Vantage Fuels “Win a Car Promotion”
Terms and Conditions
1. Information on how to enter forms part of these conditions of entry. Participation in this promotion constitutes acceptance of these conditions of entry.
2. Entry is open only to Australian residents except directors, management and employees (and the immediate families of directors, management and employees) of the promoter and the agencies or companies associated with this competition. Children under the age of 18 years who satisfy these conditions may enter the promotion with their parent’s or legal guardian’s consent.
3. The promotion begins on 15/8/2010 at 7.00am and closes 31/10/2010 at 11.59pm (the promotion period).
4a. To enter, consumers must purchase 40 litres of any fuel product from a participating Vantage Fuels outlet (outlets) during the promotion period. Upon purchase the customer will receive a Scratchie ticket which will reveal either “Congratulations, You have won an instant prize” or “No instant prize this time”. The customer will write their name and address on the back of the scratchie ticket and place this ticket in the entry box at the store.
4b. The winner of an instant prize will draw a ticket out of a separate barrel which will tell them what their instant prize is (this instant prize will have a minimum value of $1.00). One in every 10 scratchie tickets will reveal an instant prize. These prizes will be either a confectionery, drink or ice cream item from the store or a cents per litre discount off fuel on your next visit. A list of possible instant prizes is available in store.5. Customers may enter as many times as they wish.6. The promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The promoter is not liable for any consequences of user errors including (without limitation) costs incurred.
7. The Promoter needs to collect information about you to record your details for the competition and to notify you if you are the winner. Vantage Fuels respect your privacy and will only use this information for this competition.
8. At the conclusion of the promotional period, one entry from each of the 16 outlets will be drawn out from all entries received over the promotional period, resulting in 16 finalists. This draw will take place at 3.00pm on Friday 5th November at the offices of Vantage Fuels, 7 Woodlands Court, Bendigo East, 3550. Finalists will be advised by telephone and in writing. The final draw will be conducted at 12.00pm on 20/11/2010 at the offices of Brian Dunn Ford, Midland Highway, Epsom. The 16 finalist (or their appointed representative) will each draw from a bag one remote car locking device. The finalist who holds the remote car locking device that unlocks the car will win a 2010 Ford Fiesta LX 5 Door 5 Speed Manual 1.6L. The prize also includes one year’s registration, one year’s third party insurance, dealer delivery and statutory charges. The vehicle is valued up to $21,350 (inc GST). The prize does not include comprehensive insurance or any other accessories not specified. If the winner of the prize is under the age of 18 years as at the closing date of the promotion, the prize will be awarded to the winner’s parent or guardian. The winner or his or her parent or guardian (Deemed Winner) is responsible for arranging their attendance at the premises of the dealer nominated by the Promoter to collect the vehicle. The Deemed Winner must provide all information and sign all documentation necessary to enable the Promoter to register the vehicle in the name of the Deemed Winner prior to collection. If the Deemed Winner is, through any legal incapacity or otherwise unable to register the vehicle in his or her name then he or she, notwithstanding any condition set out in these conditions of entry to the contrary, assign the vehicle to another person with legal capacity for the purposes of registering the vehicle. The other finalists will each receive a consolation prize of a 42” LG Plasma TV valued at $1000.9. If the drawn entrant is unable to attend the final draw, they can nominate a proxy to attend on their behalf, or if they cannot be contacted prior to the draw the promoter will provide a proxy to participate on their behalf.
10. The prize winner must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to the Promoter using their name and image in promotional material.
11. The total prize pool is valued at a maximum of $66,350 (inc GST)12. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained ( whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any legal liability which cannot be excluded by law (in which case the liability is limited to the minimum allowable by law).
13. All major prize winners will be advised in writing and will be published in the Bendigo Advertiser and the Herald Sun on Wednesday 24/11/2010. The Promoter may also publish the name and the State/Territory of residence of the winners on its web site or promotional material in store.
14. If the winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and a new winner of the prize will be determined by drawing a further valid entry. The judge’s decision is final and no correspondence will be entered into.
15. Subject to clause 9, the prize is not transferable or exchangeable and cannot be redeemed for cash or any other form of compensation. The value of the prize is accurate as at the commencement of the promotion. The Promoter accepts no responsibility for any variation in the value of a prize after this date. If for any reason a Prize is not available, the Promoter reserves the right to substitute another item for it, in its sole discretion, of equal or higher value, subject to the approval of the gaming authority.
16. The promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this Promotion by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the promotion or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
17. If for any reason any aspect of this promotion is not capable of running as planned, including by reason of unauthorised intervention, fraud, technical failures or any cause beyond the control of the promoter which corrupts of affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to approval of the gaming authorities in the state of Victoria, where applicable.
18. Printing error(s) and other quality control matters will not be used as a reason for refusing payment of prizes.
19. The promoter accepts no responsibility for any tax implications that may arise from the prize. Independent financial advice should be sought. Where the operation of this Promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
