1) Information how to enter the competition and the Prize form part of these Terms and Conditions of Entry. Participation in this competition constitutes acceptance of these Terms and Conditions of Entry.
2) This competition is being run at the following shopping centres –
VIC: Northland Shopping Centre (2-50 Murray Road East Preston VIC 3072);
QLD: The Myer Centre Brisbane (91 Queen Street Brisbane QLD 4000);
SA: The Myer Centre Adelaide (Level 6, Myer Centre Adelaide Rundle Mall Adelaide SA 5000)
(each referred to as the “Centre”).3) Entry is only open to Australian residents.
4) Officers, management and employees (and their immediate families) of the Promoter, the Promoter’s associated companies and contractors, retailers at the Centre and agencies associated with this competition are ineligible to enter.

The competition commences at 9:00am on 9 September 2010 and ends close of business on 30 September 2010 ("Promotional Period").6) To be eligible to enter, individuals must spend a minimum of $250 at selected fashion and beauty specialty retailer(s) in the Centre during the competition period (“Minimum Spend”), and present their original purchase receipts to a staff member at the Centre’s customer service desk as proof of purchase during the competition period, in order to receive a promotional keyword from the staff member. A full list of participating fashion and beauty specialty retailers can be found at the Centre’s customer service desk.7) To enter, individuals must then send an SMS to 0421 263 336 containing the promotional keyword, their first name, surname and residential postcode (in that order with a space between each item), so that it is received by 11:59pm AEST on 30 September 2010.

SMS entry cost will vary dependent on the mobile network used but will not exceed 55c. SMS entries via the Internet are ineligible. Entries are deemed to be received at the time of receipt into the competition database and NOT at the time of transmission by the entrant.
9) The Minimum Spend may be made at multiple selected fashion and beauty specialty retailers within the same participating Centre and may include retailer gift card purchases. Transactions undertaken at department stores, supermarkets and any other retailer not specified on the full list of participating stores are ineligible. Layby, ATM, bill payment and cash withdrawal transactions are ineligible.
10) Multiple entries permitted, subject to the following: (a) only one entry permitted per Minimum Spend; (b) each entry must be submitted separately and in accordance with entry requirements; (c) unrecognised promotional keywords will be deemed invalid; and (d) only one entry can be submitted per person, per day.11) An entry is only considered valid if the entrant agrees to the Promoter's reasonable request, to participate in any public relations activities the Centre undertakes about the Prize (such as publicity events and/or other photo shoots) if the entrant wins the Prize, for an unlimited period, without remuneration.
12) An entry that is incomplete, indecipherable or non-compliant with these Terms and Conditions of Entry is invalid and will not be accepted or considered.
13) The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence and place of employment) or claims for the Prize and reserves the right to disqualify any entrant for tampering with the entry process (including, but not limited to, tampering by way of use of techniques designed to avoid the payment of SMS costs) or for submitting an entry or claim for the Prize which is not in accordance with these Terms and Conditions of Entry. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
14) If there is a dispute as to the identity of an entrant, the entrant will be deemed to be the person in whose name the mobile phone account is held.
15) Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to the Prize. Purchase receipt(s) must clearly specify the store of purchase, the products purchased and that the purchase was made during the competition period but prior to entry.
16) The national prize is one (1) $3,000 gift card, redeemable at the Centre where the winner entered the competition from (the “Prize”).
17) The winner of the competition will be determined by a random draw. The first valid entry drawn will win the Prize. The draw will take place at BoilerRoom, 6 Bay Street, Port Melbourne VIC 3207 at 11:30am AEDST on 15 October 2010.
18) The Promoter reserves the right to draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
19) The drawn entrant will be required to provide proof of identity and proof of purchase on acceptance of the Prize.
20) The winner of the Prize will be notified by telephone and the Promoter will record their address details so that the Prize may be awarded within 2 days of the draw. The winner will also be notified in writing. The winner’s name will also be published in The Australian newspaper on 21 October 2010.
21) The Prize must be collected from the Centre Management office of the participating Centre that the entrant entered the competition at a date agreed upon by Centre Management and the winner. Failure to collect the Prize within three month’s time of the draw will result in the Prize being forfeited. The Prize is non-transferable, non-exchangeable and cannot be redeemed for cash.
22) Any ancillary costs associated with redeeming the gift card are not included. Any unused balance of the gift card will not be awarded as cash. Redemption of the gift card is subject to any terms and conditions of the issuer
including those specified on the gift card and wallet. The gift card prize will be valid for redemption from 21 October 2010 until 20 October 2011. The gift card may only be used at participating retailers who accept gift cards at the Centre.
23) A draw for the Prize, if unclaimed within three month’s time of the draw, may take place on 17 January 2011 at the same time and place as the original draw to award the unclaimed Prize, subject to any directions from a regulatory authority. The winner of the unclaimed Prize will be notified by telephone and the Promoter will record their address details so that the Prize may be awarded within 2 days of the draw. The winner will also be notified in writing. The winner’s name, if any, will also be published in The Australian newspaper on 21 January 2011.
24) It is a condition of entry that the entrant consents to the Centre using the entrant's name, likeness, image and/or voice in the event they are the winner of the Prize (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products or services, distributed and/or supplied by the Promoter or the participating Centres.
25) If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the competition, as appropriate.
26) Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the Prize.
27) The Promoter's decision is final and no other correspondence will be entered into.

Privacy Statement
The Promoter collects personal information in order to conduct the competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, Prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information.
Unless otherwise advised by the entrant, the Promoter may also, for an indefinite period and without any future reference or payment or other compensation to the entrant: use the entrant's personal information for promotional, marketing, publicity, research and customer profiling purposes, including sending electronic or mail messages or telephoning the entrant.
All personal information of the entrant will be stored at the offices of the Promoter. Entrants should direct any request to access, update or correct information to the Promoter.
