10% of points scored (sending a valid invitation is sufficient).

NOTICE: Entrants must only nominate friends, family, colleagues and other individuals who they have a direct relationship with, and who consent to receiving these types of messages.

Aim the Tic Tac and successfully hit the clock in the game while in play to receive 10 seconds extra time in the particular game being played. Aim the Tic Tac and successfully at the mug in the game while in play to receive 250 extra points in the particular game.

Any entrant can upload a photograph of themselves and customise the characters in the game in accordance with these terms and conditions.

By uploading a photograph, the entrant provides that photograph to the Promoter and the entrant warrants that the photograph is a photograph of that entrant and that the entrant owns all rights in relation to that photograph and consents to its use by the Promoter for the purposes of this Competition. The Promoter reserves the right to reject any photograph provided for any reason and, at any time, to remove any photograph from the Website that was accepted.

Eligible Entrants who provide a photograph of themselves will be reviewed each day and the 3 who have scored the highest points for the duration of that day (between 00.01 EDT to 23.59 EDT) will be featured 24 hours later on www.tictac.com.au/freshentertainment as „today‟s guest stars‟. The next day, they will also be featured in display advertising on other various AU websites; MTV AU, Gorilla Nation AU, MySpace, Sound Alliance AU, YouTube, Sensis and Guvera. Entrants must provide photographs of themselves and provide permission for the use of the photographs in accordance with these terms and conditions to be eligible to become “guest stars”. Each Entrant can become a “guest star” only once during the Competition Period.


2. Entrants can play the game multiple times and have multiple entries at any time. Each game must be played in accordance with these terms and conditions.

Section 5: Prizes
The prizes will be awarded in the following order and consist of the following:

1. Prize Components:

a) Daily Prizes: There are 21 Daily Prizes (1 per day for 3 weeks). An Eligible Entrant who plays one or more games on any day during the Competition Period and scores the highest points for the duration of that day (between 00.01 EDT to 23.59 EDT) (Game Day) and who has not previously won a Daily Prize will be rewarded with an Apple iPod Nano 16 GB (colour options are not available, and will depend on stock availability) valued at AUD$249.00 RRP, which will be mailed to the winners via registered post.

b) Grand Prize: The one Eligible Entrant who scores the highest points for the duration of the Competition Period (00.01 EDT Sunday 08/08/10 to 23.59 EDT Saturday 28/08/10) will be rewarded with an Apple iPad 64 GB valued at AUD$879.00 RRP, which will be delivered to the winner via courier.

Limit one Daily Prize per person. In the event that the same entrant has the highest daily score more than once, the entrant with the next best score in line on that Game Day will be awarded the Daily Prize.

In the event of a tie (either for a Daily Prize or the Grand Prize), the entrant‟s accuracy percentage and time completed including any bonus time will be used to determine the winner. If two entrants are on the exact score, the entrant with the higher accuracy percentage who reached the score in shorter amount of time will be the winner.

The total prize pool is AUD$6,108.00


2. Prize Conditions: The prizes are subject to the following conditions:
(a) No exchange of prizes: prizes can be transferred to a person 18 years or over at the absolute discretion of the Promoter. Prizes cannot be exchanged or redeemed for cash. If for any reason a prize winner cannot take the prize or any component of the prize then the prize will be forfeited;
(b)Taxes: if the prize or receipt of it incurs a tax liability, the prize winner is liable for payment of such tax;
(c) Prize Availability: In the event that a prize is unavailable to the winner of the prize for any reason, the Promoter reserves the right to substitute that prize with another prize of equal value and/or specification and the prize winner will be notified accordingly via email;
(d) Changes of prizes: The Promoter shall not be liable for any changes to the value or make up of products offered as the prize.

Section 6: Prize Winners
1. Contact: The Promoter will contact prize winners by email each week day during the Competition starting on 09/08/2010 (for the Daily Prizes) and 30/08/10 (for the Grand Prize) to confirm and collect address details. Friday, Saturday and Sunday winners will be contacted on the following Monday. The names of the prize winners will also be published at www.tictac.com.au/freshentertainment each week day during the Competition starting on 09/08/2010 (for the Daily Prizes) and 30/08/10 (for the Grand Prize). Friday, Saturday and Sunday winners to be announced on the following Monday.
2. Claim of Prize: Each Eligible Entrant who wins a prize will be sent an email to the email address nominated in his or her online entry form (“Winner Email”). The winner must reply to the Winner Email specifying the street address to which the prize should be delivered (Winner Email Reply). If the winner does not send a Winner Email Reply to the Winner Email within fourteen days of the date of the Winner Email, that prize will be forfeited and the winner will have no entitlement to a prize.
3. Dispatch of Prizes: Any prize won by an Eligible Entrant who is a winner will be dispatched within 28 days of the Promoter receiving a valid Winner Email Reply from that winner. Prizes will be dispatched to the address specified by the winner in his or her Winner Email Reply. The Promoter will not be liable for any error or omission in the address nominated by the winner or for any error or omission in the delivery process.
4. Winner Publicity: In accepting the prize, the winners agree to participate in any publicity arrangements made by or on the behalf of the Promoter. The winners further grant to the Promoter the right to publicise their name, photographs and use their name and photographs in a variety of materials, including but not limited to electronic newsletters, websites, and other promotional material without any payment being made to them in respect of this Competition.
5. Unclaimed Prizes: Sixty days after the finish of the Competition Period the Promoter will dispose of any unclaimed prizes by awarding them to the Eligible Entrants who scored the highest points during the Competition Period (and have not already been awarded a prize) in descending order until all prizes have been awarded and dispatched.

Section 7: General Conditions
1. Duration of the Competition If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition at its own discretion.
2. Lost, Delayed Communication: The Promoter has no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication including any communication sent to (or by) the Promoter or to any entrant, whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of administering this Competition (whether as a result of one of the foregoing causes or otherwise).
3. Release: To the fullest extent permissible by law, each entrant in the Competition including without limitation the prize winners, releases the Promoter from any claim, loss, damage, expense (including any claim for legal expenses), cost or charge sustained or incurred in any way by such entrant in connection with a prize or their participation in the Competition. The Promoter and its related bodies corporate and their officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect and consequential loss) suffered or sustained in connection with this Competition, or the use of any prize, except for any liability which cannot be excluded by law. Further, to the fullest extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, technical problems, or traffic congestion on the Internet or any website, or any unauthorised intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to entrants‟ or any other person‟s computer related or resulting from participation in or downloading or uploading any materials in this Competition.
4. Force Majeure: The Promoter will not be responsible for any act, omission, or delay by the Promoter that is due to an act of God, riots, acts of terrorism, storms, fire, any labour or industrial dispute, any strike, and other matters which are not reasonably within the control of the Promoter.
5. Disputes: In the event of a dispute, the decision of the Promoter is final and binding and no correspondence will be entered into.
6. Privacy Notice: During the course of the Competition, the Promoter may collect personal information in relation to entrants. This may include, but is not limited to, their name, email addresses, telephone number, address and
photographs. Each entrant‟s personal information is collected so the Promoter is able to conduct the Competition and to contact and award the prize to the prize winners, to publish the results of the Competition and to publicise the Competition.
7. Consent to use of Personal Information for Marketing Purposes: By entering this Competition, unless otherwise advised by the Eligible Entrant, each Eligible Entrant consents to the retention and use of the information collected pursuant to Clause 6 by the Promoter. The Eligible Entrant‟s personal information including all photographs may be used for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the Eligible Entrant. For details about the Promoter‟s privacy policy, Eligible Entrants can contact the Promoter at the address provided in Section 1, Clause 2 or see http://tictac.com.au/privacy-policy. Eligible Entrants should direct any request to access, update or correct information to the Promoter. All online entry forms become the property of the Promoter.

CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON
ANY WEBSITE ASSOCIATED WITH THIS COMPETITION, TO CAUSE DAMAGE TO OR TO
INTERFERE WITH THE FUNCTIONING OF THE PROCESSES, OR TO OTHERWISE
UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK
DAMAGES AND OTHER RELIEF TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.

This comp proves that its always wise to read the T&Cs
