Terms and Conditions
1. Information on how to enter and prizes form part of these terms and conditions. Any entry not complying with these Terms and Conditions will be deemed invalid. Participation in this competition is deemed acceptance of these Terms and Conditions.
2. Entry is only open to residents of Australia over the age of 18 years of age. Employees of the Promoter, their immediate families and any agencies associated with this promotion are ineligible to enter.
3. The competition commences 29th September 2010 and concludes 1st November 2010 by last mail received for mail entries or at 11:59pm Australian Eastern Daylight Saving Time (AEDST) for email entries (“Competition Period”).
4. To enter, tell us in 25 words or less: “What is essential to your health and why?” Valid entries must contain the following information:
a) The entry statement;
b) your first and last name;
c) your email address;
d) your home address; and
e) your daytime telephone number and area code
5. Entry is via email or post:
a) Email- send entry to

b) Post – on a piece of paper write all the details listed in term 4 above. Send your completed entry by mail in a stamped / franked enveloped to “UNCLE TOBYS PLUS Essentials for Women Competition”, PO Box 457, Eastern Suburbs MC, NSW, 2004
6. Only one entry per person permitted. The Promoter reserves the right to verify the validity of entries, entrant’s identity and place of residence, and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of their rights at any stage does not constitute a waiver of those rights.
7. Judging will take place at the promoter’s premises and will commence on 3rd November, 2010. The 10 winners will be notified by telephone or mail on 8th November, 2010. This competition is a game of skill and chance plays no part in determining the identity of the 10 winners. All valid entries received during the Competition Period will be individually judged based on literary and creative merit and originality and then 10 judged to be the best will each win the prize.
8. Each winner will receive The Fitness and Health package valued at $2,934.77 RRP which includes:
a) Horizon 832 Treadmill valued at $2,199 RRP
b) Sunbeam Café Juice JE2500 valued at $213 RRP
c) Body science work wear, consisting of a ladies compression singlet and Capri pants valued at $200 RRP
d) Good Health 12 month subscription valued at $83.40 RRP
e) The Australian Women’s Weekly 12 month subscription valued at $81.60 RRP
f) The Australian Women’s Weekly ‘Salad’ cookbook valued at $49.95 RRP
g) A 6 month supply of UNCLE TOBYS Plus Essentials for Women valued at $107.82 RRP (based on 18 boxes of UNCLE TOBYS Plus Essentials for Women 620g valued at $5.99)
Any ancillary costs associated with redemption of the prize items will be the responsibility of the winner. Items included in prize pack (including but not limited to colours, designs, material, brands etc) will be determined by the Promoter it its complete discretion. Prizes, or any unused portion of a prize, are not transferable or redeemable for cash. Subscription component of the prize will be delivered to address provided at time of entry. Where a prize item has different sizes, the Promoter will contact the winner to confirm the winner’s preferred size. The Promoter will make all reasonable attempts to supply the prize in the size requested by the winner, however if for any reason whatsoever the size requested is unavailable, the Promoter will deliver the prize item in the closest size available. The 6 month supply of UNCLE TOBYS Plus Essentials for Women (18 boxes) will be made in one delivery.
9. Total prize pool is valued at $29,347.70 RRP.
10. Except for any liability that cannot be excluded by law, the Promoter (including their officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters' control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; and (f) redemption of the prize.
11. Promoters' decision in relation to all aspects of this competition is final and binding on all who enter and no correspondence will be entered into.
12. In the event that the prize is unavailable despite the Promoters' reasonable endeavours to procure the prize within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value and/or specification.
13. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
14. All entries submitted in connection with this promotion will become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter. Each entrant warrants to the Promoter that each entry submitted is an original creative work of the entrant which does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition. The Promoter are entitled to use any of the entries submitted for any purposes at its discretion, including for any future promotion, marketing and publicity purposes without any further reference or payment or other compensation to the entrant.
15. Entrant's personal details will be used by the Promoter for the purposes of administering this promotion. The personal information may also be disclosed to third parties involved in the conduct of this promotion. If you "opt in" to receive marketing material from ACP Magazines then your personal information will also be used for sending you such material. By entering this promotion consent to ACP Magazines so using or disclosing your personal information. Please contact ACP Magazines if you do not wish us to use your personal information for these purposes, or, if you wish to access, correct or update the information. The collection use and disclosure of personal information collected in associated with this promotion is governed by the ACP Magazines Privacy Notice (see contents page of any ACP Magazines Ltd magazine for location in each issue).
