TERMS AND CONDITIONS OF PROMOTION
1. Information on how to enter the competition forms part of these terms and conditions. Participation in competition constitutes acceptance of these conditions of entry.
2. The competition is being run at by The Myer Centre, 91 Queen Street BRISBANE QLD 4000 („the Centre‟)
3. The competition commences at 8am Thursday 1 September 2010 – 5.30pm Thursday 30 September 2010 (“Promotional Period”).
4. The promoter is Colonial First State Property Management Pty Ltd (ABN 96 101 504 045) as disclosed agent for the Owner of The Myer Centre 91 Queen Street BRISBANE QLD 4000 Telephone: 07 3226 6900 ('Promoter').
5. Entry is only open to Queensland residents over the age of 18.
6. People may enter the competition by being photographed on the city streets of Brisbane by The Myer Centre photographer. All photographs will be uploaded onto an LED screen in The Myer Centre food court (Level E). One photograph each day (The Winner) will be uploaded onto The Myer Centre‟s Facebook page (
http://www.facebook.com/pages/The-Myer-Centre/397238217386). Each winner will be required to „Tag‟ themselves in the photograph on The Myer Centre‟s Facebook page.
7. The Promoter reserves the right, at any time, to verify the validity of entries, and entrants (including an entrant‟s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8. The nominated prize is one (1) Myer Centre gift card to the value of $200 each weekday for 16 days. There is a total of (16) $200 Myer Centre gift cards available over the Promotional Period.
9. The winner of the competition will be selected at random from those who have been photographed. The winner will be drawn each day by 5.30pm.
10. The Promoter reserves the right to draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
11. The winner of The Prize will be announced on Facebook and will be contacted by the Promoter.
12. The prize is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
13. If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
14. By entering the competition, an entrant releases and indemnifies the Promoter from and against all actions, liabilities, penalties, claims or demands the entrant may have against the Promoter or that the Promoter may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of an entrant entering or participating in the promotion or winning or failing to win a gift, or using or permitting any other person to use the gift, except for any liability which cannot be excluded by law or which would cause any part of this clause to be void or unenforceable.
15. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, gift suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic or mail messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
